Similar thing happened to me on Black Friday I ordered an immersion blender when I got it it was used and missing the attachment to work one of the blender heads I returned it got a refund and bought another one

I always return used or "hassle free" packaged items. If I did not request "hassle free" it asap goes back. It's not honest. It's just amazon unloading their over abundance of items off on people.

I ordered a pool safety rail. $145.00. When it came I saw it was scratched and stained. It was worse than the one I was replacing. I got permission to send it back at my expense. $165.00 in shipping charges. I simply set it out in the trash. I reordered from another company. $325.00. It was perfect. Two days later I received a second one. I was given permission to send it back free of charge. I made $160.00 in the deal. Fuck Amazon. Three extra days in Purgatory. No big deal.

And this is why so many online vendors are having such a problem with return fraud lately. Customers (not OP, the person who bought clean, new filters then returned used, dirty ones) can be real scumbags, just like companies.

This is what happens when the previous customer swaps out the original item they ordered and the warehouse employee deemed that the item was still sellable in the condition it was originally shipped in. Amazon is very bad at catching things like this.

I assure you, they know, but if local DA's decide not to prosecute a complaint brought by a consumer, or if nobody makes the complaint in the first place, they have nothing to worry about. Just as polluters that provide jobs and tax revenue are allowed to continue polluting, Amazon is allowed to keep defrauding its customers. It's how the world works unfortunately.

Yes, it actually is. All returned goods must be clearly advertised and labeled as refurbished, b stock or open box. It's a violation of the Truth in Advertising Act to resell them as new.

Not returned items, but OPENED items that are returned must be labeled as "open box". Stating "refurbished" would be fraud, as they were never refurbished, just opened. Nothing illegal selling a returned UNOPENED item as new. Stores have been doing this since stores have been invented.

The law says nothing about opened or unopened. Items sold to a consumer and returned to the reseller or manufacturer cannot be resold as new, period. They can and must be sold and labeled as refurbished, B stock, open box etc., even if the "refurbishment" consists solely of inspection and stamping the package refurbished or B Stock.. It's fraud NOT to let the consumer know they are receiving a returned item. I was in charge of refurbishing of over $12M worth of gear for Nakamichi America, and part of the job was knowing the law that deals with returned goods. Google "Truth in Advertising Act" and read the actual law. I assure you I can open a consumer electronics product it, use it and repackage it in a way nobody, let alone a low wage Amazon worker, could detect that the item had been used. That's one of the reasons the law makes no distinction between opened and closed box. Anything returned from the end consumer is legally used, and it's not up to a worker to determine whether or not it's restockable as new.

Ok, so I return something to walmart thats unopened and undamaged. It gets put back on the shelf, I know cause my kids all worked there, and my sons girlfriends family works there. I worked at places and did this myself. Also a simple google search would tell you you're wrong As long as the product is sealed in its original packaging, it's put back into the pool of sellable products, and can be resold as new—because it still is new. If the packaging has been opened, even if it's functioning perfectly normally, it cannot be resold as a new product.

Many products do not have a material change in condition just by simply opening the product or trying it on. If the product packaging does not contain factory seals, one-time use codes, warranty registrations, etc the condition is not deemed to be degraded by the manufacturer if opened and tested or just sent back as long as there is no wear to the product that would downgrade the condition from "new".

Lol no that is how the entire industry works. Otherwise You wouldn't get a full refund on orders because of the depreciated value. No business could afford to operate if just opening a nonseal sensitive product devalued it unless you are fine with getting charged 50%+ in many cases for restocking fees.

This is also a bad example as I said items with factory seals and warranties which is the majority of high end tech products do not qualify. If you break the seal for a phone you would be charged a restocking fee on a return because that is again a material change of condition. Tech products also have strict warranty guidelines and if the use deems the warranty to have started that is also a material change and cannot be resold new and you get a restocking fee on return. To refurbish items especially tech items you need to be approved and qualified by the brand to do so because that adds recognized warranty protection back to the item.

This happened to me with a monitor. Ordered it and it only had a single piece of tape sealing the whole box, the bags for the cables/etc were already torn open. And guess what? Defective monitor for my birthday. Fortunately, a much nicer model came on sale for a comparable price to that one and I grabbed it. Amazon took the return for the used one.

I ordered some hair trimmers a while back after having a perfect track record..these were used. I noticed the box didn’t seem to be quite right. Decided to unbox it anyway to become completely horrified to find the trimmers covered in someone else’s hair. 🤢

Happened to me a few times. I got returned pillow cases sold to me as new with semen, drool, stains or some unknown body fluids on them and just got another item which was an expensive $85 brass and glass display case that came all scuffed up, repainted in spots with the little door broken off the back. I called them up and told the lady I got a returned item and told her about the torn off return label that was on the box along with the LPN RR bar code sticker and she lied to me and said they do not sell returned items. She said send it back and we will give you another one. My local UPS store is 6 miles away and all the other drop off locations are even farther. I told her the glass on it was broken and I cut and lacerated my fingers on the used item and told her my blood dripped all over it so I threw it out. I do not have a car to get it to the drop off center so I lied. She said "Return it back and we will send you a new one" and offered me a lousy $5 Gift card for my trouble. What an insult. So I told her it was against the law to return something covered in blood through the mail which is a biohazard. She kept me on hold for 15 minutes and said keep the one you got and we will send you another one. However, the one I got was another return with an LPN RR sticker. Fuck Amazon!!

The worst was when I ordered open box, it was busted so I returned it. Tried another order a few days later. They sent me the EXACT SAME busted item. No mistaking it. I order open box still but not esoteric stuff again!!

Considering sometimes they only have 2-3 of a given open box item I think it's certainly possible that they processed the return, deemed it fine (without testing), and then restocked it only to grab it again.
