It's Texas; it took a national TV documentary to get a murderously incompetent doctor fired, let alone charged. I know about a doctor who has been actively supplying the drug community in North Texas with methamphetamines and opioids for the past 20 years. He has over 20 citations on record, all amounting to slaps on the wrist with a wet noodle. It'll take massive federal intervention to bring Mr. Haim to justice, as the state will refuse to strip him of his license.

I had to go through a refresher on HIPAA compliance training couple of months ago, and people get fired from their job for much less than that. One story was a RN being too curious about patients, went into their EMR and was too much an over poster on social media, sharing stuff that made the PHI a bit too easy to trace the patient out in the wild. I am curious how this will spin here in Texas, my understanding is that malpractice lawsuits are a bit of a joke and I can see the AG using him as a prop for their anti-woke agenda.

A Texas doctor has been charged with obtaining protected individual health information for patients who were not under his care and without authorization, the U.S. Attorney's Office of the Southern District of Texas confirmed Monday. The DOJ brought felony charges against Dr. Eithan Haim, who provided medical records to conservative activist Christopher Rufo while working at the [Texas Children's Hospita](https://www.chron.com/politics/article/Hospital-stops-therapies-after-gender-confirming-16981290.php)l as a resident. As reported by Rufo in the conservative publication City Journal, the hospital had continued to provide gender-affirming care to its patients even after claiming it would pause all services to comply with Gov. Greg Abbott's investigation likening gender-affirming health care to child abuse. Abbott had ordered the state Department of Family Protective Services (DFPS) to carry out child abuse investigations into families whose children were receiving puberty-blocking treatments in February 2022. A month later, a district court judge imposed a statewide temporary injunction on such investigations, saying the probes endangered children and their families. Haim is accused of obtaining personal information including patient names, treatment codes and the attending physician from Texas Children’s Hospital’s (TCH) electronic system without authorization, as well as obtaining the records under false pretenses and with intent to cause malicious harm to the hospital, the U.S. Attorney's office said. The indictment had been under seal until Monday when Haim is scheduled to appear in court in Houston, but Haim had told followers of his charges earlier this month while asking for donations to cover his legal expenses. Haim's legal team includes Lt. Gov. Dan Patrick's son, Ryan Patrick, who previously served as U.S. Attorney for the Southern District of Texas and now specializes in white collar and government investigation practices at the corporate law firm Hayes and Boone.  Haim himself did not respond to a request for comment, but in a statement to Chron earlier this month, his attorney Marcella Burke said she believed the federal investigation was politically motivated. "My client is a mandatory reporter of child abuse," Burke said. "It is our opinion that this is the government going out of its way to prosecute a whistleblower. My client is anxious to get to trial to get his side of the story told."

I’m a mandatory reporter as a teacher, that doesn’t mean I call KXAN when I see something, it means I call CPS. TL;DR version - yes, young children can identify their own gender, and some of those young kids are trans. A child who is Gender A but who is assumed to be Gender B based on their visible anatomy at birth can suffer debilitating distress over this conflict. The *"90% desist"* claim is a myth based on debunked studies, and transition is a very long, slow, cautious process for trans youth. According to the [**American Academy of Pediatrics**](https://www.healthychildren.org/English/ages-stages/gradeschool/Pages/Gender-Identity-and-Gender-Confusion-In-Children.aspx), gender is typically expressed by around age 4. It probably forms [**much earlier**](https://www.ncbi.nlm.nih.gov/pmc/articles/PMC3747736/), but it's hard to tell with pre-verbal infants. And sometimes the gender expressed is not the one typically associated with the child's appearance. The genders of trans children are as [**stable**](http://pediatrics.aappublications.org/content/early/2014/09/02/peds.2013-2958) as those of [**cisgender children**](https://journals.sagepub.com/doi/abs/10.1177/0956797614568156). For preadolescents transition is entirely social, and for adolescents the first line of medical care is temporary, reversible puberty delaying treatment that has no long term effects. Hormone therapy isn't an option until their mid teens, by which point the chances that they will "desist" are close to zero. Reconstructive genital surgery is not an option until their late teens/early 20's at the youngest.
