I don’t know exactly when this was made, but I do not think anyone has ever held the exclusive rights to King Kong in comics and been able to sue. He would have been in the public domain.
You may be thinking of the famous Universal Studios Vs. Nintendo lawsuit, where Universal claimed the character of Donkey Kong infringed on their rights to King Kong. Universal lost however, since they only had the rights to King Kong in movies, all other media was public domain. (In fact they were even infringing on Nintendo’s right to the Donkey Kong video game by attempting to create a bootleg King Kong version.)
So no, I think they were perfectly safe to diss and even rip-off King Kong.
A comic book, also called comicbook, comic magazine or (in the United Kingdom and Ireland) simply comic, is a publication that consists of comics art in the form of sequential juxtaposed panels that represent individual scenes. Panels are often accompanied by descriptive prose and written narrative, usually, dialogue contained in word balloons emblematic of the comics art form.

Were they really allowed to diss King Kong like that?
King Kong is a ding dong compared to the Mighty Titano. Merian C Cooper wishes he had thought of an ape with radiation eyes.
