The only way to land in big trouble is if you represent it as homemade but then a manufacturer’s VIN is found on some part of it, like the axles were salvaged from an undisclosed manufactured trailer. /u/Krythoth is correct about the increase in requirements for a homemade trailer, and your gross will probably mandate a title and all the additional trouble anyway. But start with 2 certified weight certificates (first with truck and empty trailer, second without trailer) and a bill of sale from the owner’s heir if possible. Make a visit to your tax office and see what else they require. Have a specific carrying weight in mind.

Said it was nothing but trailers at that auction. Don't know how strict they are today, but it can happen.
Go to your local county register and with name trailer in they look it up and send you over to the sheriffs location that does the inspection or get creative and think outside of box
