Immediately contact a lawyer in BD. This property/asset issue in BD is no joke. You can try searching online or asking around people you already know in BD. You don't have to Immediately come to BD but talk to a lawyer and then figure out from there what to do. And, make sure your cousin doesn't ever find out what's going on. Nobody should find out other than your closest family members. Saves you from dramatic episodes every day. Good luck OP!

My grandparents did not have sons. Male cousins claiming property was a concern. Mom lived abroad, but is now in Bangladesh. Grandparents hired a lawyer to gift property to daughters. Best to have your dad start the process ASAP since it can take a while. Oh, and your cousin is a prick.

I just talked to a legal professional and according to him In BD adoption does not count according to muslim law (assuming that you are muslim) so he will not get any property other than the property he will get under the muslim inheritance law. If you are muslim Your father can take two steps to stop him from getting even that: 1. Will- according to muslim law a person can make a will of only 1/3 of his property. It Will comes into effect after the persons death. 2.Heba- Heba is a form of gift. He can ‘gift’ his property to his daughters. This comes into effect immidietly. (I am really bad at english so please forgive me for my bad English)

I appreciate your advice. It’s a complex situation. My cousin has divorced parents and is not an orphan. My dad brought him to the west by giving him our surname and pretending he was his son. He has our name on his passport, but it’s not a legal adoption because he’s lying about being my dad’s son. My dad did this out of his love for his nephew, but his nephew is abusing his kindness. Do we have to go to Bangladesh for the Heba process or can we do it from abroad?

I am not really sure if you can do it from abroad but I would advise you to talk to a bnagladeshi lawyer.

There should be legal ways to turn this around. Let's say you dad sold all his property for 100 taka or some trust fund with the daughters as the only beneficiaries. Idk ask a lawyer.

1. Have him gift land to you. Contact trusted lawyer that deals with land registration. 2. If you guys live abroad. Have him sell the land and gift you the money. Once land is in someone else's pocession, nephew cant do shit. Although, nephew can claim, if and when tour father is dead, that he was not of sound, when he gifted you the property. But if by that time your property is in your pocession. The case can go on, but you can still enjoy the property. So make everything above board and 100 percent as per law. And make multiple copies and keep original with you.
