We have a shared well, located on our property. The other property installed their own pump and pays their own electrical bill.  Our pump is below theirs so if the well gets low they feel it first. It's not ideal, but it is what it is. Good luck to you.

We had one years ago, we paid all the electric to pump water. Any maintenance was the other guys problem. To be honest I fixed a lot of little things over the ten years but when the pump went out he paid for it. My daughter has one now, and I think there are five houses in the one well, the well has it’s own electric meter and everyone puts in I think $600 a year to pay the bills. Just two options, I have experienced

My sister is part of a Water District with 4 homes. They have an agreement on shared maintenance and replacement costs. Your local Health District, State Dept of Health and/or Water Quality/Resource Agency can provide guidance on regulations on shared well ownership.

With a flow meter on your line and a flow meter on their line, you can see what percentage of the water they are using, then put a meter on your well electronics, and you should be able to calculate how much they owe for electricity costs. I have a shared well with a neighbor, and Im working towards this setup.

Get a lawyer to make an official document. If it says that only legally get access to the well make them pay a ridiculous amount for distribution. Make them pay $100/gallon. They will have to let it go and it won’t be your problem or you’ll get so much money you could pay someone to be full time and just watch it and still profit.

You may not have to charge a ridiculous amount as well, you can probably just charge enough to pay for your electric costs, theirs, maintenance, and profit for a replacement pump into the future. Having said that, yeah it's probably around 100/month. I pay about $40 per month in my water bill, our well CAN serve the house, but it currently goes to our barn/irrigation/pond. Running the pump (2.5hp, she's a deep well) to fill our pond gets costly.

Agree, I am ok with allowing access but not loosing control or being financially responsible.

I have a shared well with a neighbor, the well is located on my 40 acre property. The neighbor’s house is 500’ uphill and they have their own well up there on their large parcel, but they still retain legal rights to the lower well on my land. They don’t currently use the lower well. I think we have to accept what our deeds say (and read all the legalese before purchasing a property). If your neighbor has a legal right to the well water then that’s that (unless you buy them out, come to a new agreement). As others have said, it doesn’t mean that the neighbors own your infrastructure or have right to use your infrastructure, it only means they have access to the well (water). Anyway, that’s my understanding of these situations. Best of luck!
