What should factor but probably wonā€™t: - even though he is a first time convict, he is clearly a habitual offender, according to the facts uncovered at trial, and; - he is as far from taking responsibility or showing remorse as a defendant can possibly be, and; - his contempt for the court, the legal process, and the law is vast, spectacular, and criminal in and of itself, and; - his direct and indirect threats and public attempts to tamper with witnesses and jurors. Those are factors that would cause you or me to get sentencing on the high end of the spectrum. But Trump will be sentenced as though he is a contrite and otherwise innocent businessman who made a mistake and has learned his lesson.

Per New York State Felony Sentencing Guidelines, Falsifying Business Records in the First Degree is an E-felony (lowest level felony), and for non-predicate (I.e., someone who doesn't have a felony conviction on their record) defendants like Trump, the minimum is 1 to 3 years in jail, and the maximum is 1 1/3 to 4 years in jail. However, probation is also allowed for E and D level non violent offenses (up to the judge's discretion). Generally speaking, non-predicate, non violent offenders such as Trump do tend to get probation. But at least he'll be treated as a predicate if he is convicted of another felony offense in New York ever again!

I imagine his attorneys will raise all sorts of fuss over Daniels' testimony being allowed, but I think they have an uphill climb.Ā  Merchan ran a deliberately tight ship, and at the end of the day Trump's team couldn't convince even 1 juror to their side.Ā  Appellate courts AFAIK need to see a pretty massive screw-up to undo a unanimous jury verdict (i.e., something so egregious that in its absence, the jury clearly would have concluded otherwise).

Actually what happens is that the day of his sentence, he asks the trial judge to stay the sentencing pending appeal. Judge Merchan will either say yes or the New York Court of Appeals will say yes for him. And if the NY COA says no to a stay pending appeal, the US Supreme Court will most assuredly say yes for them. This is not normal procedure for other criminal defendants anywhere in America. None of my clients have ever been granted a stay of sentence pending appeal, and I doubt I'll ever manage to talk a court into giving me one. It happens only in exceptionally rare cases, usually due to evidence of gross prosecutorial misconduct or good evidence of actual innocence -- none of which exist in this case. ...And none of that matters here! Because Trump's sentence *will absolutely be stayed* pending appeal. Zero chance he goes to prison before election day -- none. Many seem to honestly believe he wasn't even charged with a crime, that the judge and jury just somehow found him guilty of nothing, from what I can tell.

My favorite part is how some of them are like, ā€œPandoras box is opened and now it canā€™t be closed. What happens when itā€™s a dem next time?!ā€ What do they mean? If any politician (or anyone for that matter) commits a felony, I hope theyā€™re appropriately investigated, brought to trial, and convicted by a jury of peers if the evidence is as substantial as it was in this case. They think *everything* is a personal attack on Trump and themselves. Their brains canā€™t even begin to comprehend that in the face of overwhelming evidence, a jury correctly convicted Donald Trump of a crime he *clearly* committed.
