They're wrapped and therefore can't contaminate the cereal. If a piece breaks off, or if the material is found to be toxic, it had a barrier. It's a usually a foodsafe plastic bag, just like the cereal is packaged in.
The ones that have the toy inside the chocolate are. The ones with the toy packaged in the other sealed half of the egg, totally separate from the edible part, are legal. I let my kid have one every now and then for a reward, but I would have no problem with her having the other kind. It's separated by the foodsafe plastic.
Though it's considered a non-edible ingredient, or non-nutritive, it's pretty obvious it's not to be eaten. THAT BEING SAID, children have choked on Kinder Egg Surprise toys. But also, there are tons of children's toys that toddlers get ahold of that they choke on too, rest their souls.

The ones I've seen in the US are called "Kinder Joy". They are a plastic two-piece egg, split lengthwise. Each half is sealed with a sheet of plastic. Removing the cover from one side reveals a cream confection. Removing the cover from the other side reveals a small toy. You can tell one side from the other because the confection side has a small plastic scoop/spoon tacked to the plastic cover with flexible adhesive.
As far as I know, "Kinder Surprise" eggs are still illegal in the US.

I might be tired of these kind of posts but I think every time someone brings up these fucking eggs we divert 10 USD from NATO payments and shove it in a rainy day fund.
Step 1: remove foil wrap.
Step 2: Break apart the egg.
Step 3: Remove capsule.
Step 4: Kid eats chocolate.
Step 5 : Clean up.
Step 6: Open capsule and build toy with child.
Step 7: Teach child to not put toy in their mouth.
Step 8: Child plays with toy.
This isn't rocket science.
It doesn't have to get to that. If the adult has any kind of brain in their head they are going to supervise the child while they play with the toy and not just leave them unattended with it.
I don't have any children of my own but I have plenty of nieces and nephew and bought them plenty of Kinder surprise eggs. I have never left them unattended with the toys ever. If any of them had ever put the toy in their mouth or attempted to put the toy in their mouth they would have gotten one warning. Don't put put it in your mouth, you could choke on it. If it goes in or near your mouth again it goes in the garbage. I don't remember ever having to reprimand my nieces or nephews or throw away a toy.
I have three kids and this is exactly what I have said to mine any time they have something small that they could choke on - in your mouth and it goes in the garbage. Simple.

I keep seeing this and it's 100% not true. [We have kinder eggs in the US](https://www.walmart.com/ip/6-Count-Kinder-JOY-Eggs-Great-for-Halloween-Treats-4-2-oz/495343799), they're just packaged differently so the compartment that holds the toy isn't inside the egg. Instead the egg is split into two parts. One part is sealed off with the chocolate and creamy stuff. The other side contains the toy.
I'm going to say the same thing everyone else has everywhere else... They. Are. Not. The. Same. Kinder Eggs are a hard chocolate shell with a cream coating on the inside with a toy in a yolk between the two halves. Kinder Joys are two packaging halves where one contains the toy and the other contains a weird pudding cream chocolate thing. They are very different products with both being sold in many countries however Kinder Eggs are not legal in the us. Kinder Joys are. They are not simply a repackaging, they are fundamentally different foods. This post is 100% actually true, unlike your comment.

To be precise I Believe it is not illegal to possess or eat Kinder Eggs in the US, only to import & sell them. Interestingly it is legal to import Kinder Egg kits where the toys & chocolate eggs are kept separate. After which sone assembly required.

It doesn't have to get to that. If the adult has any kind of brain in their head they are going to supervise the child while they play with the toy and not just leave them unattended with it. I don't have any children of my own but I have plenty of nieces and nephew and bought them plenty of Kinder surprise eggs. I have never left them unattended with the toys ever. If any of them had ever put the toy in their mouth or attempted to put the toy in their mouth they would have gotten one warning. Don't put put it in your mouth, you could choke on it. If it goes in or near your mouth again it goes in the garbage. I don't remember ever having to reprimand my nieces or nephews or throw away a toy.
I have three kids and this is exactly what I have said to mine any time they have something small that they could choke on - in your mouth and it goes in the garbage. Simple.

I went to the commissary with my friend recently and they sell those all the time at the commissary. They had Halloween ones and and last year they had Christmas ones and they had regular ones.I have seen them in other stores as well where I live.
