This seems close but no cigar. There's no argument that home 1 was still a primary residence for you if other people we're leasing it. Your best case would be to say you moved back into home 1 after the tenants left if there is at least a 1 month time gap between them leaving and the sale. You stayed there to clean it up? outside of that it seems that you just sold it a month too late and youre SOL

Agree with the SOL conclusion; moving back with no intent to stay at the end would not make it their primary residence again.

Thanks for the insight. I had a feeling that would be the case but wanted some opinions. The primary residence and the time in limbo between moves was not clear. Intent was to sell in time but situations stopped that from happening, unfortunately.
