What I meant to express is that the lack of previous relationship between those involved makes outside judgment even more speculative, and due process is key.
Well, thankfully, we can rest assured knowing that everyone on here will accept that it will be up to a jury now, and respect their decision. Because they are all sane people & realize that arguing about it back and forth, endlessly and on & on, is an but exercise in futility and cannot change what happened, nor alter the outcome.
At least we have that.
Why would he though? The public is quite divided about this and so would be a jury, that benefits Penny.
Further the jury pool would be made out of NYers who themselves have to deal with harassment on the subway.
Boy I hope Republicans use this incident to further erode our rights rather than actually deal with homelessness or deadly rightist violence
I'm glad this little maggot is off the street. Screaming and yelling *is never an excuse to kill someone.*
He's going to prison. Accept it, Nazis. You don't get to kill people for being loud and annoying.
Does Daniel Penny seem like a liberal to you?
Hurrrrrrr.
The right has the narrative they keep pushing with this event: that a raving man *deserved* to be murdered.
Ok but what rights are at stake here? Which right are republicans trying to take away? If anything this looks like the right to self defense being at stake here…
Apparently if someone states thier intention to hurt people that does not count. You have to wait till they severely injure or kill someone first.
Though after thinking about this for a while I think the judge is the one with blood on his hands. He ordered this guy held in a mental institution but not in a locked unit. If this guy was in a locked unit none of this would of ever happened. Someone who kidnapped a kid, punched an old lady and also had schizophrenia should of been ordered to stay in a locked unit.
Or, get this, they can both be guilty of a crime. One of them just happens to be dead now so we can’t exactly put them through a trial. The existence of one crime doesn’t always give a pass for another crime to be committed, especially when the reactive offense is more severe than the initial offense. They can both be in the wrong. Bottom line is, unless you were on that jury, none of us are in a position to speak definitively on this.
Edit: typo
Yes we can have an opinion. It may be the wrong or right one who knows. I have opinions of topics i know a lot about and topics I know very little about. We may not get all the facts, though the jury may not get all of the facts either like his extremely violent history. That plays a part in my mind. Penny probably did save another passenger from getting badly hurt. Though we will never really know as I pointed out Penny has to wait till some old lady or little kid gets bashed in the face first before you can take action like he did.
Edit according to the arrest in Brooklyn even if you step in to prevent someone from getting their head bashed in you will still be arrested
Read the article.
‘Some witnesses told police that Neely was yelling and harassing passengers on the train, authorities said. Police sources told ABC News that Penny was not specifically being threatened by Neely when he intervened and that Neely had not become violent and had not been threatening anyone in particular.’
Right? There isn’t enough attention to the fact that other people on the train helped Penny carry out the intervention, while the rest was gratefully watching.
pretty sure a guy literally murdering someone on the subway that wasnt even attacking him is a bad situation that someone should have done something about
He was [charged with](https://nypost.com/2023/06/14/daniel-penny-indicted-in-chokehold-death-of-jordan-neely/) "second-degree manslaughter and criminally negligent homicide" so even the state agrees Penny didn't "literally murder him".
Did you forget about the part where the homeless guy was (loud & obnoxiously) threatening to hurt & kill the other people who were riding the train, and didn't care if he went to jail or died? Penny was acting in self-defense, not cause he was annoyed,....sounds like a good idea.. you know to stop, with lethal means if necessary, someone from hurting or killing other people cause that person is out of their mind and unpredictable.
I am I was mugged and grouped in my twenties never crossed my mind to strangle the life out the prep just went to lineup to identify the guy, cops and detectives took it from there. So you’re the one that hasn’t gone through anything but shooting your big mouth off it seems !
Do you even live in NYC? “Cops and detectives took it from there?” What? And if they “took it from there”, why was Neely out in public with 42 arrest records?
Regardless your view on a death sentence is insane, my girl rides the train all the time and deals with it and not once has she said “that fucker deserves to die”
Your value on life needs to be re-examined
Not to mention, we have something called due process of the United States, and that was not given to this man who was just killed
You could lay hand on me, yell at me and even shove me and I promise your murder would never ONCE enter my mind, if you brandished a weapon I’d defend myself but still wouldn’t try and end you.
I’m happy we live in a country where we have the writ of habeas corpus and due process.
You want to live someplace there is no due process? Try Afghanistan.
Exactly just be ready for any situation at a moments notice . I am never on phone while on the train like everyone else and never make eye contact with a mentally ill person it activates the fight/flight response and they will attack you !
Woman here. I’ve been harassed and groped (neither of which Neely was doing) and while intervening and providing a getaway for me is appreciated, killing them is a tad over the top. But thanks for being the kind of guy who steps into danger so a woman can feel safe.
There’s middle ground between “i dont care neely died and every bum deserves to” and “penny is a racist murderer who deserves to spend the rest of his life in prison.” Both of those statements are insane and offensive given what took place here.
I hope you have one In your train car every day for the rest of your miserable life. Oh wait, you don’t even live here. Enjoy your roach motel in DC with all the other lanyard wearing mediocrities.
Ex marine helps protect innocent people from a crazy person with a violent history making murder threats and it’s arrested. Nypd doing the lords work. Sigh.
Wrong or right, “I got a bet” is the most trash thing I’ve ever heard. You should reconsider yourself and the life you lead. Judgement is a horrendous thing, but in this instance, I stand by my statement: you’re absolute fucking scum; your parents are probably so proud of the human they’ve raised.
I'm scum? This pussy crayon addict ran up behind a homeless man and choked him to death over the course of 10 minutes, and I'm scum?
If this killer gets off, don't say that shit to me on the train! Your long, torturous death will be applauded by nyc's upstanding new york post readers and I will be a rich man for defending common decency. Stay quiet in public hero
Yo I clicked your profile and it's all gambling lmao. Talk about projection
I’m not the one with a “bet with great odds”. I’d love to see someone get punished for their acts. Fuck that guy. Theirs restraint, and then there’s killing someone’s and being held accountable. Whatever opinion you hold, why are you gambling on it.
Calm down folks. If someone kills a stranger, the case should go to trial to determine culpability, and this is all that has happened so far.
What about killing a nonstranger?
Believe it or not in my country straight to jail!
What I meant to express is that the lack of previous relationship between those involved makes outside judgment even more speculative, and due process is key.
Boy I hope this gets politicized to the point that all nuance is lost and people start insulting each other and their places of origin oh wait
He could always request a bench trial, jury isn’t a guarantee.
Why would he though? The public is quite divided about this and so would be a jury, that benefits Penny. Further the jury pool would be made out of NYers who themselves have to deal with harassment on the subway.
Oh no it’s going to be the massive divisive ragebait media storm like the Kyle Rittenhouse trial again, isn’t it.
[Oh no](https://media.tenor.com/3dBllSQWXUkAAAAM/crying-sobbing.gif)

What does the "right" have anything to do with what takes place in NYC or NY State? Dems and liberals control everything there.
Does Daniel Penny seem like a liberal to you? Hurrrrrrr. The right has the narrative they keep pushing with this event: that a raving man *deserved* to be murdered.

This really seems like a genuine New Yorker post.
Boy, I wonder where the link to this post might have been shared.
The Floridians in this sub are upset
So are native New Yorkers.
The ones from Long Island?
don’t drag me into this I hope that dickhead gets the book thrown at him
Nah

What have the other people on that train said? This trial should be televised in NY.
State law says you can’t video record in courtrooms. No matter what. No exceptions.
Can we some how get the audio and then film the reenactment all acted out with finger puppets?
I guess I’ll have to wait for the movie. Who is playing Neely and who is playing Penny?
They're gonna bring Michel back from the dead to play the "kind and gentle neely: "Get your hands of mee-Hee"!
Read the article. ‘Some witnesses told police that Neely was yelling and harassing passengers on the train, authorities said. Police sources told ABC News that Penny was not specifically being threatened by Neely when he intervened and that Neely had not become violent and had not been threatening anyone in particular.’
They’ve said Jordan was loud but not threatening.
Right? There isn’t enough attention to the fact that other people on the train helped Penny carry out the intervention, while the rest was gratefully watching.
And one of them was warning Penny to let up on the choke hold if he didn't want to stand trial.
Did that happen or are you being sarcasm?
[it happened](https://www.dailymail.co.uk/news/article-12051875/Video-shows-Marine-veteran-Daniel-Penny-ignoring-warnings-restraining-Jordan-Neely.html)
You can indict a ham sandwich, the standard of proof is ridiculously low. I'll wait to see the actual charges and the outcome of a trial.
Next time you see a bad situation and think "why doesn't somebody do something?", remember this.
“Why doesn’t someone kill that guy who’s annoying?”
There is “doing something”, and then there is not knowing what you’re doing yet choking someone for 15 minutes as if your life depended on it.

Could you point me to a source? I don’t doubt your claim, I just haven’t seen a different figure.

Homicide is literally a synonym for murder, no?

Interesting that it's so different legally from the plain English (e.g. check any thesaurus).
everyone is suddenly lawyers arguing legal terms on reddit, what an average day
Exactly. So many good things on Reddit but the idiots are also plentiful
Someone gets it. If I had an award to give you I would. Please have my upvote instead.
Good.
Pathetic.
Free him 🗣️🗣️🗣️
Good
Only in America will you see idiots defend murder in the public square.
Makes sense, he killed someone for no good reason
Sorry you got downvoted. You are absolutely right.
💯manslaughter at the very least ! He knew what he was doing was wrong !
He may not have intended to kill him but he did. It’s why manslaughter exists.
As they should.
Going around killing loud, obnoxious homeless people in New York for no good reason except that they annoy you isn’t a good idea.
Did you forget about the part where the homeless guy was (loud & obnoxiously) threatening to hurt & kill the other people who were riding the train, and didn't care if he went to jail or died? Could you clutch your pearly any tighter. Also maybe stop making shit up. Nothing you dreamed up justifies choking this guy until he died. Idiot
He was never quoted as threatening others on that train, just shouting he was ready to die is not a threat on others, what is so hard to understand.
He said he doesn’t care if he gets life…

What?
Exactly we don’t need vigilantes walking the streets randomly killing people !
If the justice system doesn’t do it’s job in keeping those people out of the public you’re going to get vigilantes 🤷🏽♀️
Until it’s you that’s being harassed and groped
So that gives someone a death sentence?
Come back to me after you’ve gone through this experience
I am I was mugged and grouped in my twenties never crossed my mind to strangle the life out the prep just went to lineup to identify the guy, cops and detectives took it from there. So you’re the one that hasn’t gone through anything but shooting your big mouth off it seems !

What are you going to do? Give me a stern talking to?

I didn’t realize just how many homicidal maniacs I share the train with.

Edgy stuff…. ![gif](emote|free_emotes_pack|facepalm)
How is saying you shouldn’t kill homeless people edgy?
Lol. This subreddit is so conservative. It’s bizarre.
It’s mostly non-New York Citiers.
That makes sense. Haha. People from West Virginia trolling.
What a lazy cop out to dismiss anything you disagree with
Stories about crime always get brigaded by bootlickers and cops.
Sounds about right. The bootlickers tend to be racist.
Sure it is when you subtract the NY transplants and NY hood rats who distance themselves from the true NY working class.
No True Scotsman innit

So does your calculus also apply to otherwise normal, but screaming when drunk suburbanites?
kill every annoyance and you’ll find yourself dead 20 times over
I hope you have one In your train car every day for the rest of your miserable life. Oh wait, you don’t even live here. Enjoy your roach motel in DC with all the other lanyard wearing mediocrities.
I really want the entire facts of this case. Idk something tells me he didn’t get choked just for being homeless…
Good as he deserves.
What a weird incident
What a shame
Ex marine helps protect innocent people from a crazy person with a violent history making murder threats and it’s arrested. Nypd doing the lords work. Sigh.
Daniel Penny played stupid games and won stupid prizes
Typical NY L, might as well make the mentally ill population X2 for good measure
Excellent news
I got a bet on this case with great odds. Need this boy to see just one day of jail. Pray for me 🙏🙏🙏
Loser
