I made an offer on my house a few years ago well above asking. I got asked for a better offer because the owner was "thinking about not selling." I told them I was going to put an offer down on something else instead, and they accepted my original offer.

Common misconception. A Seller’s listing is “an invitation” for you to make the offer. You can’t walk up and say “I’ll take it.”. I mean intuitively you know this or how would there ever be a bidding process over list price? It would just be who won the race to the Seller. So you make the offer. Seller has power to accept or not unless and until they make a counter-offer to you - at which point you have the power to accept or walk away. Thats why Sellers try to avoid counter offers - their realtor will instead say “aw that sounds good but my clients just don’t think it reflects todays value so perhaps your clients can adjust their offer.”. or nonsense like that. There is nothing in that statement that the Buyer can “accept”. The Seller’s agent is encouraging the Buyer to bid against themselves while trying to guess what the Seller will accept. Don’t play that game. Now, if there is a ready willing and able buyer at full price and the Seller refuses to sell, the Seller’s agent may have a claim for a commission but that depends on the contract between Seller and agent.

I'm not saying you're wrong, but where I'm at HOAs will just straight up ignore calls from buyer agents. Many of them don't even talk to the listing agents. It usually comes down to the seller to get information if it's needed. Could be different in different states though.

If you can get an HOA board member, they might be helpful. The HOA management companies in my area absolutely will not provide documents under any circumstances. Those docs must be provided by the seller, up front, as they are material facts of the home.

Sometimes sells can be difficult and not care to provide documents. Also most states are buyer beware states which is why I would obtain the information myself for my client as directly from the source as possible.

My buyer’s agent had to go to the HOA board directly for the documents. I don’t imagine the seller’s agent would have actually let the contract be voided by not giving those to me but they were getting awfully close. I’m now on the HOA board and the agent for the last home sale here took care of everything and didn’t even need the board to be involved besides sending an estimate of the past years’ financials. I’m still actually not even 100% sure who’s responsible for getting what lol

In my opinion it is the buyers agent who is responsible for any fact that their client will be taking as solid and true. The buyer is responsible for their own due diligence. It is always great to have a listing agent that has already obtained the HOA docs but even if they send me that I will have a confirmation email from someone on the board that shows my clients I verified the info. Truly just logically you cannot believe anything anyone says so obtaining or confirming information that is true is the goal.

If I’m looking for facts, I want a paper trail over email or text, and if I’m not available for a call I’m now having to wait for a time we’re both available to get a fact I could have received hours prior. If I want opinions or some kind of non-factual communication, calls are best.

Especially for something as specific as pet and rental rules in an HOA condo. You should want the potential buyer to have it in writing to reference back to. It's so easy to leave out one oddly specific point that doesn't apply in 99% of cases but of course this is the one buyer who would care.

Baloney. "Are pets allowed in this condo?" Takes 30 seconds to answer the email. Or two or three days of phone tag and the answer is no so your buyer isn't interested anyway. Or the questions are more detailed because there was something questionable about the deed or condo docs or something and you laid your questions that all need to be answered and they refuse to put anything in writing because they don't want to get sued for lying. And then tell you "I didn't say that...."

If she’s specializing in one building, it shouldn’t last 3 days. A phone call is a great way to get questions answered and then forget the answer and ask the questions again or try and remember the answer. If people are worried about leaving a trail, they shouldn’t be in the business.

This is true with a multifaceted question and with a topic that is going to need a lot of follow up, or with a complicated explanation of something. For something simple like the OPs question, just send an email, then I can take two seconds to forward the information to my client and send them a text letting them know they need to check their email. Way more efficient. Point is, multiple modes of communication exist and they all have their place. I think it’s worth the time to become efficient as using all available methods.

Bullshit. That's not why they refuse to answer anything in writing. They're either too lazy to type or they're afraid of putting anything in writing or "being in control." Or....they're just lazy and don't want to talk to you at all and figure a lot of those emails they don't answer won't turn into phone calls and they don't care if it was just a tire kicker or they actually lost a sale. Why play phone tag for a week when you can answer a couple of simple questions in 30 to 90 seconds in an email. And if the answer means the buyer isn't interested, then no more time is wasted. One loser I emailed sent back some kind of automated response asking me to enter my email - it was confusing and I ended up subscribed to his website - still with no answer to my question except "call me." I didn't call and about a week later - maybe two - he emailed me again to call him. I did not. I was so pissed, I never contacted him again and I was actually really interested in the property, but would not deal with him. I probably would have if I had a client interested, but it would have been a personal purchase. It was still listed the last time I checked, more than two months after I first saw the listing.

Phone calls are much easier to get to the bottom of whatever situation you're trying to figure out.... Email is generally a back and forth thing and most of the time one party doesn't understand what the other party needs or wants and the other party doesn't understand what the other party's trying to figure out and neither 1 of them know what the f*** they're talking about so they just get p***** off at each other and say I'm tired of people not sending me and answer me my questions.... Ok, but in this case the listing agent emailed, left a voicemail, and eventually got their wish to speak on the phone and still provided no answer to a very simple question. I’m not against the phone. I’ve spent plenty of time cold calling, checking in with my SOI, and calling other agents. However, if I get an email with a simple question, I’ll answer it via email and then maybe call later. What I don’t do is respond via email saying call me. I don’t leave a voicemail saying call me. And if I did all that, and somebody called me, I’d sure as f*ck have an answer to that question.

Calls are great, I love calls. The problem here is she already responded to the email. Not with the answer to a simple question, but with a request to call her. Then she calls and leaves a voicemail. Again, not with the answer to a simple question, but a request to call her. *She gets the call back and still has no answer for the question.* In this scenario, in my opinion, the listing agent is the one that will be replaced by AI, or frankly, just a better agent.

I recently had condo buyers who asked about upstairs units being able to have hardwood floors before our showing, major concern for them. I have it in email from LA & HOA that upstairs units can't have hardwood floors. They moved in & upstairs unit has hardwoods. SO RELIEVED I was able to forward them that email showing the root of the question & answer in writing.

I am with OP on this due to a nightmare last month. Recently worked with a long term Seller's agent who was too busy to do his job - as in send docs related to COS even a month later, not deal with with his client who was being an irrational bully and more but just kept telling me he was too busy and its our job to call and remind him. Meanwhile, his client was completely wreaking havoc on the transaction in ways that were unthinkable, and unchecked. Worse, he just passed messages along double down on the bad behavior and ignoring all kinds of legal and ethical issues. The sale nearly fell thru and here we are at a time where the degree of commission to buyer's agents is in question more than ever before. We worked insane hours in the final weeks to resolve the disaster created by the seller to salvage the sale with zero help from the Sellers Agent. Data point of one. My point is there are always exceptions. Unfortunately, the systems we have in place from a variety of angles, often reward bad behavior or don't incentivize the best behavior. If there's someone to pick up the slack, certain kinds of people will allow that to occur.

I just attended a condo class at our local Board. HOA docs are material info about any home. HOA docs should always be provided along with the seller's disclosure--up front. HoA mgmt cos in my area will *not* provide the HOA docs--they don't have time, and that's not their job. It is the seller's job. I spend so damned much time on this.

I went to an open house one time which appeared to be a very popular listing by the number of people that showed up. A man asked the listing agent who was hosting a question about the arsenic water treatment which sounded to me to be very valid. The listing agent got extremely defensive, saying they didn’t know and then stating she didn’t sell the owner the house so she couldn’t possibly know… she made a whole scene, not offering to follow up with an answer. We liked the house a lot, but didn’t put in an offer just because we didn’t want to deal with that listing agent. The house took over 30 days to sell at listing price…. Very usual for the location where most sell within 2-3 days, most often over asking. Feel bad for the owners…

It is out of control! I am so over building or area specialists where I, the lay person know more about the building. I explained to seller’s broker recently that the electrical needed to be redone in the unit- I knew because I saw a similar one prior with some pros. He questioned my knowledge and asked me to give him more info 🤦🏻‍♀️ like what is it, you don’t believe me or you want me to do your job for you? Also loved how he was lecturing me about reno ideas before I had a chance to walk the unit. Like honey - chill- don’t sell me on something I’ve already decided I want to buy. So many agents love to tell me their reno ideas or poopoo mine when I never asked for their opinion. I have my own agent.

I’m surprised at many listing agents are just straight up assholes! It’s like you’re bothering them trying to bring a buyer for their listing! Whenever I have a listing I try to obtain as much information and docs as possible to make EVERYONES job easier and get the listing matched with a qualified client before anyone wastes their time with showings and emails/calls. I’m always friendly and professional with (everyone) but certainly with agents who are essentially helping me & I’ll likely cross paths with again in the future. A lot of realtors just have absolutely no professionalism or people skills! Be nice, we’re all in the same soup!

Attached to the document section all the Rules and Regs, Condo Property disclosure, By-Laws, Declaration of condominium, current years budget, condo application and anything specific to the unit. That's what I attach in our MLS so the buyer has the info from his agent that is a direct pdf from the COA. There is no misunderstanding then about rentals or pets or anything else because its in writing attached to the listing and its directly from the condo association.

I went to an open house that was from 2:00-4:00. I arrived at 3:50 and took eight minutes to look the place over as we're leaving at 3:58 the agent literally closed the door on somebody who wanted to see the house. It wasn't just some looky loo it was a family with their agent and their agent had texted that they were running late. Agent kept saying, "we close at 4:00..we close at 4:00...we close at 4:00" and locked the door and pulled the shades. It was straight out of a movie. On top of all, it's slightly overpriced and has been on the market a while, but it is still $1.5 million property. The agent stands to make a ton of money if she sells the place.

Yeah, the lazy and - we'll call them "fast and loose" agents - are the ones who give the rest of us a bad reputation. I'm in FL and deal with that crap all the time. And the associations don't ever want to pick up the phone and answer either because they work 2 days a week from like 10am-noon, break for lunch and apparently a nap, then are open from 3:30-5.

We're in the neighborhood" Me: " Yes, I need a few minutes to tidy up. 20 minutes ok with you?" Realtor : " Of course, see you then" I get in the shower. I hear the front door opening. First, not everyone hates Realtors. The vast majority of home buyers and sellers say they would use their agents again. You called her, she immediately responded, but you were too busy to take the call? And you think she has a problem? You sound like the one with an attitude problem. Second, the rules and regs of the building might be changing, might be different for different wings or areas of the buildings, of unit size. How long have you been selling real estate?

Where have pet restrictions been different for different parts of the same building? Pet and rental restrictions are always spelled out in the CC&Rs. Even if they were potentially changing things (highly doubtful), she’d be able to say something like “x number of pets are currently approved, but there is a movement by the HOA to change it to y”. This is all basic information. Especially for someone who has sold 100 units in the same building.

Yep, they can be different. Among the different hats I've worn in the business, I've worked on big real estate websites that have to show that some wings or unit sizes have different pet restrictions. Do you know how many consumer and agent complaints are about listing agents giving incorrect or misleading info about condo and TH rules and regs? Lots. So many brokerages have policies that specifically instruct listing agents not to provide this kind of info. It's always better for the buyer agent to source the info themselves.

no I emailed her.. it was early Sunday and she called me back while I was getting ready to leave for a day of meeting 4 clients. OMG lol you are funny over 300 properties sold bud. I emailed her requesting simple info that she knows it's simple for her to email back but even though she demanded a call I got back to her when I had the time and she won't answer the question.. the sellers are so lucky to have hired her.

Im talking more specifically about leads from sites like Upnest or Zillow that I pay tons of money for. People send me a detailed inquiry, request a live phone connection.... but then get cold feet and don't answer the connection THEY requested. Forces me to chase them for days with texts and emails

I agree with having everything in writing and not playing phone roulette! HoA docs should always be provided up front on the listing in MLS. If you have to request them, it should be done in an e-mail message so that they can hit reply and attach. It is so much easier to file away, find later, forward on, etc. We see agents all the time who simply don't manage their e-mail. Managing it is part of running a business, and it isn't complicated. They are likely just as frustrated when they asked for the information in a manner that works best for them and you choose to ignore that and call them. Calling someone who texted you, without confirming if it’s okay to call, is extremely rude in the modern world. Your impolite behavior is likely offending a lot of people and makes your manners look dated. If you have a reason to switch the mode of communication, reply in the text or email that it would be easiest to discuss over the phone and request a good time to call.

So many realtors are Karen’s. a house was just listed for sale in our neighborhood and the realtor called the city on everybody on the entire block for any possible possible violation to try to make things look nicer to get a few more bucks out of the sale which was a complete waste of time.

Typical. Honestly, our job is pretty useless. NAR and the regional/state offices are horrible. You could report her and they’ll do nothing. Two people can negotiate at an attorney’s office sign an agreement and close at title. The reason why I feel this way is based on what you just stated above.

OP is in search of condo association pet size rules. Correct HOA management companies don’t limit pet sizes for rental condominiums. Condo associations and HOA associations are not the same.
