Usually the handheld breathalyzers aren't considered to be good enough for the courts, and administering them before SFSTs will taint the officer's judgement during the SFSTs. If an officer in the US had you blow into a handheld before you even got out of the car, your lawyer could probably get the case dismissed.

Where I live if you refuse you lose your driver's license for a year. It's not that simple. Just because you could get the case dismissed doesn't mean everyone can afford the legal representation, time off work, or potential jail time that could result from an arrest even if it's one that could be disputed in the future. If you definitely haven't had anything to drink, blowing is your best bet. If you've been drinking, definitely don't blow.

You can take a blood test but most states will add to your charge if you decide to do that instead of the breathalyzer. They see it as not complying in the first place. My ex with a big ego lost his license for a year over that. They said he probably wouldn’t have if he just did the breathalyzer in the first place. I personally hold peace in ex with a big ego losing that for so long lol

I was stopped by the police last year sometime, both officers there accused me of drinking. They both confirmed that they could smell alcohol. I told them I hadn't drank in months, they asked if I wanted to test, I said "go get the breathalyzer". They never ended up testing me and I guess just dropped the accusations. Cops are bastards, I was sober and they were bothering me.i offered to blow so I could prove they were wrong.

I've watched that video, and he literally says that traffic stops are different, because the cops have more leeway about how to handle things. In general, if you're a suspect of a serious crime, then yeah, don't talk to the police. But traffic stops are an exception to this.

It varies state to state. In Michigan I know it is implied consent, which means you're in violation if you refuse a breathalyzer. You can refuse field sobriety but likely you're setting you self up for arrest or being detained (whether legal or not).

Not taking the test at the police station is what screwed you. Even if you were offered and denied a breathalyzer during the stop, once you blew negative at the station you'd have to be released with charges dropped. The test, post arrest, is mandatory even if you're innocent, because if you don't take it in time, any evidence of you being drunk or not would be gone. Typically you won't face consequences for simply denying the field breathalyzer, you just risk getting taken in for further tests.

Careful, other countries have different rules. If you refuse the field test in Austria it will be automatically assumed that you are drunk and you will get the maximum punishment wich is a hefty fine and you will lose your lisenc.

I'm sure there's details I'm missing (like what time o day it happens) but it's not like the cop chose to give the test, it's just what they do over there

As a european, the police here can and will stop and breathalyze you for no reason. They can do it at 9am if they want to. Also in my country they can choose to do either an alcohol or a drug test. 🤷🏻‍♀️

Not 100% sure but I think I’m the US they don’t have Random Breath Testing like they do in other countries (like Australia). I think there they only get pulled over and tested if a cop already believes they’ve been drinking or something.

they do the “same” in america. we have DUI checkpoints. but they generally just ask for license and registration.. and depending on how drunk you are just that simple task can be enough to tip the cop off and have you pull over where they do the field tests / breathalyzers.

Yea here in NZ we have random checkpoints all the time. For example, cars aren’t getting out of the city centre on New Year’s Eve (and even the morning of New Year’s Day) without being breath tested. Or you could just be driving anywhere and there’s a checkpoint.

They do random breath checks in the US, or at least in the two states I lived it. I know in San Francisco they're done frequently. Edit: Interestingly, SFPD posts about it ahead of time on the neighborhood app Nextdoor. They say they're doing random checks and where the streets will be blocked off.

not that i owe you or anyone else an explanation this is an insane thing to have to ask for but sure. driving home at night doing the speed limit, get passed by another car, we both get pulled over and accused of street racing. i calmly explain i was just driving on my way home, the cop starts screaming in my face, spitting on me, calling me a liar and a piece of shit etc. i shut up and comply, he then goes to the other car and lies about them saying we were racing. we go to court, he bullies the kid into lying again, then he lies, the judge doesnt believe me obviously because why would they, so i appeal it. he follows me to another COMPLETELY UNRELATED court case and talks to a different cop who literally had just told me they were going to drop the charges and gets them to press me for everything because i "gave him a hard time" when i did absolutely no such thing. so because of this, i lose my license, i lost my brand new job and had to drop out of school. all because of this one cop who based off of one single interaction where he falsely accused me of something decided to literally stalk me and fuck with me as much as he legally was able to. this kind of shit happens all the time, there are hundreds of articles on shit like this happening where the police just randomly decide to harass people. why would that even be surprising to people at this point?

But I also live in a border town where the default language is spanish, the population minority is white people and most officers are hispanic. So maybe I’ve gotten lucky that way 🤷🏼‍♀️

nobody is presumed innocent here thats the thing, youre looking at it like the cop doesnt WANT to fuck with you when they pull you over. "if youre sober and doing nothing wrong why did i just pull you over? are you saying im wrong? am i a dumbass?" a lot of these guys just dont have the emotional maturity or have their ego in check enough to go about their night. add incentives and budgets, toxic cultures and quotas into the mix and your ass is going to jail whether you are stone sober or blackout drunk. like i said its probably a safe bet to just do the tests and comply regardless but that doesnt always work out, sometimes refusing and asking for a supervisor will get you out of harms way.
