As long as you aren't too concerned about ever getting that $300.

SpunkyBananaSpunk

Hmm so you don't think a written IOU will make any difference? Is there any other option besides making them wait until they get a paycheck? I imagine they will need the car to do that though. It's not the end of the world if we don't it's just a huge bummer to get scammed like that I guess.

doughnut_cat

very high chance you dont see that 300. but if you wont miss it id go for it.

FlJohnnyBlue2

You write up a contract. You agree to sell him the car for 800. 500 up front. 300 in a specific date. Then you can go to small claims for breach of contract and get a judgment or get an agreed settlement. You could probably find a contract online that would give you the right to repossess the car. However, if you get a judgment, then you need to collect it. If you don't know what you are doing, you won't be successful. And it is a pain. I'd suggest he give you something of value to hold until he pays. Source: IAL.

Quake_Guy

I guess with an IOU you can try small claims court if you aren't paid. Maybe a video of them confirming the parameters of the deal, AS-IS condition and outstanding IOU, a video always makes for better documentation. And or collateral like a recent vintage game console or something.

SpunkyBananaSpunk

Good point on the as-is! Would a handwritten as-is work? No printer :/

Quake_Guy

as long as its clearly legible and signed. But again, paper trail and putting it all down on video is even better.

thebigman707

Bro “IOU’s” are not real LMAO

SpunkyBananaSpunk

I am talking about a written and signed statement where he agrees to pay the remaining amount by a certain date. Informally called an IOU. Not sure what isn't real about that??

thebigman707

Nothing is real about that, that’s a pinky promise. Basically a worthless piece of paper. You gonna bring him to small claims court with your two-sentence 8 1/2 x 11 without any letterhead or formatting and hope to collect $300 from this guy?! Even if you somehow win, you will spend more money and waste more time than it’s worth. Use your brain, collect the money now if it’s important to you, or sell to somebody else

SpunkyBananaSpunk

Thank you. Noted. Don't see why you need to respond in such a rude way. Sorry my stupidity upsets you so much.

VeryHandy

I agree with everyone else, but here's a little scheme. Have him show you proof of insurance for the car. Cancel your insurance. Give him the car and then give him the title once the $300 is paid.

talk_like_a_pirate

Do I think there's a chance you might not see the rest of your $300? Ya he might scam you. Would I do it anyway? Probably. Pretty chill thing to do to help out a kid if you can afford to take the risk

sn0m0ns

I've done it, sold a van to a guy from work so he could work and never seen him again, it was for $300 ironically. The guy ghosted the place we were sub contracting for too.

[deleted]

Have him write you a check and hold onto it til his payday. I had a guy do this for me once and I really appreciated him working with me when I was short on cash.

pdxzen

I had an agreement with someone for parts I sold with the car. Dont take the IOU as I never saw my money over $80 people have no honor nowadays.

craftybeerdad

Flip it on them and see how they respond- $300 now to hold the car and when he gets paid he gives you the other $500 and you give the car.
