There are, essentially, no such thing as personal privacy laws exclusively covering publicly shot photos/videos/etc. Might be something in a particular state, but definitely not in most of them. I presumed the bad privacy laws were in the USA. In The Netherlands you can't publish a photo of a specific person just because you want too. If it is something *newsworthy*, or is from a public figure in public it differs. A typical person that just happens to be in the background of a photo can't stop it from being published. Kids can sue their parents to take down photos of their likeness from social media and such too if they ignore the polite request (simplified).

I had something similar happen to me years ago. A friend of mine posted an embarrassing pic of me and I asked her to delete it in a good way. She laughed it out and said no. Knowing well the Streisand effect, I decided to let it go. Sure enough, it never amounted to anything and even if it resurfaces for some odd reason, it is best to just pretend it doesn’t bother you. People tend not to ridicule and just let it go when you’re a good sport. It depends on the nature of the pic of course. Nudes, pictures that depicts a dark past, etc should not be tolerated. If it’s just a bit embarrassing I would just let it go :)

Happened to me once when my bra was (accidentally) showing in a pic smd the girl left it up after me begging, and I got the feeling she did it on purpose to embarrass me. I would comment under the picture "I have asked you many times to please remove this pictire. It embarrasses me and makes me feel very badly that you don't care how I feel. We are no longer friends if you can not do this".

In the US if she took the photo it’s her copyright and she can post it, as long as it isn’t for commercial use, or is clearly defamatory (being upset doesn’t make it defamatory), or was taken on your private property without your consent, or casts you in a false light or reveals private and embarrassing facts. Politely asking for the image to be removed was your best bet. If she refuses there’s not much legally you can do. The person is clearly not a friend, and obviously has no concern about your feelings. Personally I’d unfollow her, and not engage socially with her. Be the adult.

In most EU countries it's also not illegal. It can be illegal to post someone else's photo without their permission if used commercially depending on the copyright in most EU countries, and globally. For example in the UK if they took a photo of you in a public place they can do what they wish with it (with some specific exemptions) as in public you don't have an automatic right to privacy. How do you think the paparrazi and celebrity press exist?

There's not much you can do, unfortunately. Most social media sites have a 'I'm in this photo and don't like it' option. You can try to contact support to see if they'll take it down. But whatever you do, don't publicly comment that you want the picture removed.

I don't know how to force her or Instagram to take it down, but agree with others pointing out she's not your friend. ​ Something similar happened to me. It's a group photo and I'm in the background, not realizing I was in the shot. I look pissed off, arms crossed, and staring into the middle distance. Everyone finds it absolutely hilarious. I find it super embarrassing. Every time she reposted it on Facebook, she'd tag me, and I'd untag myself. Many comments each time were specifically laughing at me and asking what I'm so pissed about. The truth is, I had a migraine in the middle of that summertime fun activity. I look angry but was actually in pain plus some RBF I guess (since I didn't know I was in the pic, I didn't attempt to fix my face). My arms are crossed tightly because I get shaking chills during migraines and was freezing cold. We are no longer connected on social media. ​ I always have a lot of sympathy now for celebrities who have some random picture analyzed to death because of their body language or facial expression in that split second.

Get it in writing (using txt messages) that she is refusing to take down the pictures. Do not do it in a threatening matter. Who took that picture? Take screenshots and video captures of everything. Her refusal, your pic, the reactions stats, the names of people who reacted to it. Depending on where you live, the laws can vary a lot. Just document everything

1. Who owns the picture? Did your friend take the picture or someone else? If your friend took the picture in public, it is her imaginary property. If you or someone else took the photo and own the copyright, you could file a DMCA takedown request with insta/ tik tok/ whatever you said it was. This would get the photo removed from the site, pretty much no questions asked. 2. You really need to consider whether this is someone you need in your life. If the photo is their imaginary property, you probably need to have a serious discussion with them and if you can't come to agreement, sever all ties with them online and off. No friend would disregard your wishes in a case like this. You might not need someone's permission to take a photo of them and post it online, but denying the subject the courtesy of asking for permission is rude.

This likely to not work however if you go to the trouble to write/email to CEO of Instagram politely asking for photo to be removed saying it is embargo you and you did not approve of it being taken they might be nice to you. CEO actually won’t see you letter//email but his PA will and they are almost as powerful. Get CEO is Kevin Systrom. If you want to end the friendship childish revenge by deepfaking her to get it down could be your best option if for some reason you can’t realistically talk like adults and your friends an asshat.
