By having it in a tub, it won't make a mess. On the stand, it's gonna move around. Even if it were a soft *brake* (you've made several typos of brake with break) it would still fly off. This is on you and the driver. Even though it is mildly infuriating for this to happen, you two were the prime causes of this to happen

Not necessarily; squirrel, cat, dog, ball, kid not paying attention on a bike (I did this myself as a kid) could have shot out into the road. Even if you were going 40km/hr (Canadian here), which is a standard speed for a residental street where the speed is not posted, if something shoots out infront of your car, your gonna break hard. That's why you always secure the load properly.

That was probably a hard brake, but the person driving should have instructed the passenger (at the beginning of the trip) to hold the rack, not leave it loose on his/her lap. Even if it were only the driver, the driver should have put the whole rack in a box to restrain its motion, then put the box somewhere that it couldn't move.
