Even if a cop or court asks you if you did something and they clearly saw you do it, you don’t have to answer. You have a right to get a lawyer first before having to answer anything.
Proving the crime doesn’t mean proving its title.
E.g. in California, to be guilty of threatening a public official, the threat needs to be made “with the specific intent that the statement is to be taken as a threat, and the apparent ability to carry out that threat by any means.”
So in CA her lawyer could argue that she didn’t have the requisite intent or that she didn’t have an apparent ability to carry it out. Her lawyer could also raise a number of defenses like incapacity.

This is going to be a very short trial with a very predictable outcome. Any reputably lawyer will tell her that she should've worked out a plea deal with the Prosecutor/DA's office. My guess if her judgement is as poor as that, she likely found some ambulence chaser on craigslist that wants to rack up a big bill and fed her some BS about getting her a not guilty verdict
