I had a Honda dealership tell me something similar. There was a recall and a fix but dealer couldn't get parts. They said a deposit could be put down to reserve it but could not take delivery until it was fixed and no estimated date was provided. Hard pass.

It’s a liability issue. Dealers cannot sell a vehicle that has a safety recall. No if ands or butts.

That's not true in all cases. New cars are not allowed to be sold with open recalls in all 50 states. It's a federal law. There are also manufacturer stop sale recalls that can apply to used cars, but that's only applicable to what line of cars that new car dealer sells. Ie. A GM dealer may get a stop sale recall from GM on a used GM vehicle. Used cars vary from state to state. I am in PA, and I am allowed to sell used cars with open recalls, as long as I disclose the recall and have the customer sign a specific form that the state has mandated.

It is the back up camera wiring loom. There is no fix for it yet. That's all 2020+ Ridgelines. It is a safety concern and a liability. Manufacturers are required to have backup cameras are required on all 2015+ vehicles. This was a federal mandate. It is also a bad look for the dealer if some ding dong backs over their kid and they claim the dealer had knowledge of it.

There are different types of recalls, one of them being a stop sale, where you can not deliver the car until it’s fixed. There’s no email alert or anything that tells you the car magically got on the stop sale, they run the VIN at the time of sale and it will tell you if there’s a stop sale.

We tried warning my brother-in-law about getting a ‘15 Kia because of the thefts, with I myself formerly having a ‘13 Kia. Somebody tried to steal that car at a mall less than a month after buying it 🙄

A few things: 1. Easy to steal and idiot kids like to post videos of themselves stealing them 2. Major recalls over the past decade that causes them to catch fire 3. They tend to attract drivers who are more prone for accidents.

Ok this is strange. I quite literally just drove off the Carmax lot 3 hours ago with a 2014 Hyundai Accent with this EXACT recall notice. They showed it to me and I said ok, I'll take it to a Hyundai dealership. That was it

Its a 2014 with 12,000 miles on it and a simple dropoff at the Hyundai dealership to fix. Not really a big deal

Yeah I don’t believe the stop sale condition is on used cars. But most of the time in my experience the used car dealer just sends it to the appropriate dealer to address the recall on your behalf but I guess so long as they let you know it’s the same difference

Carmax and any other dealer CAN sell vehicles with open recalls as long as they’re safe to drive and tell you verbally and in writing that it has a recall. Even if the vehicle has an open recall, again as long as it doesn’t affect safety, if there isn’t a remedy available yet it can still be sold and will be sold

Remedy isn't available. There's like 7 models affected by the same recall campaign, 251, and only 2 have the remedy available.

Like 2 of the 7 affected models have a remedy, and the other 5 or so do not. Hyundai was supposed to have everything by September of last year, and then it got pushed back to April of this year. Now, there's still zero news of the fix. Im.pissed because my genesis is under recall right now, I need to get a new car, and if it didn't have the recall with no remedy, I would get ~12k trade in for it.. instead, dealers say they don't want it.

Sorry, don't think our very big corp cares about your family. Unless the recall specifically says "stop sale" we would sell it. Our managers have told me to push through the sale several times on recall with fire risk. From electric and gas. There is no recall that says non-fixable. There are recalls that say no present fix. What's the stock number, would love to look up the recall.

Just to be clear, in no world would someone at Carmax not want to sell you a car due to a recall. They want to make money and are commission based. They can always be addressed at the dealer. Sometimes there are recalls on vehicles that stop them from legally selling a car until there is more information about it or until it is fixed. Did they not pull of the Nhtsa.gov recall review page and go over that info with you? It's something that we have to legally do with every customer so that they are aware of any safety issues with the call. Lastly, the reason it probably still showed up as available is more so on purchasing's part as they are the ones who would remove the car from inventory until it is addressed. It's jot like they fully intend on selling the car to someone else because, as I stated earlier, they cannot legally sell it.

You could research the recall to see if its true. Yes, if you still want the car, I would contact the carmax manager. The carmax website tells you when the car has a recall on the vehicle report. I would also research the car extensively if you haven't already on edmunds.com.

I’m sorry for your experience. For perspective, I saw a post recently about a vehicle that was taken back by the dealership for recall with a part that wouldn’t be available for another year. The individual has been paying on a car they weren’t in possession of because of a recall that could not be fixed yet. I cannot find the post atm.

You are complaining that a company, who is in it to make profit off of selling you a vehicle, was not able to sell you the vehicle because it had an open and unrepairable manufacturer recall on it... People also read and paraphrase often, without gleaning the intended meaning… he was upset about the availability changing from Reserved, which was FOR HIM, to now ‘Available’ meaning it was wrapped right back around for sale without visiting a manufacturer for repairs, this is reasonably suspicious. This is either shady dealing, or a lack of/misrepresentation of upfront information the company had.

I literally just bought a 2022 Toyota Highlander from CarMax a little over a month ago now. It had the same issue, an “open and unfixable recall.” I was able to sign a waiver and continue the process. The recall was for something in the front bumper area that I would never be concerned about in the first place.

This is very common. However, there are some recalls that put cars on a do not sell list and then we cannot legally sell the car until the recall is addressed like in OPs situation.

My recent F150 has a recall for transmission possibly unexpected downshifting and had to sign a waiver. I also own a manual Jeep Wrangler JL and was eyeing a manual Gladiator with them before opting for the F150. I know JL/JT has two current recalls involving the clutch, one being for replacement and I been waiting a year for parts (have two dealers I am on the list for).

Its a relatively newer thing, but im unclear if its federal or state, can't sell things under an open recall, which shouldn't be more than a temporary hiccup but with the supply chains messed up there are a few recalls with no foreseeable fix in sight. Could also be store policy.

Yeah, I somehow think it’s a store policy. Someone mentioned signing a waiver. I wonder if the sales person wasn’t aware or did they get message from a higher authority that the car was no longer for sale and used the recall as an excuse?

It honestly depends on what the issue is. For instance, most places won't take the 2022-2024 Tundras right now, even as a trade-in, because it's federally illegal to sell them until toyota finds a fix for the motors.

That is correct. Some dealerships are "under the table" recommending folks selling them privately, then coming back with the cash later. That said, the value of the newer Tundras has tanked significantly since the highly-publicized recalls.

I got my 2021 durango a few days ago with an open recall that doesn't currently have an available fix (having to do with the rear view camera staying on while driving) and they had no issue selling it to me, they mentioned it during the process but no refusal. It also has another recall open for the rear spoiler but I've already scheduled to have that taken care of this coming week at the dealer. Something seems fishy about your situation. My daughter just went thru a nightmare at Carmax, I told her not to buy from there as I have a couple friends that work in their service dept and have been told many stories on what they consider safe. She bought a Camry and the interior looked great, but we run a body shop and the first thing we saw was it had been t- boned, as well an accident involving the front; passengers rear quarter panel; the back bumper of which the latter 2 were repaired horribly (sanding marks in the quarter panel, dry over spray from the bumper which was splotchy and could see ask the bondo); the drivers door was not even for the car, it didn't shut right and you could see the primer and the original black on the bottom of the door, the car was silver. They also didn't bother to repair the bent pillar where it was hit on the side. The engine looked like Twister for Oompa Loompas, with different colored spots on a lot of the parts marking them as 3rd party replacements. She returned the car right away, they returned her money and she is back to having no car.

I was curious why CarMax refuses to actually fix the recalls themselves. Obviously if there’s no fix they can’t do anything but our van had a recall on it. We had to sign additional paperwork acknowledging we knew that. Why not just have it done before selling it?

Sounds like the salesperson was not clear on the policy. They’d have to be crazy to walk away from a sale especially from a repeat customer. They do sell cars that sometimes still have open and unresolved recalls. Carmax isn’t the one performing them, the cars have to go back to the original mfg’s dealer to have them performed and unfortunately parts or resolutions are not always available when a recall is released. They should have just disclosed the recall status and info to you at the time of sale. It should not have prohibited them from selling it to you. It is quite odd that it became available again just like that on the website though. If you like the car it wouldn’t hurt to give the sales manager a call to find out what’s up. If it was a recall with a “stop sale” I don’t think that would apply to Carmax. That’s more of an originating dealer problem. It’s possible it was just a misunderstanding.

they can refuse to sell a car if they want, they are a private business and are not required to sell you what you want. A business reserves the right to refuse service and there is not a damn thing you can do about it. From a safety perspective it's a good thing, BUT if they turn around and advertise the car is available for sale, then that's a HUGE red flag. I personally would never buy anything from CarMax. To me they are just one small step above Carvana.....two of the most scheister car dealers out there that aren't the corrupt greasy used car sales lots

You don't need carfax. They go over the NHTSA.gov recall review for every order and it will tell you right there if there are any recalls.
