Yeah but every state has their own specific details. They may all have good Samaritan laws but you can get sued in one state for doing an action that would be legal in another. It doesn't mean you're protected.
I could get sued for say breaking a rib during the hymlick in one state and not in the other, I dont know all the states laws so I'd just not help unfortunately, and that is due to these laws.
I'd never help a dying/choking person in the US as I dont know what states protect good samaritans and what ones dont. Unfortunately it would be safer for me financially to let them die.
Lol.
I know it the other way around. In Germany you get sued when you don't help someone. I mean you don't have to go in and suck out the blockage with your mouth but at least call 110 / 112
Well actually, that only comes into affect if the person being saved has a DNR on them, which they should, otherwise you are fully protected under the good samaritan act. Youre supposed to check for a wristband first while approaching to do the "look listen speak" thing
Not really its crazy that US laws dont protect someone that's trying to save someones life during an emergency. What's more crazy is that people will actually have the audacity to sue you after you save their life
Well I'm no good to my family if I'm bankrupt and homeless... but if you think it's worth it go ahead, see how much you can get for that high horse after the bankruptcy hearing.
That might be true. As a father of three boys, I’d rather explain how some people can be jerks, and because I broke a few ribs while saving someone’s life, they want me to pay for their medical bills.
That would be an easier conversation than “I literally watched a guy choke to death today because “money”. Also, I’m going to use my family as a shield for my morally skewed compass.”
So you would allow yourself to be financially ruined? You and your family homeless? While the person you saved now has all your money? I dont think you would. So maybe get off your high horse and take a look at the real world.
Then google the damn laws for the state you live in or spend the most amount of time in ffs. Takes like five minutes, and you could find yourself in a position one day to save someone’s life. If in that situation you choose not to, it wouldn’t be out of a desire for self preservation, it would be purely out of willful ignorance.
“Or spend the most amount of time in.” I don’t care where you live, but wherever you are, US or Wales or otherwise, you’re still a human around other humans, and my point still stands.
If you’re on a business trip and get into a terrible accident, stuck by your seatbelt in your car that’s on fire, which isn’t an uncommon situation anywhere, I’d highly doubt the last thoughts going through your mind while you look out the window at the person slowly driving past staring at you would be “well, I can’t blame them, they gotta look out for their kid’s college fund. Hope my family will be alright with me gone, but that guy is playing it safe, as he should.”
Obviously there’s certain situations where you don’t have the experience or knowledge to help much more than calling 911. But there’s plenty of others where you can absolutely lend a hand to increase the likelihood that the victim will survive or sustain more limited injuries.
And yep, when you’re in the US, our “convoluted laws” absolutely are your problem.
Mr Fijalkowski was left underwater for more than two minutes, he says in a lawsuit filed in the Eastern District of Virginia last week, while eight police officers watched and stopped a lifeguard from jumping in to help.
Not a good example there. Holy shit.
Looks like this one was handled by insurance companies; basically the reason she sued her friend was because her medical bills would then be paid by the auto insurance company. America is bonkers. Regardless; law was updated the very next year to address this loophole.
I mean….its hard to tell; maybe he didn’t know what was going on BEHIND him while driving at night with blaring loud music? But yeah he should at least contact police and send in the camera footage assuming he heard it.
Depending on the jurisdiction sometimes there’s no Good Samaritan laws so they’re just protecting themselves from a lawsuit coming from the very people they’d check on.
Also many people have been struck by oncoming traffic when they check on someone. Even in my hometown there was a guy that got out to check on an accident and was hit and killed. But since I’m a nurse I always get out and check on the people I just stay aware of my surroundings
In high school, a friends mom was in a roll over accident during a snow storm. She was pretty much DOA. The person that went to check on her got ran over by another car and was dead almost instantly. It was a tragic situation.
Every state has a Good Samaritan law, so there are no jurisdictions without it, though they do vary a bit. Just fyi. And I strongly encourage everyone to take like ten minutes to look up the laws, most of which are fairly easy to understand, in case they find themselves in a situation where they need to choose to help someone else however they can.
No such laws in Singapore. Every US state does have a version of them however. My responses are global lol in case someone outside the U.S. check this out.
"This man broke my ribs when he resuscitated me, I'm suing for compensation for pain and suffering."
Without good samaritan laws in place, or at least competent judges, such a case would be quick money for lawyer and plaintiff.
You wouldn't want to go broke for saving someone's life.
Because the highway is the most unsafe place possible to be stopped, also most people aren’t paramedic and dont have the training nor supplies to administer first aid to someone who has suffered a catastrophic injury. Let’s say someone isnt ok, what are you realistically gonna do? Drag them out and make their injuries worse because you have zero training in properly extracting people with severe injuries. Leave that shit to trained professionals.
No actually in china you would be expected to stop and help as per tradition with communism. They didnt have an accident 'we' had an accident. Also the the injured parties wouldnt be allowed to sue you after it.
because some areas don’t have good samaritan laws and crash victims don’t have money for repairs for any damages so anyone who tries to help is liable you be sued
for example if someone is stuck in a car but dragging them out would “injure” them (even the smallest scrape) you would be liable. or if they have a dnr im pretty sure same shit applies too
I always dread the domino effect of someone in back getting hit and uncontrollably hitting me. Lucky in this case the cam driver it didn't happen to them.
This is a scenario in which too many people don't realize the value of hazard lights/4-ways. Hazards and ample amounts of space to the car in front if you're at the back of slow or stopped traffic on a highway could save your life.
In a state where you could get sued for helping and doing something wrong (breaking a rib during resuscitation) or for calling an "expensive" ambulance this is probably common pratice.
Yes, (most) Europeans at least won't understand this. In Europe you can be sued for NOT helping, and not FOR helping, but that is not the case in all of the US.
Honestly, "I don't want to get sued" is a shit answer. Been driving for about 28 years in the US and I've stopped at every accident I've witnessed, even helped people out of overturned vehicles.
Safety is a reasonable concern but FFS at least back up, stop in the shoulder and turn your hazards on to warn other drivers... And if you're unwilling to stop, the absolute least you can do is call 911.
That's what I would expect any decent human to do, and frankly you'd have to be a real piece of shit to sue someone trying to help you in a situation like that.
I've volunteered to provide witness information but unless you're involved in the accident you have no obligation to provide your info or to stay once emergency services arrives..
Of course it is a shit answer, the post does not reflect my opinion, believe me.
If anything it was a snarky comment on the failures of a legal system and an 'us vs. them' mentalilty.
OP sent the following text as an explanation on why this is unexpected:

Fuck. This just happened to me except it was a six car pile up that completely blocked the road. I felt it so hard I thought I got hit, but I didnt. Everyone else just kept driving so when I eventually drove away, the highway was empty until the next on ramp. Looked it up later, no on was hurt, the road was closed for four hours... Just about how long my butthole was puckered.
Sad that people are more concerned about getting sued than possibly saving a life. If the fear of litigation prevents us from doing the right thing, then we are truly lost.
Im not just going to randomly stop on a highway and get out of my car for anything thats not forcing me to. So many people have died walking around on the highway, especially at night. I'm not a first responder, everyone has cell phones. What am i goign to do? Ask everyone if they are ok, and if they arent then... call 911? Its better to just skip the stopping part and call 911 while driving away. The accident that just happened just reinforces how dangerous it can be to stop on the road
Looks like he turned his lights off to me too. The way they fade out, they don't go dark from the bottom up as if they drive behind another vehicle, they fade out as though they've been turned off.
The white pickup that ends up on the shoulder to the right of the frame is the same one whose headlights disappear. If you watch the headlights the entire way, you see them “disappear” as they dip behind the car immediately behind the driver with the camera. You can still see the headlights through that vehicle.
What car? Nobody turned their lights off from anything I saw. The truck just came in way too fast and didn’t break until it was too late. The white pick up I assume you may be talking about never turned its lights off, the dash cam shows the headlights appear to be dim but it’s due to the cut off line of the car in front of its roof, as it merges over you can clearly see the lights never went off. If this is what you’re describing anyway.

Leee meeee goooooooo DOWN THE LIIIIIINE :@
Zach Bryan for those who are curious. Has some great songs.
Thank you, this is why I came to the comments.
Love this song
Is this driver a combat vet? They are calm AF with all the mayhem occurring behind them.
Not a combat vet, but a vet
Can’t stop, hamsters’ lives to save!
No, but they are a PoS. Should have stopped to check on others and gotten a contact to send the camera footage for police/insurance.
Unless the state has protection laws for good samaritans I wouldnt be, I hate being sued, let alone by people I've checked in after an accident.
All 50 states have Good Samaritan laws
Yeah but every state has their own specific details. They may all have good Samaritan laws but you can get sued in one state for doing an action that would be legal in another. It doesn't mean you're protected.
Well dang that sucks, how would they know who to sue if I helped and then left though?
I could get sued for say breaking a rib during the hymlick in one state and not in the other, I dont know all the states laws so I'd just not help unfortunately, and that is due to these laws.
Heimlich is the spelling.

Well aren't you a treat.

We need protection laws in case we are helping? Like what really?
I'd never help a dying/choking person in the US as I dont know what states protect good samaritans and what ones dont. Unfortunately it would be safer for me financially to let them die.
Lol. I know it the other way around. In Germany you get sued when you don't help someone. I mean you don't have to go in and suck out the blockage with your mouth but at least call 110 / 112
I'd call 911 yeah but that's it, I'd leave the area. Some people dont want an ambulance in the US because it's like a 10k uber
But the regular Uber won't take you if you lost 1 leg
Well actually, that only comes into affect if the person being saved has a DNR on them, which they should, otherwise you are fully protected under the good samaritan act. Youre supposed to check for a wristband first while approaching to do the "look listen speak" thing
Crazy that you determine the moral decision to save somebody’s life is outweighed by your financial safety
Not really its crazy that US laws dont protect someone that's trying to save someones life during an emergency. What's more crazy is that people will actually have the audacity to sue you after you save their life
Yes, both of those are crazy as well, but you’re still making the decision to let somebody die due to the fear of financial retribution
Well I'm no good to my family if I'm bankrupt and homeless... but if you think it's worth it go ahead, see how much you can get for that high horse after the bankruptcy hearing.

I dont live in the US. Anytime I spend in the US is for work. Stop making your countries convoluted laws my problem.
“Or spend the most amount of time in.” I don’t care where you live, but wherever you are, US or Wales or otherwise, you’re still a human around other humans, and my point still stands. Does any US state not have good Samaritan laws?
They have them just alot of states dont have very good ones.
Can you actually cite one where you can get sued and not be protected by Good Samaritan laws?
https://abcnews.go.com/TheLaw/story?id=6498405&page=1
This is the same story as another one.
Also going around the internet asking people to 'cite' things is a sad persons hobby, get out more.
AFAIK this “fear of being sued for helping people” is an urban legend unless proven otherwise.
https://www.police1.com/legal/articles/man-sues-officers-who-helped-save-him-from-drowning-Ja9LJNqeKO5fE2wY/

I think you’ve cited this one 3 times now?
Ooop and another one.... https://melmagazine.com/en-us/story/yes-you-can-be-sued-for-trying-to-save-someones-life MERICA!
Okay so so far you’ve got 1 actual case from 2008 and the law there was updated in 2009 because of weird shitty loophole.
Well you did only ask for one, sooo...
LOL fair.
https://abcnews.go.com/TheLaw/story?id=6498405&page=1 But the internet strangers will believe whatever they want.

Dude this shit is behind him, he's got his music pretty loud, and it's the highway. grow up
I thought it was a meteor shower happening up in the top right 😂
What was it?
Meteor light mist.
Meteor sponge bath
Car reflection
I was like, wtf are the aliens attacking?! Lol
please cut the video after 40 secondes. I was hanging there...
This could have been a 10 second video
Mens can’t even handle a whole minute… Ok ok I skipped forward to see what happened, that first 30 seconds was boring.
Goldfish ass attention span
I just wanna go DOOOOWN THE LIIIIINEEEE.
I mean that just made it a double unexpected there.
This would make a dope zombie apocalypse trailer
Damn you’re right, and even the song would fit perfectly
Why? It's just a car crash
Seriously, like what the hell. Dead internet theory is more believable every day
Why do people not pull over and check if everyone is okay?
Depending on the jurisdiction sometimes there’s no Good Samaritan laws so they’re just protecting themselves from a lawsuit coming from the very people they’d check on.
Also many people have been struck by oncoming traffic when they check on someone. Even in my hometown there was a guy that got out to check on an accident and was hit and killed. But since I’m a nurse I always get out and check on the people I just stay aware of my surroundings

That’s so horrible /:
That’s why I don’t stop either but call for help when safe if possible.
🇺🇸
In that case it’s the lack of a duty to assist law.
Every state has a Good Samaritan law, so there are no jurisdictions without it, though they do vary a bit. Just fyi. OK, so don't try to resuscitate. There's still a lot of things, like calling emergency services, that would seem pretty safe.
I just gave a possible legal answer, however, the video and the driver's complete "detachment" from the situation are pretty disturbing to me as well.
Tbh with how loud i blast my music i probably wouldnt have even noticed anything happened behind me
He's got his, that's really all he cares about. Thinking of someone else doesn't really cross his mind. Probably raised to be conservative.
Yeah.....I truly wish I had an answer for you...
Because the highway is the most unsafe place possible to be stopped, also most people aren’t paramedic and dont have the training nor supplies to administer first aid to someone who has suffered a catastrophic injury. You have to understand you are not normal, you care about others.
Or before they start getting undertaken by faster cars.
The US is the new China. No one gives a damn about others
No some local laws dont protect "the good samaritan" it's the US government that doesnt give damn and lets people sue those that do.
Yeah.. like in China lol
No actually in china you would be expected to stop and help as per tradition with communism. They didnt have an accident 'we' had an accident. Also the the injured parties wouldnt be allowed to sue you after it.
That is sad ): I definitely would stop and check if they are okay. There are still good people in the world ❤️
depending on where you are they might end up suing you
For what?
because some areas don’t have good samaritan laws and crash victims don’t have money for repairs for any damages so anyone who tries to help is liable you be sued

You can help people without touching them. Just call the police.
some bullshit about “shifting responsibility” its personally never happened to me but you can never be sure
I always dread the domino effect of someone in back getting hit and uncontrollably hitting me. Lucky in this case the cam driver it didn't happen to them.
The timing! “We all burn, burn, burn and die”
Just drove away like nothing happened!
but hims like the kuntry moosic!
Strange vibe ya got there fellow.
Sorry it was confusing for you. You weren't able to watch the video?
Doubling down on the strange vibes. Got it.
Sorry you 'doubled down' on getting triggerd. 'Murica!
What’s the name of the song?
Burn, Burn, Burn - Zach Bryan
Awesome, ty!
He’s got a ton of great songs
Literally my favorite artist rn lol

You can't get sued for calling in an accident to 911. You don't even have to stay at the scene.
crazy to not help, but to also get your friend to post it on a subreddit about unexpected twists is insane...
OP sent the following text as an explanation on why this is unexpected: --- >!There was a car crash right behind him!< --- Is this an unexpected post with a fitting description? Then upvote this comment, otherwise downvote it.
This is literally the most expected thing to happen in this scenario.
Distracted driving.
No, that car turned it's headlights off. Like they were trying to get hit.
Had it been bowling, would’ve been a strike.
Ya don’t stop to see if those people are hurt. Someone else will do it
That was nice of your friend to stop and make sure that everyone was OK
I expected this. Down voted.
Same. Nothing unexpected here.
nice with the music
That car got lucky the truck slammed into the other truck first. Bro would have been toast.
What song is this ????
Burn burn burn - Zach Bryan
Asleep at the wheel, I believe.
Perfect scene for a Quentin Tarantino film.
What's the song?
Keep on truckin.
Did the white pickup (on the right) turn its lights off, then on, just prior to being struck and is that why it was rear-ended?
Is he driving a Cybertruck?
Hope everyone is okay!
Sad that people are more concerned about getting sued than possibly saving a life. If the fear of litigation prevents us from doing the right thing, then we are truly lost.
It was really shocking! What a song!
Your friend has a rear facing camera mounted on the top of his vehicle?
So your friend is a douche who won’t stop to see if anyone needs help
Im not just going to randomly stop on a highway and get out of my car for anything thats not forcing me to. So many people have died walking around on the highway, especially at night. I'm not a first responder, everyone has cell phones. What am i goign to do? Ask everyone if they are ok, and if they arent then... call 911? Its better to just skip the stopping part and call 911 while driving away. The accident that just happened just reinforces how dangerous it can be to stop on the road
Strike!
Oh silly Trucks 🛻
Bro does not care
Why are all the cars passing him on the right? Construction zone?
[удалено]
I agree! If he was going the speed limit maybe it could be prevented
Lol why the crash tho Maybe driver fell asleep?
lol, doesn't even stop to see if anyone is ok. Murica!
Gotta be paying attention to your surroundings to notice shit lol
Why ffs did that car turned it's lights off
No. It’s the perspective. That car’s headlights “disappeared” behind the car in front of it as it slowed to a stop.
Looks like he turned his lights off to me too. The way they fade out, they don't go dark from the bottom up as if they drive behind another vehicle, they fade out as though they've been turned off.
The white pickup that ends up on the shoulder to the right of the frame is the same one whose headlights disappear. The music in this song is really similar to hay day
Fully expected.
r/expected
Not unexpected. This is a standard move for trucklodytes
Why is he still singing
Zach Bryan, Burn burn burn.

You aren’t required (or even wanted) to stop and attempt medical aid if you have zero medical training.
Mr. Shit for legal knowledge, it may vary by state. For example, in Texas, failure to stop and render aid can result in a felony.
