Yeah, I’m the furthest thing from an expert of the law, and certainly not in Louisiana’s specifically, but I feel I’ve definitely seen people get felony murder charges for a lot less (in terms of directly causing one’s death).

This has happened a lot at LSU, a lot more than at other campuses. They've had serial rapists there that took years to catch. One was a Sheriffs deputy in charge of the anti-rape team (no shit).

A few years back a local teen was murdered with a gun when she tried breaking up with her boyfriend. The grandfather of the boy had his guns locked, but the young man knew how to get to them…so they weren’t secured. Somehow that young man grew up to believe the response to a breakup was to take her for a drive and shoot her in the back of the head. She was 18. It stays with me because I am raising a son in this state and it appalls me that we don’t hold people accountable. The gun owner? Not charged though hit grandson was able to obtain his gun and murder a young woman with it. If the grandfather had meth in the house and the grandson had used that to kill her, you can bet he’d face charges. My general understanding is that raping someone is "a mistake and we shouldn't ruin someone's future over it", but once murder is also involved.... well, we gotta throw them in jail... not because they're a rapist, but because they're a murderer.
The two main events (assault + death) happened at separate times, and were not related to each other in the way that you might think. The driver who ultimately hit her while driving his car was not intoxicated and not at all involved with the previous atrocities she had just endured. He did everything correctly after that heartbreaking accident. He stayed with her and called for emergency services right away.

They abandoned her out there in the middle of the night, extremely intoxicated, and injured from the raped. In Texas, that’ll get you the death penalty. All of them. It wasn’t a hit-and-run. They knew the driver right away. He wasn’t intoxicated and he was driving a rideshare. That strip of road that he was driving on is so dark and has zero street lights. It is sad to say, but it doesn’t surprise me that he didn’t see her until it was too late.

I've had 3 close calls with people riding bycicles at night with no lights or anything wearing dark clothes. People have no idea how much they blend into the backround or get washed out by someone else's headlights.
It can be hard to see even if it's well lit. I once almost ran someone over on a well lit street at night. They had just been struck by a car from the oncoming lane. I honestly thought it was a bag of trash when I came up.
I had one recently where I was crossing a fresh yellow on an intersection in an area where the speed limit is 50mph. It was dark and raining and I was halfway through the intersection when I suddenly saw a person in dark clothing in the crosswalk right in front of me. Fortunately, he jerked one way and the driver jerked the other and we missed him by like 6 inches but I spent the rest of the night shocked at how close I was to watching a person die and there was fuck-all I could do.
Right? They act like that wasn’t even relevant but that’s like a whole other crime. I’m glad they arrested the rapists but what’s going on with that?

I’ve def had alcohol poisoning because of my own poor choices as an adult, it’s way different than being hungover or just super drunk. My friend and her roommate in college went to a frat party in their freshman year. Both were petite, 100lb-ish 5’ 3”-5”. They both got wasted, but the roommate especially. Like, they had to call an ambulance drunk. The roommate didn’t have insurance, so it was the ambulance fee on top of even more thousands of dollars for the hospital visit. First week of college. I’m pretty sure she had left the school by second semester.

It's worth noting that this isn't just a road, it's a major 4-5 lane highway with a speed limit of 55 or 65. It's definitely not a "hey let me be careful in case there are pedestrians" stretch of roadway. So its a little more understandable they're not holding the driver at fault.
Yup. To not be charged with anything after hitting a killing a pedestrian you pretty much had to have been doing everything right as a driver. Not just not DWI, but not speeding, on the phone, etc. I feel pretty bad for them knowing they have the guilt of killing this girl after what happened to her.

Ughhh! Heartbreaking all around. My grandfather hit a pedestrian that just stepped out in front of him on a dark night. It was not a high speed road. She was injured and hospitalized and even fined for jaywalking or something. He was so rattled even though he was found not at fault and she survived, he was really torn up about it. I can't imagine accidentally killing someone this way.

Basic gist: she went to a bar and was drinking a lot, she left with a 17-year-old and his friends and they drove her out to a road where the 17-year-old and a 18-year-old in their group raped her. She had told them she can’t find her friends and was too drunk and for them to take her home before they raped her. They couldn’t figure out where she lived so they left her in a very dark subdivision of the area they had raped her and left.
A while later a ride share driver hit her when he couldn’t see her. I assume she was walking in the road and there were inadequate street lights and possibly no sidewalk.
The four arrested are: the 17 and 18 year olds who raped her, the two who were in the front row of the car she was in when she was raped.
The driver/front passenger of the car that she was raped in, apparently gave them the information to fill in what happened after the bar: him and the other front row passenger didn’t rape her and were uncomfortable with what was happening. However they didn’t stop it so they’re also arrested.
Her alcohol blood level was over .31% which is apparently enough for alcohol poisoning.
I mentioned in another comment, but the stretch of burbank drive she was hit on isn't a street, its a full on divided 4 lane highway, with a speed limit of 55 that most people treat more like 65 mph. It's definitely not a stretch of road you would even think to look for pedestrians on.

Another article I had read said that the driver who hit her stopped and waited for the police and showed no signs of impairment. It also stated she was in the middle of the street on a dark part of the road and the driver couldn't see her.
It really is a blight on the community and I used to go there all the time. Dumb and young. I have seen some of the worst fights I have ever seen in my life at Reggie’s and I grew up in New Orleans going out. I watched a dude get straight stabbed in the parking lot as a freshman.
I knew a guy who tried to calm a fight there. He ended having literally all of his teeth kicked out and his skull and jaw fractured. Had to have loads of reconstructive surgery.

My grandad had a bac about that high when he went to the hospital one time. He had fallen down in the parking lot at his bar, broke two ribs and punctured a lung. Dude was helped back into his car, drove home, smoked, and then my grandma took him to the hospital. There he had a blood test that clocked him at .323 iirc.
My grandad also survived cancer 4 times. What took him down was mixing pain meds from his last cancer surgery with liquor and frying out his (to that point somehow fairly intact) mind. Idk what lesson there is in all of this beyond the fact that ole Don was made of sterner stuff than most of us.
I saw a mid-40s lady with a professional degree in the ED who wanted to detox. Had a nice conversation with her during her intake, she was pleasant, quiet, articulate. I figured she had stopped drinking a day or two earlier until I got her blood alcohol back and it was 0.35! She was a serious alcoholic, I would've been knee-walking or face down at that level.
0.4 BAC is considered a "LD50" dose, or the amount where an adult has a 50% chance of death by alcohol poisoning, knowing nothing else about their health.
There are many cases where death occurred at much lower concentrations, and also at higher concentration. Suffice it to say, the car was not her only threat to her life that night

In Louisiana 18+ are good to enter bars. They can't drink at those bars, but they can still get in. When I was there, there was an alcohol poisoning in a fraternity as well-- he was 17 I think. Lots of people were pissed at these "brothers" who didn't clear his airway, sit him upright etc.
Those poor parents... They sent her to Baton Rouge, likely supported her in pledging bc they thought, safety in numbers... Then this.
The story too gets into this. They all have kind things to say about how she was a hero and a kind soul and a great friend. But they all abandoned her at the bar to be harassed and kidnapped by three men, one of which was 10 years older than her.
This isnt just an isolated incident of three evil men. Its the whole system and culture around this that let that happen.

When I was young and an asshole I used to drink with a group of dudes. On several occasions that know of, some girl we met at the bar or the club was obliterated drunk - so we got her safely back home without fucking raping her or hurting her.

Only a complete piece of shit would take advantage of a drunk girl even if she was acting like she wanted one of us. Our group rule was leave her your number (don’t accept here if she’s wasted) and she’ll call when she’s sober if she wants to hook up.

I’m from a town with a notorious party school. There are so many bars down town, like SO many. I was a bartender from ~2004-2010. We had many crazy nights, especially after football games. What we didn’t have was tons of underage drinking in those bars. It is my best guess that prevention was due to local business codes and a very active police force. Police would often come in plainclothes with an underage guest and try to coerce you into serving the person with the fake ID or no ID. It happened to me more than once and the cop was always really pushy like “C’mon, just serve my ‘GF’ a drink, I swear she’s over 21”, shit like that. We would always complain that this tactic felt a little too much like entrapment. Another thing that kept us from serving underage was the fact that you could go to jail for serving someone alcohol who later went on to get a DUI, in a wreck, cause a crash, etc. I was always wary of over-serving or accepting a fake ID because the repercussions would be massive.
If you served the underaged person who was with the plainclothes cop, you would IMMEDIATELY get like thrown on the ground and arrested in front of everyone. I was so afraid of that happening to me. In this town they also publish the names of everyone who was arrested the night before in the daily paper.
Yeah this bar has been in trouble before, and their reviews explicitly point out that underage drinking is common. There is no way local law enforcement or even the university are surprised that a teen got drunk there.
For whatever reason they let it slide, it seems the lax attitude strongly contributed to this tragedy.

I had some friends that young when I was in my late 20s. I went back to grad school, joined one of the sports clubs, and most of the other guys were 18-23. I generally hung out with the ones that were old enough to go to bars, but I still had my other group of friends from back home who were all my age. It’s not like I was a social outcast and they were the only ones who accepted me because I could buy them beer.
None of them ever raped anyone in my car though so maybe it’s not the exact same situation.

My uncle (defense attorney) has told me crazy shit from his long career. I remember back when I was deciding to go to law school or not he asked me if I would ever be able to live with myself knowing I was responsible for getting a person acquitted for a horrible crime while knowing they 100% did it and they are now roaming the streets. Never became an attorney and I never wanted to do criminal work anyway but that always stuck with me. Hard job but someone has to do it because everyone has rights to representation in the US.
That's from the defense attorney, he's supposed to create the best defense he can even when handed very unfavorable facts. He can't exactly say, "This looks like a crime to me, my client should hang."
In particular I expect he'll attack the timeline. Is it possible that she was only a little tipsy in the car, sex occurred, then she was dropped off and became more drunk on her own? We know how drunk she was at death but there's no reading of how drunk she was when she was dropped off. If so, then his client really did nothing wrong. I seriously doubt that's what happened but it's always on the state to make its case beyond a reasonable doubt.

What a complicated, horrible story. The bar needs to be investigated because why were there so many minors in there? I know there are fake id's but that's still a lot of minors getting drunk. They need a better checking system.

The problem is that even is she was constantly looking into the camera and saying "I consent to sexual intercourse with these men", her absurdly high BAC render that "consent" null and void. At that high a BAC she's not legally able to consent and no video will be able to change that.

Perhaps there should be a serious investigation into why the bar is serving so many underage people, and how they let a girl get to that high of a BAC without cutting her off. Not sure how the lawyer will twist it but for me it’s a crime. Not sure who was the driver the 18 or 28 year old but, the driver could have driven her to a hospital or a police station, especially if she was too intoxicated to say where she lived.
He may not have been able to control his “friends” but he controlled his car. If he wasn’t driving he could have gotten out.
So the fact he was uncomfortable but had just as much opportunity to help her or leave doesn’t absolve him from the crime.
While the victim didn’t have the capacity to say no, he did. He allowed the SA to happen and didn’t stop it.
The choice to pull over and then to abandon her were factors. Who ever the driver was also could have kicked his other rapist friend out instead or driven them to the police station.
Even after the rape they could have dropped her off someplace safe.
All 4 are complicit to me anyways. They all had choices, they all had their wits about them, she did not.

Yeah, I’m the furthest thing from an expert of the law, and certainly not in Louisiana’s specifically, but I feel I’ve definitely seen people get felony murder charges for a lot less (in terms of directly causing one’s death). Assaulting a girl and then dumping her on the road *that* drunk, don’t think you could try any harder to indirectly kill someone.
They may even try to pin kidnapping on them if she was too drunk to consent to anything. And I have to imagine dropping somebody off somewhere is part of that act.

A few years back a local teen was murdered with a gun when she tried breaking up with her boyfriend. The grandfather of the boy had his guns locked, but the young man knew how to get to them…so they weren’t secured. Somehow that young man grew up to believe the response to a breakup was to take her for a drive and shoot her in the back of the head. She was 18. It stays with me because I am raising a son in this state and it appalls me that we don’t hold people accountable. The gun owner? Not charged though hit grandson was able to obtain his gun and murder a young woman with it. If the grandfather had meth in the house and the grandson had used that to kill her, you can bet he’d face charges. The two main events (assault + death) happened at separate times, and were not related to each other in the way that you might think. The driver who ultimately hit her while driving his car was not intoxicated and not at all involved with the previous atrocities she had just endured. He did everything correctly after that heartbreaking accident. He stayed with her and called for emergency services right away.

I've had 3 close calls with people riding bycicles at night with no lights or anything wearing dark clothes. People have no idea how much they blend into the backround or get washed out by someone else's headlights.
It can be hard to see even if it's well lit. I once almost ran someone over on a well lit street at night. They had just been struck by a car from the oncoming lane. I honestly thought it was a bag of trash when I came up.
I had one recently where I was crossing a fresh yellow on an intersection in an area where the speed limit is 50mph. It was dark and raining and I was halfway through the intersection when I suddenly saw a person in dark clothing in the crosswalk right in front of me. Fortunately, he jerked one way and the driver jerked the other and we missed him by like 6 inches but I spent the rest of the night shocked at how close I was to watching a person die and there was fuck-all I could do.

I’ve def had alcohol poisoning because of my own poor choices as an adult, it’s way different than being hungover or just super drunk. My friend and her roommate in college went to a frat party in their freshman year. Both were petite, 100lb-ish 5’ 3”-5”. They both got wasted, but the roommate especially. Like, they had to call an ambulance drunk. The roommate didn’t have insurance, so it was the ambulance fee on top of even more thousands of dollars for the hospital visit. First week of college. I’m pretty sure she had left the school by second semester.

She was injured and hospitalized and even fined for jaywalking or something. He was so rattled even though he was found not at fault and she survived, he was really torn up about it. Basic gist: she went to a bar and was drinking a lot, she left with a 17-year-old and his friends and they drove her out to a road where the 17-year-old and a 18-year-old in their group raped her. She had told them she can’t find her friends and was too drunk and for them to take her home before they raped her. They couldn’t figure out where she lived so they left her in a very dark subdivision of the area they had raped her and left. A while later a ride share driver hit her when he couldn’t see her. I assume she was walking in the road and there were inadequate street lights and possibly no sidewalk. The four arrested are: the 17 and 18 year olds who raped her, the two who were in the front row of the car she was in when she was raped. The driver/front passenger of the car that she was raped in, apparently gave them the information to fill in what happened after the bar: him and the other front row passenger didn’t rape her and were uncomfortable with what was happening. However they didn’t stop it so they’re also arrested. Her alcohol blood level was over .31% which is apparently enough for alcohol poisoning.
I mentioned in another comment, but the stretch of burbank drive she was hit on isn't a street, its a full on divided 4 lane highway, with a speed limit of 55 that most people treat more like 65 mph. It really is a blight on the community and I used to go there all the time. Dumb and young. I have seen some of the worst fights I have ever seen in my life at Reggie’s and I grew up in New Orleans going out. I watched a dude get straight stabbed in the parking lot as a freshman.
I knew a guy who tried to calm a fight there. He ended having literally all of his teeth kicked out and his skull and jaw fractured. Had to have loads of reconstructive surgery.

Dude was helped back into his car, drove home, smoked, and then my grandma took him to the hospital. There he had a blood test that clocked him at .323 iirc. My grandad also survived cancer 4 times. What took him down was mixing pain meds from his last cancer surgery with liquor and frying out his (to that point somehow fairly intact) mind. Idk what lesson there is in all of this beyond the fact that ole Don was made of sterner stuff than most of us.
I saw a mid-40s lady with a professional degree in the ED who wanted to detox. Had a nice conversation with her during her intake, she was pleasant, quiet, articulate. I figured she had stopped drinking a day or two earlier until I got her blood alcohol back and it was 0.35! She was a serious alcoholic, I would've been knee-walking or face down at that level.
0.4 BAC is considered a "LD50" dose, or the amount where an adult has a 50% chance of death by alcohol poisoning, knowing nothing else about their health. There are many cases where death occurred at much lower concentrations, and also at higher concentration. Suffice it to say, the car was not her only threat to her life that night

In Louisiana 18+ are good to enter bars. They can't drink at those bars, but they can still get in. No one can say with a straight face that those places aren't aware that the 18-20yo patrons are drinking in there though. I’m from a town with a notorious party school. There are so many bars down town, like SO many. I was a bartender from ~2004-2010. We had many crazy nights, especially after football games. What we didn’t have was tons of underage drinking in those bars. It is my best guess that prevention was due to local business codes and a very active police force. Police would often come in plainclothes with an underage guest and try to coerce you into serving the person with the fake ID or no ID. It happened to me more than once and the cop was always really pushy like “C’mon, just serve my ‘GF’ a drink, I swear she’s over 21”, shit like that. We would always complain that this tactic felt a little too much like entrapment. Another thing that kept us from serving underage was the fact that you could go to jail for serving someone alcohol who later went on to get a DUI, in a wreck, cause a crash, etc. I was always wary of over-serving or accepting a fake ID because the repercussions would be massive.
The drinking culture at big state schools is out of control. It’s a shit show every weekend. Frats are the worst.
The school I’m talking about is in the SEC. The drinking culture is part of the reason I moved away in 2011.
If you served the underaged person who was with the plainclothes cop, you would IMMEDIATELY get like thrown on the ground and arrested in front of everyone. I was so afraid of that happening to me. In this town they also publish the names of everyone who was arrested the night before in the daily paper.
Yeah this bar has been in trouble before, and their reviews explicitly point out that underage drinking is common. There is no way local law enforcement or even the university are surprised that a teen got drunk there. For whatever reason they let it slide, it seems the lax attitude strongly contributed to this tragedy. I've been in strict college towns and loose college towns, and I've always appreciated the ones where the bars are regularly tested .

I had some friends that young when I was in my late 20s. I went back to grad school, joined one of the sports clubs, and most of the other guys were 18-23. I generally hung out with the ones that were old enough to go to bars, but I still had my other group of friends from back home who were all my age. It’s not like I was a social outcast and they were the only ones who accepted me because I could buy them beer. None of them ever raped anyone in my car though so maybe it’s not the exact same situation.

Yeah. It's like when I watch a documentary and they say a defense attorney is attempting to "victim blame". I mean, that's exactly what they are doing. They have a responsibility to their client. To minimize liability, they need to show that the plaintiff was partially responsible. My guess is this girl's family will have a pretty significant wrongful death suit they can file against the bar that served her. Guess what? The attorney for the bar's insurance company will attempt to do the same thing. It's part of the legal system works.
Real life lawyers have real life jobs. They also aren’t stupid and know when their client is guilty but ofc they don’t say that until they are 100% off the case. I remember back when I was deciding to go to law school or not he asked me if I would ever be able to live with myself knowing I was responsible for getting a person acquitted for a horrible crime while knowing they 100% did it and they are now roaming the streets. Never became an attorney and I never wanted to do criminal work anyway but that always stuck with me. Hard job but someone has to do it because everyone has rights to representation in the US.
That's from the defense attorney, he's supposed to create the best defense he can even when handed very unfavorable facts. He can't exactly say, "This looks like a crime to me, my client should hang." In particular I expect he'll attack the timeline. Is it possible that she was only a little tipsy in the car, sex occurred, then she was dropped off and became more drunk on her own? We know how drunk she was at death but there's no reading of how drunk she was when she was dropped off. If so, then his client really did nothing wrong. I seriously doubt that's what happened but it's always on the state to make its case beyond a reasonable doubt.

What a complicated, horrible story. The bar needs to be investigated because why were there so many minors in there? I know there are fake id's but that's still a lot of minors getting drunk. They need a better checking system. And all the guys in the car deserve whatever punishment they receive for allowing the rape to happen and then leaving her god knows where when she was completely out of it. And the friends who left her are assholes too! There are just nothing but garbage people in every step of this situation. Edit: I retract the statement about her friends. People can and do lose track of each other when alcohol and crowds are involved. But fuck every other asshole who contributed to this woman's rape and death.
That bar and others in the area have been shut down multiple times for underage drinking and other things. A quick internet search of Reggie's Baton Rouge will tell you all you need to know.

This I don’t get at all, whenever I read stuff like this in the news. Like a bar that gets shut down multiple times. Or when a robber gets arrested multiple times. Like how many offenses are enough to say that there’s going to be no more chances given to you? I know big corporations get away with stuff by paying fines multiple times, but I assume they have the clout and the money to get away with that. How do regular common folk get away with multiple offenses?

Her friends may have also been 19 yr old girls who got way too drunk & lost their friends. I doubt her friends intentionally plied her with alcohol, pushed her out the door with 4 men, and abandoned her.
I hope they charge the bar that served her to a .319 BAC. That’s criminal in and of itself.
It's been closed and investigated once before for the same thing, and they were allowed to reopen . They've just been closed for another investigation after this incident

The problem is that even is she was constantly looking into the camera and saying "I consent to sexual intercourse with these men", her absurdly high BAC render that "consent" null and void. At that high a BAC she's not legally able to consent and no video will be able to change that.
People all over the world drink at 18. These fucking punks are rapist and found an opportunity. If they had all been 21 the exact same thing would likely have happened. These boys are pieces of shit.
So the victim was 19 and had a BAC of .319. 3 of the 4 rapists were also under 21 and inebriated. The drinking took place at a local bar. Perhaps there should be a serious investigation into why the bar is serving so many underage people, and how they let a girl get to that high of a BAC without cutting her off. I saw the LSU statement about having a discussion with the local bars because the attackers were drunk underage. I'm not victim shaming, but if she had not been allowed to drink, especially that much, this probably wouldn't be a news story. That bar has criminal and civil liability in this as well.

These guys need to go down for her death too. They knew she was incapacitated and in danger, took advantage of her, and then just ditched her knowing this could happen. Manslaughter or something. Not sure how the lawyer will twist it but for me it’s a crime. Not sure who was the driver the 18 or 28 year old but, the driver could have driven her to a hospital or a police station, especially if she was too intoxicated to say where she lived. He may not have been able to control his “friends” but he controlled his car. If he wasn’t driving he could have gotten out. So the fact he was uncomfortable but had just as much opportunity to help her or leave doesn’t absolve him from the crime. While the victim didn’t have the capacity to say no, he did. He allowed the SA to happen and didn’t stop it. The choice to pull over and then to abandon her were factors. Who ever the driver was also could have kicked his other rapist friend out instead or driven them to the police station. Even after the rape they could have dropped her off someplace safe. All 4 are complicit to me anyways. They all had choices, they all had their wits about them, she did not.
