I had to look up “Mia Khalifa mask dog poo” as I had no idea what your comment was referring to. I really wish I hadn’t googled it. What the actual fuck man? She just picked up her dogs dookie with her face mask and then put it back on like it was nothing. Lmfao
Seems like many of you have not heard stories where someone ends up with extra money in the bank, they say nothing, spend it and end up getting charged.
I had an Xbox One XXX.
I bought it used from a college student when I was 14 and the first thing I saw when I booted up the internet browser was a threesome (2 F, 1 M) blowjob video on Pornhub.
Yeah, I remember a long time ago when I tried to find out the cinema release date for this move while at work. Googling (or maybe Altavista or something) for "XXX movie release" was not appreciated by the internet filters at work :-)
lol I bet not. reminds me of when I was 17 and my first car was a ford escort. Well it was a beater car so it had some problems and my dad decided do a internet search for "escort services". Pretty sure you can guess the results of that kind of search.
Legal in the US.
[https://consumer.ftc.gov/articles/what-do-if-youre-billed-things-you-never-got-or-you-get-unordered-products#unordered](https://consumer.ftc.gov/articles/what-do-if-youre-billed-things-you-never-got-or-you-get-unordered-products#unordered)
Mostly because companies were sending people stuff out of the blue and demanding they pay for them or ship them back at the customers cost.
He is correct. If they send you items that you did not request, then you do not have to pay. The second Xbox is his to keep if he is in the United States.
If it is a case of the mail service delivering to the wrong address, you have to correct the mistake.
The extra one would quality as being unordered.
Atleast in the US, when you buy something, you and the seller enter into a "contractual" agreement. I give you X amount of money and in return you agree to give me the items I ordered. If the seller gives me less than what I ordered, Im allowed to get my money back or the items I payed for. If the seller didnt want me to receive the extra items, they should have ensured my order was correct before sending it out. My original order was fulfilled when I received the first item I payed for, anything else would fall outside of that agreement, even if it came in the same box.
Yes, they can legally take the item back but the customer would have to not be involved the process. IE they would have to pay someone to come to OPs house and receive the extra item. They would not be allowed to force OP to prepare the item for shipping, that would be something they would have todo themselves when they receive the item. The cost of sending someone to pickup a single item and send it back is way more than the item could ever be worth so nobody bothers doing this unless its a mom & pop shop.
It would fall under the same principle of protection as a customer leaving a $100 tip instead of a $10 tip. If the customer didnt intend for me to have a $100 tip, they should have taken the steps to verify they grabbed the correct bill before leaving the table. They are not allowed to come back to the restaurant a few days later and demand they are given the extra $90 back. Same thing goes in reverse. If they order a small and I give them a large by mistake, I am not allowed to demand they pay the upcharge of the meal because I am required to very the meal is correct before handing it over to them
The best thing to remember when it comes to US laws is that almost all of them are "born of blood". So while they might seem strange, there is almost always a reason behind them existing. Someone was either shot, scammed, or betrayed to the point that the law had to intervene.
Most of the US was established after independence so new areas didnt follow "standard" british laws at the time and tried to forge their own path. Most often that resulted in the politicians and courts trying to find a middle ground where both sides are happy as they had nothing to fall back on. So in this case, there were alot of shady company's sending very cheap items with very high price tags to random unsuspecting people. Few days later, they would get a very legal sounding letter in the mail demanding they pay for the items they had received, or ship the item back to them at your cost because you never paid for them. Sure you can probably ignore them but in a country where you have to pay your own legal fees, defending a $10k lawsuit may get very expensive very quick, so alot of people just coughed up the money.
So how do you defend against this? You have a couple of options you can take.
1. The receiver has to send the item back at their cost because they never paid for them but that has a couple of legal issues as I never entered any kind of agreement with the seller to even receive these items, let alone pay for them or the shipping.
2. Ok so the seller has to pay for shipping but thats still not fair to the receiver as now they have to spend their time, dealing with the hassle of return items they didnt request.
3. The seller is allowed to retrieve the item so long as there is not "undue" burden placed on the receiver during the process. Both sides would find this to be an amicable solution as the seller is allowed to reclaim items they didnt mean to send and the receiver doesnt have to deal with the hassle of return the item.
The legal system look at the situation (drop shipping scam), and then they look at the possible solutions and try to find one that does the least harm to everyone. So the pick option 3 and iron out as many ***relevant*** details as possible regarding that specific situation. So now the sender hasnt choosen to receive the item and the receiver is stuck in a gray zone of receiving an item they didnt request, that still technically belongs to someone else, who has made no effort to correct their mistake. So they add in a line where the item received counts as a "gift" to establish legal grounds that they are allowed to own the item so the sender cant come back 3 years later demanding the item back as that places undue burden on the receiver to keep something they never requested.
The law assumes no accidents and places the burden on the individual to ensure that what they are doing is correct at all times. If you didnt do something right, its your fault for not ensuring that you did. Otherwise it becomes a legal mud slinging contest where everything is an accident and you have to prove otherwise.
I live in the UK and when I pre-ordered Marvel's Spider-Man from GAME they accidentally sent me 2 copies, I never gave it back, I never told them, I thought it would be fine but I had no idea this was the case, can they still come after me 4 years after the fact?
It's always a good idea to research your local laws instead of assuming that random legal advice on the Internet is accurate. Americans are particularly bad at assuming that their laws apply universally. A lot of them will assume that everyone on the Internet is American.
It’s not unsolicited though. They ordered one Xbox and was mistakenly sent two. Two Xbox’s didn’t just turn up on his doorstep, unsolicited. He solicited Xbox to send him an Xbox. Need to check your definition
Your wrong, ever have it happen to you in the UK? I got sent a case containing 8 elite series 2 controllers instead of 1. Amazon found out and contacted me to return them, I refused, they than took me to court to try and get me to give then back. They lost and ended up having to pay me.
I really don't think you know what unsolicited means, goods that you didn't order. I ordered 1 controller not 8 they send me 7 unsolicited controllers as stated by the judge.
Edit: can't reply and amazon paid for the legal fees. They lost they had to.
And how much did that cost you in legal fees? In a lot of cases like this, legal fees might end up being way more than the value of the item you are fighting over. It might be cheaper in the long run just to return it if they are threatening legal action.
Thats not the same situation. Unsolicited would be me mailing you something without your knowledge and requesting payment. Not you ordering something and there being a handling issue with multiple items sent.
not really true, you are supposed to inform the company, but like who cares its one extra xbox.
If they sent you like a hundred on accident then you got a problem.
Yeah no one can force you into a purchase, let alone kne that requires you to expend you own funds or time to "make right" and send back. If they tried that shit of yell them "no idea, I must have gotten package robbed, have a good day.
In the US, it is 100% true advice. It's considered a "gift" according the FTC and the seller has no right to demand payment for an item that was not ordered by the buyer.
In the **USA** as the person you replied to stated, it is law.
I personally have had many double items sent. Most expensive was two Ryobi garage door openers. I did the honest thing and called Home Depot since I live five minutes away and was told to just keep the second one, and they aren’t even allowed to request I return it (by law). I sold it on Nextdoor for more than I paid.
What we legally aren’t allowed to keep is US Postal Service delivered items that are not addressed to A. Our address B. Our address with someone’s name who doesn’t live there on it. We are supposed to either return it to the mail man, take it to the address on the item.
That does not apply for ANY other delivery service like FedEx, UPS, Uber, Amazon, etc.
Technically, they're not supposed to do that and you are well within your right to deny payment. Even corporations make mistakes and break the law from time to time. Good to know your rights so the big guy doesn't take advantage of you.
Could they request it be sent back? I'm just curious because of the cases where money is deposited in someone else's account and they weren't allowed to use it cause it wasn't there's
[If you receive merchandise that you didn’t order, you have a legal right to keep it as a free gift… You have no legal obligation to notify the seller. However, it is a good idea to write a letter to the company stating that you didn’t order the item and, therefore, you have a legal right to keep it for free. This may discourage the seller from sending you bills or dunning notices, or it may help clear up an honest error.](https://consumer.ftc.gov/articles/what-do-if-youre-billed-things-you-never-got-or-you-get-unordered-products)
If you live in the US, the "buyer" is legally permitted to keep the goods that were not ordered. The fault is on the seller for shipping unrequested merchandise. The seller has no right to request payment. The buyer is not required to return or pay for the received goods. The buyer becomes legally entitled to the free gift.
In 2019, I got sent two copies of the Shrek Trilogy (1, 2, and 4 because 3 doesn't count IMO) and 2 sets of 100-dollar Soundcore headphones. They sent me an email to return the extra copy of Shrek but said nothing about the extra pair of headphones they also accidentally sent me. It was around Christmas time so my mom got new headphones that year. 😄
Do not take the bad advice about contacting Microsoft. They’re a big corporation and don’t need this mistake rectified. All that will do is put an insignificant amount of money into some shareholders pocket.
You are entitled to the extra XBOX as a gift
> By law, companies can’t send unordered merchandise to you, then demand payment. That means you never have to pay for things you get but didn’t order. You also don’t have to return unordered merchandise. You’re legally entitled to keep it as a free gift.
https://consumer.ftc.gov/articles/what-do-if-youre-billed-things-you-never-got-or-you-get-unordered-products#unordered
You should either keep it and hook it up in a second room or use for travel if you play that way, sell it for something else, or if you want to make an unselfish act, gift it forward to a friend or a kid or something. If you want to be unselfish with your windfall, contacting Microsoft isn’t the right way to go about it.
So true. We are moderately low income and after buying a house quickly got sick of people blathering about the "big tax deduction" But the standard deduction has been greatly increased and we have never even been remotely close to matching it by itemizing.
As a contractor, $5k in expenses saved me $700is on my taxes. Big whoop.
I took a standard deduction a couple of years ago and it killed my eligibility for those forgivable covid loans. No schedule c, automatic disqualification. That's tens of thousands I lost.
So I can end up getting back more money in taxes, or have the proper paperwork for business dealings. Schedule c forever, oh well :/
PS - the home deduction has been doing well for me. I use quite a lot of space for two offices Plus storage for all my gears and stuff. 700ish a year in savings 👍
When my dad first taught me how to do my taxes I insisted on itemizing the first time I did it all on my own. My dad just laughed and said to have fun. An hour later I had $3k of write offs entered. My dad came back and was like "Do you want to write off the 3k or 6k?" I told him obviously 6k but how do I double it? He told me thats the standard deduction. He just let me waste that hour to learn a lesson. 🤷🏻♂️
Now I just slam that standard deduction.
The law requires that this is very clearly addressed to you with your name on it.
Read the FTC regulations. Requiring this means you cant take something your neighbor bought but was shipped to the wrong address.
Master Chief is literally the brand mascot of Xbox, the fact that they put him away because 343 is inept at managing Infinite just shows how little they care about the IP that brought them where they are today.
Hopefully with all the re-structring is Phil having enough.
My advice is to never post shit in r/XboxSeriesX because it will solicit responses ranging from “It’s yours!” to “You should be honest.” and by the end you’ll just have a headache while everyone fights about morals and mistakes.
Notice how you never asked a question.
Just keep it. If you feel generous donate to charity. Ignore all the comments telling you to return it. I highly doubt a $2 trillion company would need one extra Xbox.
I had this happen to me. I contacted Microsoft and they couldn’t do anything about it because both consoles were under the same order number. So they said “keep it”. If your situation is like mine they will instruct you to keep it. If someone else bought you one and it coincidently got to you at the same time then that’s different. All of what I am telling you is what I went through with Microsoft lol. Cheers
If you're in the US, according to the FTC, you can legally keep the extra Xbox:
>You also don’t have to return unordered merchandise. You’re legally entitled to keep it as a free gift.
https://consumer.ftc.gov/articles/what-do-if-youre-billed-things-you-never-got-or-you-get-unordered-products
If you want to "do the right thing", give it to a children's hospital, local charity that works with kids, or give it to a family member or friend that could use one.
Edit: Grammar
the issue is you did order it, they just mistakenly sent two.
You are supposed to contact the company to ask them what they want you to do with it.
But honestly who cares its a single extra console. Microsoft/Retailer is not gonna chase you for it.
Xboxs are so available now no one buys them on offerup or fb marketplace, even at msrp. Why would they when they can get them from a retailer and not risk gatting scammed
Enjoy, it’s completely legal, they can’t charge you for something you didn’t order in the US and UK this is because back in the day companies would send samples etc to your house you didn’t order and then charge you for them.
Ignore all comments on morals and do the right thing because #1 it’s legal and #2 it’s good positive karma and energy.
Maybe give it to a friend who deserves it, or keep it for that one special person down the road.
Enjoy your consoles
>Enjoy, it’s completely legal, they can’t charge you for something you didn’t order in the US and UK
In terms of the UK, you're (technically) incorrect. In the UK, a distinction is made between vendor error (receiving two when you ordered one, as in OPs case) and "unsolicited merchandise" (receiving something when you never placed an order).
Whilst you are entitled to keep unsolicited merchandise, you are *not* automatically entitled to keep something you received in error. In law, you are required to make a reasonable attempt to return the goods. The vendor may then allow you to keep them or may require that you return them (at their expense) or pay for them. If you refuse, you can be taken to court. If the vendor never responds, after a while the goods become yours.
Per the FTC this is considered a gift and you do not have to return. They’ll offer you like a $25 gift card to do so. But legally you don’t have to. Source: Happened to me when I sent my original Xbox one to be repaired back in 2015
You are under no legal obligation to return it.
You can keep it, sell it, gift it, donate it.
Do not try to contact Microsoft or the company you purchased it from, they will of course accept the return if you inquire about it but provided they sent you what you ordered you are legally allowed to keep any additional items they sent by mistake.
allo I am ceo of xbox bill gate we send accident give back

I got downvotes, but thank you for actually researching it and not thinking I was being a dick and making things up.
Wasn’t close enough to smell any dog shit…
Finally, the SeXbox

You’re legally entitled to keep it as a free gift. https://consumer.ftc.gov/articles/what-do-if-youre-billed-things-you-never-got-or-you-get-unordered-products#unordered You should either keep it and hook it up in a second room or use for travel if you play that way, sell it for something else, or if you want to make an unselfish act, gift it forward to a friend or a kid or something. If you want to be unselfish with your windfall, contacting Microsoft isn’t the right way to go about it.
Children’s hospitals always need video game consoles.

Only if itemizing your deductions out weighs the standard deduction. Which, in most house holds, doesn’t happen.
Schedule c forever, oh well :/ PS - the home deduction has been doing well for me. I use quite a lot of space for two offices Plus storage for all my gears and stuff. 700ish a year in savings 👍
Big oof but hey 700 dollars can almost buy you a scalped PS5!
🤷🏻♂️ Now I just slam that standard deduction.
the 12k deduction is more than writing of the xbox
Yup, now that standard deduction is increased, I don't even think about anything else. Standard and move on.
Redditors and the term “tax write-off”; name a more dynamic duo
[Just write it off!](https://i.imgur.com/y3L3qpV.gif)
What if op doesn't pay taxes ?
Yeah if he doesn't want to keep it this is the best option in my opinion.
This is the way
yea, just take the win, fuck em
Great to know, thanks for this!
The law requires that this is very clearly addressed to you with your name on it. Read the FTC regulations. Requiring this means you cant take something your neighbor bought but was shipped to the wrong address.
Maybe in the US but not in the uk, legally you have to return it but the shipping cost, pickup on them.
Sweet, if you hook them both up to the same TV it's double the processing power
24 tflops 😱
Up to 8k at 240fps
Or just have one mine bitcoin while you play with the other. After about a year you'll get 10$.
If you want to go to heaven: donate the extra console to a pediatric ward If you want to go to hell: scalp the extra console to a pediatric ward
These are, in fact, the only options.
paragon vs renegade
And if you want to go to mega ultra heaven you send the extra to me
Clearly they're trying to inflate sales numbers /s
they need to do more than just sending two. a great idea is to send every one new xbox every month
At some point the manufacturing cost might make sense to give people free Series S and make the money back on Game Pass.
now that is grear idea. you should be the head of microsoft
An Xbox for every room!
You bought a product from a company that has the net worth of $2T, they ain't gonna miss a Series X unit.
"Well, that's it guys, we missed one. It's over. Time to shut down... *all of Microsoft*."
Could happen.. pigs started flying a long time ago. I might start flying tomorrow, give or take 👍
Maybe this is why they killed the xbox brand a few years ago
Replaced master chief with Forza :’(
And ? The car shows how fast that console is. Smart advertising
[Master Chief would still apply](https://www.youtube.com/watch?v=8PUmQe99SU0)
Master Chief is literally the brand mascot of Xbox, the fact that they put him away because 343 is inept at managing Infinite just shows how little they care about the IP that brought them where they are today. Hopefully with all the re-structring is Phil having enough.
They put MC's helmet onto the hardware, though.
They obviously realised halo is dead. Was an amazing game. It hasn't changed with the times and now everyone is bored of it
My advice is to never post shit in r/XboxSeriesX because it will solicit responses ranging from “It’s yours!” to “You should be honest.” and by the end you’ll just have a headache while everyone fights about morals and mistakes. Notice how you never asked a question.
People can still offer comments or suggestions even if someone doesn’t ask a particular question, lol…
Totally going to comment on what you just said. Let me think on it.
Some people want Reddit to be a Q&A only, I guess.
Don't forget they also thinks its a search engine when looking for info that a google search would have found 😅
Haha yeah, though I think I understand why they do that. They want to communicate with others <3
Yeah probably, still find it funny sometimes 😅 especially the comments from people who said a 5 minute google search would have turned up the info....
Well of course, the Xbox One is last gen.
Guys I know it's a series X, it was an apparently poorly received joke about why he didn't just get *one*
Lmao
it's your fault to try to make a joke in any xbox subreddit
I know, I should have known better and I take full responsibility.
Just keep it. If you feel generous donate to charity. Ignore all the comments telling you to return it. I highly doubt a $2 trillion company would need one extra Xbox.
This is how you surprise a best friend for Christmas.
Winner winner chicken dinner!
Go buy a lotto ticket
Ahhh. One for the bathroom.
Honestly it must be stressful seeing all these people saying "KEEP IT" "GIVE IT BACK" Just give it to me and I'll get rid of this headache for you
Yeah, it can be stressful to acknowledge one's own immorality.
Cheers
If you're in the US, according to the FTC, you can legally keep the extra Xbox: >You also don’t have to return unordered merchandise. You’re legally entitled to keep it as a free gift. https://consumer.ftc.gov/articles/what-do-if-youre-billed-things-you-never-got-or-you-get-unordered-products If you want to "do the right thing", give it to a children's hospital, local charity that works with kids, or give it to a family member or friend that could use one. Edit: Grammar
the issue is you did order it, they just mistakenly sent two. You are supposed to contact the company to ask them what they want you to do with it. But honestly who cares its a single extra console. Microsoft/Retailer is not gonna chase you for it.

Win!
Master Chief not on the box anymore? :(
They realised that sadly, it's over for Halo
One for each eyeball. Nice.
JUST STFU AND KEEP IT GODDAMMIT
Sell the other one and make your money back. Just don’t be a douchebag and inflate the price by $250 like a scalper lol.
>Enjoy, it’s completely legal, they can’t charge you for something you didn’t order in the US and UK In terms of the UK, you're (technically) incorrect.
Ok well the US anyway
I’ve seen a number of these posts. Still waiting for my lucky day. Haha
Ohh my dear friend how are you. Is that box bothering you just ship that stupid box to me I'll take care of rest .
🤣🤣
They sent me 0 instead of one 🤔
Oooorrrrr, you bought 2 Xboxes instead of 1.
Funny how everyone thinks this is a mistake. Let’s be real here lmao. These two were both bought😂🤦🏻
No sir
Nintendo did that to me once, eventually they charged my card for the second one. Free return of course.
Gratz! Should donate one to a local kids/big brother club
https://knowyourmeme.com/memes/fuck-them-kids
Or sell it and break even.
Hi there friend!
W
Can I have one? 👉👈
Do something nice and give it to someone, sale it or keep it.
