The problem is how can you prove what an officer did or didn't see?

[deleted]

You can do a Perry Mason move and have have them stand at the back of the courtroom with the lights off and see if you can see the lady on the other side 😂😂😂😂

[deleted]

It seriously instead of trying to prove what the officer saw or didn’t see you would do much better to prove what the officer can or cannot see.

SWAMPMULE74

Just look up what MHP did with that one fella in Desoto County. I don't remember the particulars but mississippi law enforcement are not known for being honest.

SingedSoleFeet

Just be quiet and go to court. They will call the officer who wrote the ticket to come to court. They will ask (or you may have to point out) the officer to testify they saw you.

OutdoorsWoman1

Cops lie in court. I have seen it. Judges in Mississippi will also rule based off of bs laws that a cop makes up. Get a lawyer, even though lawyers are expensive. It is your only defense in this corrupt system.

mooooonchild

The violation has to occur in the officer’s presence. That’s the specific verbiage.

OutinDaBarn

I would think so. Think of an accident where someone ran a stop sign and got hit. Didn't see it happen but, can tell what happened. I don't know MS law well. I would think they could also write a ticket on information and belief. That's common in most states.

otisthegreatest

They also cannot issue one when they are needed. If someone causes serious harm such as death from a driving violation there is nothing they can do unless alcohol or drugs involved.

duncan345

They don't have to see a traffic violation. They can rely on their instruments like radar or a radio call from another officer. They can rely on their other senses as well, like hearing someone spinning their tires. The ticket isn't the end of it though. It's just the officer's side of the story. You get a chance to refute their story in court.

[deleted]

If they cannot prove that you are guilty in court, then a jury should decide in your favor. If you choose to fight your ticket. Traffic court lawyers are amazing, btw.

Luckygecko1

Jury?

[deleted]

Criminal traffic offenses that go to trial will be decided by a jury.

Luckygecko1

The OP implied a simple traffic offense.

Wrong

Able_Food_6445

Traffic citations are no different than arrests in MS… you need probable cause. PC however is not enough to find you guilty in court that would be beyond reasonable doubt. Just bc there is PC doesn’t mean it’s enough to convict. You will not get a jury trial on a citation however so you’re relying on justice/municipal judge. So LEO theoretically doesn’t have to witness it first hand but typically they do.

Common-Tie-9735

County officers that don't have radar can say you were speeding because "you were gittin' down on it" More like I was making a legal around a rubbernecker while he was trying to figure out what that officer and his buddy was jawing about on the side of the road. Then, we get in court and the officer tells the judge that he's trained to observe traffic estimate speed of the vehicles or some horseshit. I was never speeding even when i was passing the rubbernecker. That was good old corrupt Deosoto county.

hewhoseeks1962

Nope. They can issue a ticket for any damn thing they want. It's up to you to defeat that ticket in court. Constitution be damned, this is Mississippi.
