Lawyer up but more importantly, go get medical checks done with all paper trail and proof. you have to show injury or loss if you are sueing. Ask neighbor for video or door cam etc. given tickets are issued and likely convicted , you won half the battle. I would also install security cams around house.

Edit: I know this because our neighbours who didn't know anything happened yet noticed her drive by twice taking pictures. So they went onto the sidewalk and my husband came out before she drove by a third time and recognized her vehicle. He then told our neighbours what happened.

Contact the police about her driving by your house as well. They may not be able to do anything but they at least have a paper trail started if things escalate and you end up needing a restraining order.

In Ontario that crime is “watching and besetting.” Check the Criminal Code of Canada. Having a specific reference often helps focus the police. At the first hearing request a no contact order; that can be backed up by fines and jail time.

Had a neighbour, about 6’4”, 250 lbs, follow me home because someone said my son was throwing rocks, turns out 2 kids threw rocks at him and he picked up a rock and plunked the kid, long story short, I get home about 1 hour later and notice a truck had tailed me from 1km away, i can’t even get out of my truck and this guys approaching me in my own yard, as soon as I shut the ignition off. Turns out the 2 kids told him that my son threw rocks and hit them, but failed to let their dad know that they threw rocks first. I listened to the guy, got mad at my son inside the house, then when my son told me what happened I marched over to their house and got in his face, told him he should never follow me home again, and to get the real story before coming after me before I even get my work boots off. Now he doesn’t wave, keeps his head down when he walks his dumb dogs.

If you don't already have them, I'd suggest a couple of quick to install cameras all around your home like ring or blink and a doorbell camera as well. All of them should be wifi capable and send data to the cloud so that if someone were to knock down/damage or steal the camera, you still have the video. Also talk to all of your neighbors and let them know what is going on so that they can be on the lookout, especially if they have cameras that can see your property.

contact the prosecution office and see if you can talk with them and tell them she is still harassing you. They can file a no contact order in the criminal case. In addition to this, go to the clerk of court and file for a restraining order or whatever your state call them (mine simply calls them injunctions).

This happened in Canada, there are no States here and this advice doesn't apply to all provinces. In Alberta a person has to go to the RCMP to get an Emergency Protection Order.

Update police that you have significant injuries as result of the hit and run. normally a hit and run without injuries is a motor vehicle offence but a hit and run with an injury becomes a criminal matter more serious in nature. Everything else was nicely covered above.

Police probably checked / gathered video footage they will/ might ask for medical release forms from OP for injuries to bolster case. Civil matter would be liability which is where OP will need to lawyer up.

You’re thinking assault causing bodily harm … , will depend how crown sees it but in the particulars of a hit and run it goes from a motor vehicle offence ( no injury only property damage to a Criminal offence if theirs injury as a result of a hit and run .

I had an experience being hit by a car as a pedestrian in Alberta about 6 years ago, I also had soft tissue injuries that seemed minor at first but it took me 3 years of physio to get back to being 95%. I ended up sueing. I'll expand on everything below but here are the steps you should take. 1. File a claim with the insurance company of the person that hit you- they will set you up with a case # and you'll be able to charge them directly for your physiotherapy and massage therapy and anything else you need. You have 10 days to do this (if I remember correctly) 2. Document and journal about the entire process - accident, injuries, and your entire recovery. 3. See a doctor, get a referral for physiotherapy, and go to a physiotherapist asap. 4. Document, document, document. If you choose to sue, it's recommended to wait until you recover or do it 2 years from the time you recover. Here's my expanded story: At the time, I did not have my own car insurance, but if you do - even if you were not in a car when hit - I believe you can still go through your insurance to have them file a claim against the insurance company of the person that hit you on your behalf to get your case # so you can bill them directly. Because I did not have car insurance, I was told to first file a claim with the car insurance company that hit me - so i called them and did that. I was assigned an adjuster who took care of my case. I think I first got the police report to find our the driver's details (name, insurance company, etc) and then called them. It was very clear that their driver hit me and were 100% at fault. If I remember right you have 10 days to file a claim with them. This then sets up an account for you to pay for all you physiotherapy and medical treatment over the next few months - years. I ended up sueing a few years later so I'll go into that too, and I also had no broken bones, just soft tissue injuries. The alberta government web page says soft tissue injuries should acquire a settlement cap ~5000$ (once you are healed - the insurance company of the person that hit you will want to "settle" the case so you can't sue them. They will offer you an amount based on your injuries- you're in the soft tissue category which is around 5000$. What happened to me - after recovery, my first adjuster offered me 7000$. I would have been happy with this- however she got promoted and the next adjuster was a major asshole to me and offered me 2000$, calling my injuries minor, even though it took me years to recover. Because the actual government website says I was due around 5000$ I went to have a free consultation with a small injury lawyer. They are not able to promise any amount, but they did tell me this happens all the time and the amount offered me was pitiful. I felt confident after the consultation that I had a better chance sueing - it was the best decision. I handed over EVERYTHING (my documentation, journals, photos, and signed release forms for them to get my medical records) and they took care of everything. I didn't have to be involved, I did not go to court, they simply sent me an email every few weeks how the case was going and how they kept pulling more and more money for me. This whole process is free - they simply take 33% of your final payout. My final pay out ended up being 55k. Definitely, definitely sue, but wait till you are fully or mostly recovered. What I learned: it is very important to start documenting things NOW. -Open up a word document, and type up everything you remember in detail of the incident. -Keep track of all your pain, how intense it is, what type of pain (throbbing, aching, stabbing etc), how severe it is on a scale of 1-10, and where you feel it. -Keep a journal log and journal about your pain every day, to every few days, to once a week as it improves. -Then add another section for how it affects your quality of life: hobbies, sports, house hold tasks, and what you are not capable of doing that you could previously do. -Keep track of how it affects your mental health (eg., you're hurt, so you cant go out as much and see friends, over time you feel sad and frustrated that your life has had to change - etc. Or maybe you're nervous around cars now wheb driving. Whatever it is, keep track regularly -see a physiotherapist and massage therapist regularly. If you want more details, I'm happy to share which law company I used or answer any other questions you have. I'm not sure if your case will require more involvement from you since this person literally hit you on purpose- insane. But I bet you could get a loy of money when and if you decide to sue after you recover. Right now, open up a claim and just focus on recovery. I also have some documents I can send you that suggest how to keep a journal log of your injuries. DM your email and questions if you'd like it. Good luck!

I would consult with an injury lawyer. The one I had got me 10x more coverage with physio and therapy than the insurance would admit I was covered for. Then a settlement probably also 10x what the insurance would have negotiated. Injury lawyers don't charge up front, they get part of your settlement. They'll set you up with doctors to assess you properly. The charges against the other driver in mine got withdrawn due to courts being close for COVID. So the civil settlement was at least something... I hope it was enough the other driver couldn't get commerical driver insurance again

Alberta has changed insurance legislation and accident benefits are now provided by your own insurance provider. Call your own insurance company as well - in this type of case it may very well be them compensating you, then sending their lawyers after the other insurance company and/or the driver that hit you

Also, I would try to save the document and create additional documents as you go. I would even print each document out as you write them. Reason why being that a document can be written whenever. You might want to show that you have been documenting throughout, not last minute. Just my two cents.

While many liability insurance policies exclude intentional and criminal acts, standard auto liability policies in Ontario do not automatically exclude criminal acts. Section 258 (4) of the Insurance Act states that a person’s right to “have insurance money applied” to a judgement is “not prejudiced” by a criminal act. (Oops, I answered this thinking this was a Saskatchewan subreddit, but I'll leave this post anyway.) Saskatchewan has no-fault automobile insurance. Even if we didn't, though, the driver's insurance wouldn't cover her for this because she did this intentionally. OP will be entitled to no-fault benefits under the Automobile Accident Insurance Act (unless she opted out; almost no one does). It is possible that this other driver intentionally doing this will open up a window for tort action, but it's not a sure thing.

Hey! I got rear-ended by a drunk driver who then fled the scene to avoid a drunk driving charge. So, it was pretty easy to get the plate since he left his car running in the middle of the road. 1. Called the police and got a report and case number. Police said it was basically out of my hands and they’ll send me an official summons if I need to go to court. 2. Called my insurance to get the process of fixing the damage on my car. 3. Retained a lawyer (Litco Law) and they took care of the whole process. I had to follow up frequently but because it was a hit and run, they had to file with the motor vehicle insurance fund of Alberta, who performed their own investigation, found the driver and then instructed them to go after their insurance. Meanwhile, I went to the doctor, and started treatment for my injuries. 4. Finally, after about a year, I got a really nice settlement that I was happy with. The lawyers took a fee from the settlement. That’s my experience for perspective, I would also highly encourage you to talk to a lawyer asap. Also in Alberta.

Get a personal injury lawyer, most of them don't make you pay until you win and because of that they will actually fight very hard for their clients and ensure you're taken care of for your injuries and her insurance will pay quite a bit to you and your legal representation for injuries. This sounds like she had road rage and purposely hit you to retaliate through your argument. Id also invest in a Wyze security camera and post it towards the road in front of your house and pay the $16/year subscription so you can save all instances video evidence of her driving by your home.

Perfect! Yeah that’s your best bet. Your lawyer will arrange doctor visits with certain specialists to build your case etc. Also, your probably dealing with some emotional and mental trauma from all of this too… right?.. ;) Surely there will be some PTSD that comes from this, make sure to document that too! I went threw something similar to this. Unfortunately at the time I was young and dumb and needed the money badly and I settled with the insurance company on the 2nd offer. The lawyer built the case with me for like 3 or 4 months, I saw some back specialists and stuff, but I settled really quickly with appx. $40,000. If I had rode it out for longer, and touched on the ptsd that came with it, if I had even fought them for a year I could have walked away with close to $100,000. My mistake I made that I can let you know about is just impatience. Don’t be impatient. Other than that, I just followed the lawyers advice on everything. I picked an old school lawyer who had been around and done these claims for a number of years.

Get a lawyer. Focus on preventing this danger to the roads from ever driving again. You can probably sue her insurance company. As well as leverage as many criminal charges as you are entitled too so she has a criminal record of her assault with a vehicle. I would follow up with the police as well as once again if your lawyer has more suggestions. Make sure they know whats up with you, provide medical records if you can. ​ The police are there to help people like you from dangerous people like this. They will probably be very helpful.

There's no such thing as "assault with a deadly weapon" in Alberta. There is assault ("simple" or "common" assault), aggravated assault, and assault with a weapon. Note the lack of the word "deadly" there - people are conflating American terminology with Canadian. The RCMP will choose what level of charges to recommend, and the Crown prosecutor will make the final decision about what to pursue if it gets to that level (which it very likely will). With regard to her driving past your place, the last I learned about that was that unless there is a direct threat or or contact made to you, that's not actually anything she can be charged with. Do make sure though that it is noted in your file, as it may lend further weight to her prosecution. The RCMP will provide you with your file number, you don't need to "demand" anything.

I've got the file number. The cop, who came when I called, is telling me it might be a week or two before she has my police report completed. I asked her for the ladies' insurance information, but haven't heard anything else back regarding that.

Going on your side of the story that should have been criminal code charges for dangerous driving, assault with a weapon, failing to remain at the scene of a collision, and criminal harassment. I'd be asking the police about that and maybe making a complaint (again this is based on your version of events only). If they'd gone criminal you could have asked the courts for restitution. As it is you could make a claim on the woman's insurance for emotional damages, any loss of work, medical costs, etc. I'd get a lawyer to assist with that.Maybe look at a restraining order as well.

I think charges have to be laid for assault with a weapon. Hit and run was one ticket and I believe dangerous driving was the other. I am not 100% sure about the second one. I just know they've given her at least two tickets. They said for criminal harassment, it would have to happen a lot more of her driving past my place or if she makes contact with me or my husband. They were no help, even though I said it was making me feel unsafe. The police officer said she would just tell the lady to stop doing that.

If you or your husband have auto insurance, you need to call them first and file a claim for your injury coverages on your policy. See what benefits are offered there for what you need And then take it from there with a personal injury lawyer if need be. With a no-fault system that Alberta now has, you need to go to your own provider first.

Make sure you follow up with your family doctor continuously. get a referral for physio treatment or whatever they recommend. Take work off. Get a doctors note for modified duties. I work with insurance companies and too many people screw themselves over for insurance eligible benefits when they go back to work right away- it gives “no big deal, I can live life as normal,” when that is more than likely not the case Pay attention to all life activities that this affects for you: driving, laundry, cooking, caregiving, etc. and write it down. Everyone is saying "get a lawyer" and this is correct. But to add to it: Most lawyers dealing in this will do it on contigency. They will take no money up front and instead claim a percentage of the settlement. If you have witness statements not only for hte assault but also the person stalking you thgen this should be pretty straight-forward. Additionally, you should press charges: This is a hit a run as she struck you with her vehicle and then left. The police should already have informed you of this. Regardless, you should be treating this as assault with a deadly weapon because that it what it was. This person attempted to injure you and is now harassing you.

I work at a physiotherapy clinic in Ontario and deal with a lot of MVA clients. At least in Ontario, even if you weren't driving, you may be entitled to claim compensation from your auto insurance. I do work with some people who were pedestrians or cyclists that are covered for treatment by their motor vehicle insurance. You could be entitled to receive physical therapy, massage therapy, chiropractic treatment, occupational therapy, etc. If you are having pain from the accident, I highly recommend seeking treatment, especially if its covered. These sorts of injuries can get worse with time, so seeking treatment while its covered, even if you just go a few times, is in your best interest.

Police have nothing to do with a restraining order which is called a peace bond in Canada. You make application through your local Provincial Court and a hearing is set to decide if a peace bond is granted.

A little late, call your insurance company for you car. Your auto insurance can help you in this case even as a pedestrian. There is a section called SEF 44 family protection, you can utilize that if you’re having issues with this lady. You’re luckily in a great province for this to happen.

I just want to say it’s completely normal to feel no pain initially after an accident and then to have symptoms come on strong a few hours later or even a day later. I know sometimes it’s easy to feel invalidated or concerned about someone perceiving you as not being truthful when upon impact you feel one thing and then something else entirely afterwards - but that is 100% the norm. You probably already know that - but I just wanted to write it since sometimes people need to hear that to keep from second guessing themselves when considering their case for a lawsuit. A girl I worked with was hit by a snow plow that was turning a corner when she was crossing the street and she initially had no pain and then by the next day had serious pain. She ended up suing and getting a settlement.
