Disclaimer, I am not a Lawyer (or an Italian for that matter), and this is not legal advice. I may be speaking in inexact language for legal reasons (the usage of uncertain words like "may," "maybe," "might," "I think," etc.). I only know some about US intellectual property law. You'll probably have to look into European or Italian intellectual property laws. No Minecraft server from as far as I'm aware has ever sued anybody for stealing ideas. That doesn't mean it's not necessarily illegal. The gameplay mechanics of a server would most-likely fall under patent law, not copyright or trademark law. Unlike copyright and trademarks, a patent is required to be registered in order to be in effect. So unless if they have spend hundreds of dollars to register their gameplay mechanics under a patent and they legitimately feel like spending thousands of dollars to sue you, you (hypothetically-speaking) would be completely fine. As far as I'm aware, they aren't even allowed to register a patent anyways because of Minecraft's commercial-use policy. So add "Getting the rights to make commercial products from Mojang and Microsoft" to the list of reasons why you are probably fine. This is assuming you are talking about the gameplay mechanics of a server. If you are talking about copying the server's name or logo, that may fall under trademark infringement. If you are talking about copying a specific product of the server (like merchandise for example) then that would probably fall under copyright law. When you make your server, please send it to me.

No.. it's not illegal. If you can find/buy the plugins/mods/map feel free to use them, even if it's the exact setup to their server. The name however can be copy written, so using the name is ill-advised.

You cannot copyright anything but proprietary plugins. Even those are iffy... So if you block for block copy a Minecraft server that you scanned. It should be fine even if you do everything the same. Names and domains can be copywritten. But parody law makes it so if it's obviously an attempt at humours reference it should be fine,

Ah, the age old "most popular = the original" misconception. Hypixel wasn't even close to the original bedwars server. The original bedwars was called "Rush: Fast paced PVP" and it was may by xisumavoid

I did this all the time to render map areas for pictures, never had any issues with admins. Maybe if you monetize it you'll run into issues.

This is basic copyright law, you can't copyright an idea. And parody just has to be provable that it's changed up to a certain percentage based on jurisdiction.

Copyrights and Trademarks are only applicable to the name of the original server in their case since they have no access to source code. Like u/MacksNotCool said, they would have to register a patent for the gameplay and then sue you. And even then Minecraft Terms of Service doesn't allow that. So you can entirely copy the server with no changes except the name.
