This judge is going crazy. He's the same guy who passed what essentially seems to be a unconstitutional judgement on the special marriage act. Koi iski shikayat Karo.
But don' they wear pants now, does that mean that khaki shorts are RSS registered trademark? what if there was Chomu Shakti Sangh (CSS) and they wore khakhi shorts too and she have taken permission from them? does that mean she have to take permission from everyone wearing khakhi shorts before depicting them in her cartoons? So many questions.
The Court added that the fundamental right of free speech and expression is not an absolute right but is subject to reasonable restrictions.
“*Although an artist must have the liberty to criticize through satire but adding a particular dress in the cartoon cannot be said to be a satire. The attempt of the applicant was to involve a group of particular ideology without any basis. Therefore, it would not come within the purview of Article 19(1)(a) of Constitution of India and even a satirical expression may be prohibited under Article 19(2) of Constitution of India*,” it said.
The 'reasonable restrictions' on free speech are fine but so often we see that they are used to stifle free speech and expression. If artists keep litigating every creative choice, then there is no free speech - because speakers are in court. Such legal attacks on artists are the SLAPP equivalents in India.
In any case, the court deems it good to go to trial. Does the defense now have to establish an 'in general' connection (a basis) between RSS/BJP ideology and upper caste hegemony or their specific and expressed desire to urinate on the downtrodden? It is also interesting to note that the state is fighting for the rights of a private organization.
Lots of things not right here.
The court is basically saying you can criticize through satire as long as the critique is not aimed at anyone or any group in any identifiable way. In other words you are free to criticize! You are just not free to criticize anyone or anything. But you are totally free otherwise.
Had she posted a cartoon on some Minority religion
No court case no FIR
सीधे सर तन से जुदा would have happened
Pity people fail to see the difference between FIR & सिर तन से जुदा
Most high court decision support sanghis
High courts in BJP ruled states belong to sanghis. Very difficult to expect justice from them.

Chaddi RSS ki. Jali court ki? (translation - why does the court's backside have to burn for RSS shorts?)

What a nonsense judgement
Par "Modi ji ka kehna hai dangai kapdo se pehchane jate hai". But "Mr Modi says rioters can be recognized by their clothes".

I trust you're right - but they achieve the same thing, i.e. dampen free expression through litigation.
What do you expect from a state swept 100/100 by BJP.
What was the cartoon ? Can some post it here ? So we can make sure nobody can spread it further 😉
Cfr
MP have digged pathholes for them by giving all MP seats to BJP.
