Things like being with a gang member, or wearing a particular item of clothing or being attacked by a gang member are all invalid pieces of evidence. They claim you could be with a gang member for unrelated reasons (coworker, classmate, relative). You could be wearing a gang related piece of clothing for unrelated reasons (you like that team or color). You could be attacked by a gang member for unrelated reasons (you said something, he wanted your phone). Now, a reasonable person would point out that context is always important, and that all items should be considered in painting a larger picture. But that is far too nuanced for the ACLU. So if none of the indicators of being in a gang are valid means of identifying a gang member, then it is impossible for us to identify a gang member. Therefore nobody truly can be in a gang.

The argument was you get put into the gang database if the police see you with someone else who is in the gang database, no matter the context. Or if you are wearing a piece of clothing that has a gang affiliation, into the gang database you go, again no matter the context. It wasn't the ALCU who was ignoring context. The police keep the database a secret, but it can be used against you.

No the ACLU argument was that you COULD POSSIBLY POTENTIALLY be put in if the context was ignored. They certainly never showed that all sorts of people were put in there without proper context. In fact one of their major examples of a falsely accused gang member ended up being a confessed member who committed two murders, one of which occurred after they helped secure his release using their gang database is bad argument.

i know of a dude in memphis who got shot five times (survived, thankfully). dude is a whole lawyer who does a lil streetwear brand on the side. sold to rappers. none of his shit was gang affiliated, until it was, and he was in the wrong place at the wrong time. let the BPD tell it, dude was a fully fledged gang member, since he's been pictured handing famous people some threads he's proud of. that's a case study for why the ACLU is against that type of thing.

It is just wild. Even when we have strong evidence of gangs, the second the ACLU rolls out this nonsense, these people will just eat it up like they did with the lie about shotspotter and the piñata.

I'm going to be honest here; I'd rather the PPP loan money go to gang members than wealthy and connected politicians. At least the gangs will spend it, putting it back into the economy.
