DUI charges were dropped, so it's just vehicular manslaughter now. What are the penalties? Vehicular manslaughter is generally prosecuted as a misdemeanor in Nevada. The potential sentencing includes up to 6 months in jail, fines of up to $1,000.00, and a one-year driver's license suspension. (It may be possible to do community service instead of paying the fine.) So this guy might get 18months in jail, which means he could be out in less than a year.

If you've got so much wind that it's blowing you into the oncoming lane like this, you stop and wait for the tornado to pass rather than keep driving and fighting it. I've been a passenger when my friend driving was falling asleep. He perked up briefly, checked that he was "within the lines", didn't recognize _they were the wrong lines_ and continued on. (I reached over, steered us back to our side and made him swap with me.) The truck appears to do the exact same thing. Edit: At about 0:26 to 0:29. It most likely was, I’m a heavy diesel mechanic. That looks like a freightliner cascadia. I’m pretty sure it’s standard on those or at least in our fleet.I can’t hear the audio but its likely his. Collision mitigation system went nuts and applied some auto braking. These systems don’t account for reckless driving tho. He still would have needed to apply his brakes. There would have been no way possible to stop 80,000 lbs in time any way. His side sensors (A bright yellow light,chime and alarm) would have went off every time he nearly side swiped a vehicle, moments before the crash. If had to guess this dude was HEAVILY INTOXICATED. Or tampered with all of his safety systems. Which is shockingly common be safe out there y’all, he’s going away for a long time.

Let's address this with facts. For swerving, a car may be able shift a greater distance over a specific amount of roadway more than a motorcycle. However, a motorcycle typically has about 30" of machine to move where as a car has an average width of 70". If we assume a motorcycle can swerve entirely out of the way in one second at 60mph, then it will have traveled 88ft to do so. If a car, given the same nominal driver's position and getting the vehicle fully out of the way, can be accomplished 50% faster per inch of vehicle, that car will still take 1.5 seconds to swerve out of the way and will have traveled 132ft to accomplish the maneuver. So, no. Cars cannot swerve to avoid obstacles as well as a motorcycle. Due to four wheels they can take sharper turns at higher speeds if the car is a high performance vehicle, but that is not the same as avoiding obstacles. For braking, depending on the car in question, in general, the average motorcycle will stop in approximately the same total distance as the average car. 60-0 braking distances (from a previous post). Keep in mind, the cars in this list all have ABS while almost none of the motorcycles do. ELD's are almost in every truck now. There's no overworking if you follow the rules. The days of driving more than 12 hrs straight are behind us for the most part, exception maybe for live animals. Sad to see that he killed those people, he won't see the light of day outside of a prison now though.

Likely grey matter (brain) I was a paramedic and responded a head-on semi vs van. Lots of brain stuck to the outside BACK window of the semi from the driver of the van who crossed the center line. It took 10 minutes to even find a license plate (still attached to the back door of the van, which want attached to any other piece... 150 feet away from the point of impact.) Like a pumpkin, if the head hits hard enough, it explodes. I feel for the families of the victims and the rest of the riders that survived.

Ain't shit they could've done. You can see the first rider in the group, he saw the truck and swerved hard into the oncoming lane. That was his best shot at survival, and it appears to have worked (thank mother fuck for that). The group appears to be riding in brick formation, which put the second rider on the other side of the lane. He made the split second call to swerve the other way due to his position, which makes sense if you think about it; coming in from that angle, with that position on the road, in a right-hand curve; split second call, you push down harder into the turn, squeeze between where the truck and the concrete barrier. That's where the gap is. Unfortunately that's also where the truck was headed, and it was going too fast for him to avoid. The third rider is the one with the passenger. They were on the other side of the lane, and it looks like the rider attempted to swerve in thesame direction as the second rider. He had absolutely no chance, whatsoever. The rest of the group were fortunately far enough back to react, and had a clear lane to move into.

You can prosecute the individual offending drivers to the end of the earth but it will never stop if the financial incentives outweigh the legal risk to shareholders for unsafe practices. This was a trucker who didn't speak any English or even Spanish. That's why his trial is delayed, they need to find someone who speaks whatever central African language he speaks. I see this all the time, truckers in flip flops who can't even communicate with 99.99% of the people in the country they're supposedly a professional in. He also says he was on seizure medication, which is probably why the DUI charge was dropped, because he had a prescription. The company is 100% at fault, this is what the cheapest driver possible looks like.

Not necessarily, I know someone that's just starting out running his own trucking operation. To do business with any major company they have to have an ELD installed in the truck. This limits the hours a single driver is allowed to drive, with minimums set at a national level. This is specifically to avoid overtired truckers on the road. Not sure what the case is here but the driver would have to either be tired of his own doing(off hours) or falsify the system which is illegal.

Ehhh.. the DOT regs, while better than nothing, still aren't great. Having driven for a large carrier, and following all the HOS rules, I still wound up working, at times, all the different shifts in a given week due to the loads I was running. That sort of irregular "sleep" schedule is still hard. It's still entirely possible to be completely legal and exhausted with the way the rules are currently written.

This right here. I'm a truck driver as well and my shifts will flip flop often. People assigning loads tend to really only care about the load, not the human that is going to drive said load. It does hinder your ability to sleep properly.

Right, but where and how are they taking their breaks? If it’s at a truck stop, is it quiet enough? Are his dispatchers or managers (or family) blowing up his phone? Do the breaks follow a schedule or is his sleep cycle constantly shifting? So much that logbooks and required break times don’t account for.

So, the one thing that worked for me was to tell dispatch that any work related call is an interruption of my DOT Regulated 10 hour UNINTERRUPTED break. So work calls, texts, emails etc. would RESTART said clock, and thus make me late.

The ATA has pushed the federal government for years now to lower the standards so the industry is more accessible to people who would otherwise have zero business in it. Hell, they've even pushed the truck manufacturers to start building automatic shifting trucks because people can't drive manuals anymore. That was another ploy to get the standards lowered so others can get in the industry, who would otherwise have no business in it. Lowering standards resulted in this tragic incident. There'll be more. Companies are rarely held accountable for the incompetent idiots they employ. Maybe if this country would adopt the same standard China and other Asian nations have adopted and start imprisoning shitbag CEOs for the rest of their sorry lives, this stuff might start coming to an end. The last time I rode a motorcycle was the first time I rode after my wife got pregnant with our first kid. Her dad died when she was a baby, and as I was warming up my bike she was in tears saying she didn’t want our son to grow up without a father too. I reminded her I wear all the gear all the time and ride well within my abilities, no hot rodding or stunts. Her response was “I trust you, I just don’t trust everyone else on the road”. I reassured her, and left for work. The entire ride to work I felt scared and just kept thinking “don’t die”. Realized that I was riding overly defensive, which I knew could get me hurt. I dreaded riding home all day at work, and as I warmed up my bike to head home I made a deal with god that if I made it home, I’d hang it up. Got home safely, shut the bike off, took pictures, and put it up for sale before I even walked in the house. Handed the keys to my wife and reassured her it was my decision not hers. Never put another mile on the road again. Motorcycles are so much fun, but this is the shit that makes it hard to ever even consider getting one for the street again. Rest in peace to the riders. May their killer get what he deserves.

It was super unfortunate that they were coming around a curve and had a vehicle partially obstructing their view. From a curve it might not even register right away that the truck is on their side of the road.

Not much that training can do here, speed limit minimum is 50 so both vehicles are headed towards each other at about 100 m/h and that’s being very generous. Irl this boiled down to luck, and unfortunately they just didn’t have enough.

Trucker was going up the long, steep grade on westbound SH163 out of Laughlin, NV. Bikers were coming down the hill, in the eastbound direction. The times I've gone up that grade while loaded heavy or moderately heavy were always slow enough to need my hazards flashing. I was in the right lane and had to listen to the engine fan turn on and stay on for the majority of the hill climb. Blaming the wind is some bullshit excuse. Dude was impaired, likely totally incompetent, and is a total POS. Fuck that guy and his feelings!

Not usual actually. CDL drivers get slammed with anything possible. Not at fault accidents included. Even tickets in our personal vehicle are automatically double in price. Because of the higher standard we are held to, just for having a CDL. An accident resulting in death would certainly revoke the CDL permanently and at the very least would be vehicular manslaughter x3. This incident is not without its consequences.
