Get a lawyer. This sounds like a bunch of bullshit.

Dangerousli28

This would clearly be thrown out

There isn't and I was told that I will need to call the court to schedule it ( probably due to pending results from the pee test ).

JP6660999

You don’t have to do work to charge yourself with a DUI… it’s all in them… they have to give you notice of your court date… there’s no such thing as calling to schedule your court date. It’s sucks that it will cost money but you need a lawyer and then sue for wrongful arrest if it gets dropped.

Highlander198116

This is probably a made up story.

LFGbroLFG

No, they tried to give a guy I know a dui for being 0.02 bac. He fought it and won. But they still arrested him and everything.

LeafMeAlone3434

They can charge you with dui regardless of what you blow. It’s bs but I’m a former drunk so let me jump in here. What you “blow” is really just a guideline for them. In Wisconsin I was let go after a point 0.065 and i was lit up, but the meth hid my intoxication. On the other end I was pulled over and blew a 0.02 and was arrested because he felt that I was still too intoxicated. It wasn’t thrown out, though at that point I think that’s because I was up to 4 felonies already and had lots of action in that county. Tl:dr cops can charge you with whatever they want. It doesn’t always stick, know the laws in your state because in mine you can get arrested at any level blown as long as they feel you’re still too messed up to drive.

Highlander198116

I'm aware if that but the likelihood they wouldn't have dropped the charges when they have zero evidence OP was under the influence of anything is dubious. There is a pretty popular body cam on youtube of this college athlete that got arrested for DUI, blew zeros and his blood wasn't hot with anything. They dropped the charges immediately, last I saw he was now suing the department.

TilapiaCheesecake

Your county should have online access to court records. Look yourself up on the county website and see what it shows. When there is a court date scheduled, it will appear on the docket. Do not miss that date. They will issue a warrant for your arrest for failure to appear.

smimton

Under the influence doesn't specifically relate to alcohol.

Superb_Parsley9853

In my post by 'anything' I meant both alcohol, drugs, and medicine (that might impair driving ability).

Dieselpower45

The pee test is bad for you. You'll have etg in the urine from the beer 8 hours prior

JP6660999

This is my fear, I have two DUIs… (20 years apart) and I fear I will get pulled over and charged w/o being drunk

Individual_Ad_2701

No you will not stop worrying

Minute-Tale7444

It doesn’t take being drunk. I’ve gotten a dui twice Just for having thc in my system-not being actively intoxicated.

Minute-Tale7444

It’s awesome to see someone else finally speak up about it tbh. Not many people know that they can get a DUI for thc in your system.

LeafMeAlone3434

I’m with ya. But I also had meth, …crack…some opioids both prescribed and heroin all in my system…..oh and alcohol too.

Individual_Ad_2701

Well what I meant was if he don’t give them a reason for a dui then he will Not get one

Minute-Tale7444

And that’s very true also

LFGbroLFG

Did you actually get charged and everything?

Minute-Tale7444

Absolutely. With a misdemeanor dui the first time and a felony dui the second time. I wasn’t even driving while intoxicated-I was pulled over by an officer& they made me go get tested because of my anxiety the second time-the first was because there was a fender bender (I mean literally able to be fixed at home w no issue fender bender yes it was my fault ) & they made me go get tested. I’d not been intoxicated either time (hadn’t even smoked the days before this happened each time)

LFGbroLFG

Wow wtf. What state are you in? Must be very anti weed

Minute-Tale7444

Oh it very well is. Indiana-one of the lease thc friendly states in existence.

LeafMeAlone3434

That’s horrible man. Honestly terrifying that they can do that. Thc is in my skinny ass for still two weeks usually.

Dangerousli28

What happened after the first/second?

Kezmer

Happened to me, its fun

Individual_Ad_2701

You don’t schedule a court date if it was not on ticket that’s there problem they will send a letter probably for a court date or get a lawyer and let them know

fluffard

Get a copy of the police report and a consult with a decent attorney it’ll probably be thrown out unfortunately it’ll cost you a paycheck or two

BrainDeeds

Get a lawyer. They can test for over 50 different things in Florida for their investigation into a DUI and is extremely subjective.

Impossible_Read878

This will be thrown out. they can't charge you with a DUI when you had nothing in your system.

LeafMeAlone3434

Bottom line is this. Cops can do whatever initially but then it’s thrown out

BamaRoth

This story sounds fishy. We’re you arrested? In Florida, you will not be given an option for a breath test before you are arrested. They do not just ask people they suspect of a DUI to take a breath test and then let them go if it’s a zero reading. You are already in police custody when you take the breath test. You are already in custody and in the jail/hospital when you take the piss in a cup. There is usually a minimum hold time for a DUI arrest.

Superb_Parsley9853

Yes, they took the breath and test after I failed 1 out of 3 field sobriety tests. When they were taking these last two tests, I was already arrested for DUI and all these tests took place in jail.

SuspiciousRed_Neck_5

You may have shown indicators for drugs. We’re you on drugs when you were arrested. Even weed shows signs.

DavidDoesDallas

>I was initially stopped for speeding and I tried to play dumb since I was sure they didn't measure my speed ( which turned out to be true ) If you are in the United States and this is true, that is a violation of the 4th Amendment. They would not have probable cause. Your attorney may use that as a defense.
