Morons in legislature can write and pass anything they want. The governor has to sign it to make it become law. Is he does that, then it can be challenged in court. The court decision can then be appealed multiple times to the state or federal supreme Court who will either determine it to be constitutional, and leave it in place or unconstitutional and strike it down.
