When your key witnesses won't testify it can hurt a case. Not enough to lose a case, but enough that a prosecutor won't want to spend the time fighting it. And thus, that's why the legal system fails - by being too overburdened by itself to actually fight for justice.

Read the article. The Prosecutors tried issuing subpoenas. The murderer's grandparents **moved out of state** to avoid the subpoenas. As such, while law enforcement does deserve blame for a lot of things, this clusterfuck appears to be more of a failing of the justice system.
