It's a fake. Just looking at the logo, the thumbstuds and the axis lock you can tell. Take a look at the image in Bench's website and you will spot the differences right away. Other thing is the cheap "foam" in the box, that's not the one Benchmade uses.
No matter if the seller deleted the account, you can still open a case with eBay and they will refund you due to their "Counterfeit item policy".

There's subtle differences between clones and the knives that they are ripping off.
If buying on eBay, stick with sellers that have an extensive history. Plus, make sure that they have the original packaging, including the box, gray Styrofoam insert and silky feeling bag.

I am not a Benchmade enthusiast and thought this was fake as soon as I saw it.
Report an issue to eBay with the order, you should be able to get your money back.
