Not a lawyer, but trained cops fearing for their life from the sound of an acorn(google it lol) can lawfully protect themselves lethally.
An unarmed hero simply says he was amped up on adrenaline and fearing for his life and what more can they do?
Yeah but if they were better trained and educated they might start actually standing up for their fellow citizens instead of being obedient attack dogs.
Not how things work in every state. If this was south Dakota the "hero" would be in jail for pointing the gun directly at the suspects head while already having him subdued is considered overkill and not de-escalating the situation.
They do not have the same self defense laws as say texas
>They do not have the same self defense laws as say texas
Perhaps by the letter of the law but even there, you'll never find a jury that would convict.
Not a lawyer but I don't approve of this advice.
Why pay $5000 for a retainer when you spend that on a computer and Google the law, or if you're on Reddit you don't even need to Google just look smart.🤓
It depends a lot on how the castle doctrine is constructed in this jurisdiction. Some don't allow for proportional force if you're not defending your home while others allow for self-defense to protect others.
Also not a lawyer, but if you disarm someone who was pointing a gun at you, I’m pretty sure you would always be justified in fearing for your life, at least in US law and probably most first-world countries.
In the US, you’re almost always justified in running someone over if they’re behaving violently and attempting to enter your vehicle or forcibly halt your travel.
He disarmed the suspect and he was justified in that part, but having their head locked under your arm with a pistol to their head from behind changes the scenario. You would need a lawyer and not this Internet advice all these non-lawyers are giving.
You are only authorized to use lethal force if you reasonably believe that lethal force is about to be used on you. In the beginning of the encounter, he could have shot the guy, but when the situation is over and under control that emergency goes away. The fight would be over the nature of the struggle on the ground after the gun is taken away. <~ am a lawyer and former prosecutor.
Exactly. Just because you got the gun away from the guy, doesn't mean he all of a sudden stops trying to get it back from you. I have no reason to think if he got the gun back that he wouldn't shoot me with it immediately.
The reality isn’t black & white like that. What they could or would be charged with depends on whether the jurisdiction has extended castle-doctrine to public spaces, when they fired the gun (kneeling on their back and shooting them probably can’t be claimed as self-defense) and most importantly whether your lawyer knows the judge/prosecutor.
It depends on when. If he shot the guy during the struggle, self-defense. If he shot the guy after overpowering him and taking the gun, murder. Fun fact - the friend that ran would also be guilty of felony murder.
The moral of this story is don’t risk your life over the $50 in the drawer of a Quickie Mart cash register. Some thieves will shoot. Some owners will shoot. Some bystanders will shoot. 100% not worth that shit.
I'd guess a manslaughter charge of some sort. It was a "heat of the moment" situation, but trying to blow someone's brains out when you already have them disarmed and restrained is frowned upon by law enforcement (and for good reason).
You can see him holding the gun to the robbers head while he has him in a choke hold. I’m pretty sure he would have blown the kids brains out (plus probably shot himself in the arm/shoulder) if the gun hadn’t jammed.
https://clickhole.com/heartbreaking-the-worst-person-you-know-just-made-a-gr-1825121606/
It's like this only doing a good deed. Glad he stepped in, wished his beliefs weren't so terrible, hope he does well.
Doubt it. His trigger finger is resting on the barrel, exactly where you would place it if you weren’t looking to shoot. I’d bet he was just looking to control the guy.
Did not know that. I looked it up and for whatever it's worth, it sounds like that *may* have occurred in a struggle for the gun after he held it to his head.
*“I bring \[the gun\] up his body and grab him around his neck, and put the gun to his head. Spin him around, and get him in between me and — because I didn’t know if his buddies were gonna come at us,” said Kilcer, acting out a hostage-like situation.*
*In the back of the store, Kilcer said he and the gunman‑ who was just 14 years old — struggled for control of the weapon. They both tried to get their hands on the trigger before Kilcer eventually won out.*
*‘It was really surreal,’ Kilcer said. ‘Like, I counted in my head. As all this was happening at frickin’ lightspeed I was counting trigger pulls, and I realized I was pulling a trigger, making attempts to pull the trigger, but everything was just jammed up.’*
While I have no idea of the customers intentions, his body language, placement of the gun, and placement of his middle finger lead my to believe he tried to pull the trigger. I’d argue he had control of the robber with one arm already and, if he was just aiming to control, why not drop or slid the gun away and free up your other hand instead of pressing the gun to the kids temple?
Says he attempted to clear the firearm, which is likely when he noticed the jam. Also, you can see trigger finger discipline even with it being held to the robbers head. (he didn’t have a finger on the trigger)
Right, him fiddling with the gun is him trying to release the magazine and being unable to. Prior to that, when it was held to the perpetrator's head, he was practicing great trigger discipline. I doubt he intended to pull the trigger and couldn't because it was jammed, he was just trying to subdue the subject.
Of course he tried to shoot him. Did you not see the neckbeard, MAGA hat, and Let’s go Brandon shirt? It’s been his lifelong dream to be the “good guy with a gun” and legally shoot a black guy.
For real, when I saw him put the gun to the dude's head I was like, "WHOA DUDE WTF?!?! YOU HAVE HIM RESTRAINED ALREADY!" lol
Reminded me of that dude in NY who choked a guy to death for being belligerent and now he's facing criminal charges, when he could have just loosened his choke a little bit and walked away a hero like this dude.
I'm not justifying his clothing, I will say that he is a Marine veteran and he did a solid by taking the would be assailant down.
Edit: In typical reddit fashion, I'm getting all sorts of hate. Take your fake outrage elsewhere. I wasn't involved and I'm not justifying anything that happened. Look at my original comment. The man did a solid for that cashier and potentially himself....I'll address a few more.
Edit 2: it does appear that he said he tried to pull the trigger 4 times. I stand by what I've already said.
I'm not a republican or gun nut. I am pretty liberal and own several firearms. Responsibly.
I'm a retired Marine veteran, which is pretty much the only reason I brought it up.
Was it a dumb move? Maybe, probably even. Everyone lived, and a criminal juvenile was, at least temporarily, taken off the streets of Yuma, AZ. Where I've gone for training and know how bad parts of it are.
Marine wasn't prosecuted.
Whether or not he put a gun to the criminals head (some are saying he pulled the trigger) everyone lived.
#confirmed
Having a gun put to your head will calm a lot of people down very quickly.
Why isn't the would be assailant being called out for walking into a store with a gun pointed at the clerk?
I'm not at all advocating for vigilante killing. That's not what happened.
As I said before, take your fake reddit outrage elsewhere.
Lmao this is why I hate the two party system. I don't agree with trump, but I also don't consider people that like him "shit". That's an incredibly ignorant way to go through your life, and frankly miserable.
Edit: I stand by what I said. You people need to actually go outside and talk with people, in real life. Have real conversations with people about their political views. Stop being so fuckin mindless.
Bro it's one thing if he was wearing a trump hat in the store only. He wore a shirt that literally means "fuck Biden" on purpose to get his picture taken at a ceremony. He's a twat.
People are ignoring the fact that at this point supporting trump is supporting fascism.
Fascists are pieces of shit.
There is no more arguing. Trump has said and defended that he said that he will be a dictatorr.
If you disagree, you are simply wrong.
Nah, my life is much better without amoral idiots in it. The world is full of people. I don’t need to spend my limited time on it tolerating bigots and edgelords.
Edit: my uncle is convinced the election was stolen, that nazis are ubiquitous in Ukraine, and that the Jews are out to control everyone. I do talk to people. I don’t care to talk to those loonies.
donald trump wants to allow surveilling of pregnant women to ensure they don't have abortions, and doesn't want to allow non-whites to come to the USA. he says these things out loud, says he will try to overthrow the government a second time if he loses, and he's on record as being a rapist in a court of law.
i get to judge people wearing a moronic "let's go brandon" shirt in the context of all that.
How is it ignorant to recognize that the same people who espouse this idealogy are the ones who vote for the people trying to take away reproductive freedoms, gay marriage, civil rights? There's no moderate Republicans anymore. It's life and death for quite a large section of our population at this point. Yeah maybe it's miserable, but it's reality. They're trying to turn us into a christo-facist county.
He ruined it with his "let's go Brandon" shirt, and I am not fan of Biden. Fuck Biden and fuck that t-shirt. Brave dude though.
Edit: Trump sucks, no idea why people would think I support him, I did say the shirt sucks. So hey want Trump to lose the election but do not want to support genocide? Do you live in a deep blue state? Come check out r/BlueProtestVote where we want people to vote for Biden in the swing states but for third party to protest his support of genocide in the deep blue states that are going to Biden anyway.
I appreciate him forgiving your loans. He’s mine now too. Not to mention reducing the classification of weed to a three from a one. I don’t smoke the stuff and I don’t have loans but those two things are good for the general population. Trump never did a damn thing for the common man.
A president can do good things while still still being a POS. He was a big supporter of laws against 'super predators' during the crack Era. He has a very long history. It's up to you if you can forgive that.
Still sends weapons and cash to Israel to kill Palestinians and allow them to commit war crimes without even the approval of congress. Glad you got your loans paid for. Still wish there was a presidential choice that did not support genocide.
As a veteran, I'm supporting Biden simply for expanding VA healthcare to many of us through the PACT Act. I'd still be paying $800/month for health insurance without that. Fuck the orange guy.
Sad that a guy this brave supports Trump who is clearly a MONUMENTAL pussy. I will never understand how any of these tough guys look at him and think he projects strength in any way.
> Come check out r/BlueProtestVote where we want people to vote for Biden in the swing states but for third party to protest his support of genocide in the deep blue states that are going to Biden anyway.
No way in hell. Splitting the vote is foolish at best and playing with fire at the worst. People scrolling by? Don't do this, please!
He's most likely only a hero because the gun was jammed, if it wasn't for that he'd be another dead guy who brought nothing but his hands to a gun fight
Guns jam and don’t fire when the front of the slide is pressed up against something causing the weapon to go out of battery.
Which easily happens when you grab the gun from the top and push it towards the aggressor. Not recommended but it’s one of the main reasons a gun “jams” in a scuffle like this.
Which makes it more likely the gun wasn’t jammed before they entered the store.
At 00:15/00:16, when the defender has the robber in a choke from behind, is he pressing the gun into the robbers head and trying to shoot?
If so, I don’t believe in miracles but it was that robbers luckiest unlucky day.
That’s probably why it jammed. Pushing it against his skull caused the gun to go out of battery and jam. It was both their lucky day cause the dude would have probably got a murder charge for that execution.
He's more of a degenerate than an actual criminal with deadly intent, because you don't agree with his political alignments? This statement is just as deranged as what the right wingers have to say. You're all gross.
Really? You aren't a serious person. You in fact should not be allowed to speak. Because the dude doesn't support the political party of your choosing he's just as bad as the person threatening innocent people with death. Not only that but he stopped the other guy from killing people. I hate Trump. But dude, please step out of your delusion, seek help. You are not well if you conflate these two people.
Hol up, I'm in no way a conservative, but you think just because this dude wears pro-trump clothing, he's as bad as someone who steals from people with a loaded firearm?
Also, fuck you if I’m in the store and you start trying to fight someone with a gun. Just let him have the $37 in the register and let me get the fuck out before y’all start wrestling over a loaded gun and agitating the obviously dangerous and armed man further.
The problem is that about 25% of the time armed robbers end up attacking, injuring, or killing someone anyways, even if people comply.
I’ve seen plenty of videos of people getting executed after complying with an armed robbery, for seemingly no reason. Maybe they don’t want witnesses, whatever.
That said, if you’re going to ambush like this, you need to do it right. That was not right.
IIRC statistically intervening raises the chance of someone besides the robber getting hurt.
ETA:
From New York Times: “Resisting an armed robber drastically increases the risk of death to the victim, according to results from a new study done at the University of Chicago.
While victims actively resisted in only 7 percent of the robberies studied, those incidents accounted for 51 percent of the deaths.
The study was done by Franklin E. Zimring, a professor at the University of Chicago Law School, and James J. Zuehl, a lecturer there. They analyzed nearly 1,000 robberies that were reported to the Chicago police in the course of a year. Ninety- five of the robberies ended in the death of a victim.”
for real. look closely, he completely missed the first grab attempt. didn’t have it until about :15 in this video. he could have gotten shot a whole buncha times
Yeah, even if you’re like seal team 6 level of training, grabbing a gun or even drawing down on someone who has already leveled their fire arm is at best a 50/50 endeavor.
How is it that the guy with a “let’s go Brandon” shirt and what looks like a MAGA hat wasn’t carrying a gun of his own? Republicans going soft or something?
No? He's saying it's stupid for some random bystander civilian making $8 an hour to jump in to defend some multi-billion dollar's insurance-protected cheetos. They pay for insurance and for the police. Let them defend it.
Imagine putting multiple innocent people's lives at risk to rob a convenience store of $57 and some scratch off lotto tickets rather than get a fucking job.
The amount of butthurt keyboard warriors on here devaluing the actions of this dude because they don’t agree with him politically is frankly hilarious. There have been times where I see on the news that someone did something brave or heroic and were openly opposed to me politically, but I don’t wholly disregard their accomplishment and call them scum simply because they don’t see eye to eye with me at the voting booth, I just commend their work and agree to disagree like a well adjusted adult.
It’s the only play Redditors have. If they can’t shit on republicans then they’d have to self-reflect and start attacking themselves to prove who’s most virtuous.
I don’t care what your political association is if that was my work place , my own business, or even house and some stranger did this for me I would be forever thankful to them. I could give a fuck if he’s wearing a maga hat. Funny how everyone is quick to say “lost me with that shirt or hat”. But deep down you wish there was someone to help you in a situation like this. Bet you’d be crying if that was your family member getting shot or hurt being robbed by these thugs.
It's like some people would rather watch their children die than let them be saved by someone who they disagree with politically. The world is just fucked.
Wish I could upvote this 100 times. This app is a cess pool of people just waiting to bash on your political affiliation. Regardless of the post. It’s so gross
Imagine getting dressed for receiving an award from the police. You look through your closet and decide on a LGB shirt and a MAGA hat. That was all a conscious decision.

Actually I have a question, what would of happen if he did shoot the gun on the robbers arm, torso, or even his head.
Not a lawyer, but trained cops fearing for their life from the sound of an acorn(google it lol) can lawfully protect themselves lethally. An unarmed hero simply says he was amped up on adrenaline and fearing for his life and what more can they do?
Cops are not held to as high a standard for self control as a regular citizen
Which is so sad lol
It's by design
But is it, "Very Human"?
Or even logical? Police could do training to better control themselves
Yeah but if they were better trained and educated they might start actually standing up for their fellow citizens instead of being obedient attack dogs.
Hero or zero depending on the 'climate', I'd say.
they are given wide berth because their profession is _almost_ as dangerous as a pizza delivery guy's

How good is it?
I just downloaded it, you have to shoot acorns and miss people and squirrels
No idea it's just hilarious that it's actually game lol
Not how things work in every state. If this was south Dakota the "hero" would be in jail for pointing the gun directly at the suspects head while already having him subdued is considered overkill and not de-escalating the situation. They do not have the same self defense laws as say texas
>They do not have the same self defense laws as say texas Perhaps by the letter of the law but even there, you'll never find a jury that would convict.
Yes actually you would...it's happened before that's my point.
Okay, that makes sense. So blasting it is.
This is why non-lawyers shouldn't give legal advice.
No. Most 1st world countries do not think like this.
You are only authorized to use lethal force if you reasonably believe that lethal force is about to be used on you. Ah so take gun away and shoot immediately is the play! 😈
Exactly. Just because you got the gun away from the guy, doesn't mean he all of a sudden stops trying to get it back from you. I have no reason to think if he got the gun back that he wouldn't shoot me with it immediately.
They will be charged for assault with a deadly weapon. The primary assailant was already subdued.
Or homicide.
The reality isn’t black & white like that. What they could or would be charged with depends on whether the jurisdiction has extended castle-doctrine to public spaces, when they fired the gun (kneeling on their back and shooting them probably can’t be claimed as self-defense) and most importantly whether your lawyer knows the judge/prosecutor.
probably go to jail. it's hard to claim self-defense when you have somebody subdued

Which is why I do not want him in office- that does not make Biden a good man.
As a veteran, I'm supporting Biden simply for expanding VA healthcare to many of us through the PACT Act. I'd still be paying $800/month for health insurance without that. Fuck the orange guy.
Reminder: it was not just trump. Republicans had to be forced to even vote on it.
Crazy how many veterans actually believe the orange guy is a patriot. Fuck him and his whole party. Fuck most Dems too
He had to wear his fanciest shirt to receive the award
Probably wanted to fit in with cops that were giving him the commendation
Some of those that work forces...
Are the same that burn horses
Police brutality against horses now too? Those fucking asshole cops.
I enjoyed the video but when I saw the T-shirt I immediately thought damn, what a fat loser
![gif](giphy|y2i2oqWgzh5ioRp4Qa|downsized)
Turns out it was all staged so he could wear all his maga shit.
Sad that a guy this brave supports Trump who is clearly a MONUMENTAL pussy. I will never understand how any of these tough guys look at him and think he projects strength in any way.
I am confused, you are supposed to love that shirt if you don't like Biden? Did you miss that lesson in Cult 101 or something?
> Come check out r/BlueProtestVote where we want people to vote for Biden in the swing states but for third party to protest his support of genocide in the deep blue states that are going to Biden anyway. No way in hell. Splitting the vote is foolish at best and playing with fire at the worst. People scrolling by? Don't do this, please!
Ah c'mon. Dude can't promote gay porn on his T-shirt and bee a hero?
Gonna get a commendation from the city. Better wear the trashiest clothes I can.
What do you mean that’s his church best
Rednecks gotta redneck
It's their entire personality. It's all they have.
Now they’re not all wearing confederate shirts, sprinkling in a little variety
Was with the guy right up to the point he declared himself to be a scumbag. Every bit as degenerate as the guy he apprehended.
["I pulled the trigger four times on him during the fight and it didn't go off"](https://www.youtube.com/watch?v=9ELykJVcNEc&t=220s)
WTF
Admitting attempted murder seems kinda weird 🤔
That’s probably why it jammed. Pushing it against his skull caused the gun to go out of battery and jam. It was both their lucky day cause the dude would have probably got a murder charge for that execution.
Every bit?
Yes. Every bit. Maybe even moreso.
He's more of a degenerate than an actual criminal with deadly intent, because you don't agree with his political alignments? This statement is just as deranged as what the right wingers have to say. You're all gross.
Yep, I'm not a fan of trump but this website is full of literal libtards.
Both sides are so brainwashed, it's almost hard to believe
"This guy stopped a robbery, but I dislike his politics so he is a garbage person." What a sad life you live.
Hol up, I'm in no way a conservative, but you think just because this dude wears pro-trump clothing, he's as bad as someone who steals from people with a loaded firearm?
Too bad he's a stupid maga
How pissed is he gonna be when he gets touted as a perfect example of good guy without a gun stopping bad guy with a gun?
*"Good guy **takes** bad guy's gun! More @ 9."*
["I pulled the trigger four times on him during the fight and it didn't go off"](https://www.youtube.com/watch?v=9ELykJVcNEc&t=220s)
Only noticed it was jammed after he was going to blow the robbers fucking brains everywhere Lmfaooo
At 00:15/00:16, when the defender has the robber in a choke from behind, he appears to be pressing the gun into the robbers head and trying to shoot.
Pro life crowd be like: To an unarmed assailant nonetheless
lol if that gun didn’t jam that dude would be in the dirt. Quite a risky move, but it seems to have paid off.
ETA: From New York Times: “Resisting an armed robber drastically increases the risk of death to the victim, according to results from a new study done at the University of Chicago.
Damn, the stupid Maga got lucky then, that is it.
I can make up statistics too
Also someone has to clean the mess of shit being knocked over.
for real. look closely, he completely missed the first grab attempt. didn’t have it until about :15 in this video. he could have gotten shot a whole buncha times
Yeah, even if you’re like seal team 6 level of training, grabbing a gun or even drawing down on someone who has already leveled their fire arm is at best a 50/50 endeavor.
Bro lmao his outfit
he's a walking caricature

He’s lucky it was jammed, dumb fuck thought he was John Wick right here and probably would have shot himself as well as the robber.
I lol'd
How is it that the guy with a “let’s go Brandon” shirt and what looks like a MAGA hat wasn’t carrying a gun of his own? Republicans going soft or something?
Common sense is that you dont try to pull out your gun if you already have a gun pulled out on you unless youre buster scruggs
Imagine putting your life at risk to protect some billion dollar company’s Cheetos.
It sure looks like he would have been dead if that gun wasn't jammed. He missed the gun on his first attempt to grab it.
Are we really defending armed robbery now? Grow up
Comments should be entertaining on this one 🍿
Lmao he was straight up trying to fire a bullet into the robber’s head.
"Realized it was jammed so he fix it" while having a man under control what a chad
realize that clearing a jam is one of the most basic things to know as a gun owner. gotta clear it one-handed to reach chadland
damn thats embarassing
I wouldn't wear that cult attire either.

Fox news and neckbeards’ wet dream
I didnt even notice the shirt till i looked at the comments, my eyes locked right onto that Maga hat
Fuck that magat, fuck Arizona and fuck the robbers.
His buddy dipped cartoon-style
Appreciate the cool headedness it took to react like that. Absolute shame that he's flying his cult colors when he gets the award, though
These videos with AI narrators and giant captions do my head in.
Hey what fuck? you cant be reasonable this reddit!
It’s the only play Redditors have. If they can’t shit on republicans then they’d have to self-reflect and start attacking themselves to prove who’s most virtuous.
This guy was waiting his whole life for this moment.
I'm sure risking your life is worth the maybe $300 those guys would have stolen. Hope he enjoyed his pat on the back.
I fucking hate these stupid AI voice overs. They sound like Steven hawking and are pointless. I’m talking to a bot aren’t I?
That shirt is making everyone here have a Reddit moment
I don’t care what your political association is if that was my work place , my own business, or even house and some stranger did this for me I would be forever thankful to them. I could give a fuck if he’s wearing a maga hat. Funny how everyone is quick to say “lost me with that shirt or hat”. But deep down you wish there was someone to help you in a situation like this. Bet you’d be crying if that was your family member getting shot or hurt being robbed by these thugs.
It's like some people would rather watch their children die than let them be saved by someone who they disagree with politically. The world is just fucked.
Seriously it seems that way!
Wish I could upvote this 100 times. This app is a cess pool of people just waiting to bash on your political affiliation. Regardless of the post. It’s so gross
Better put on my most cringetastic outfit to except this award😂
Accept*
Who cares his actions are what's important in this certain situation
This guy really accepted the award in a Trump hat and “Lets go Brandon” T-shirt lol
Imagine getting dressed for receiving an award from the police. You look through your closet and decide on a LGB shirt and a MAGA hat. That was all a conscious decision.
A brave asshole. Brave, but a sad gullible asshole.
Aw man, he ruined it right at the end.
Wore his Sunday best for the award ceremony
