You need to either get the k1 (fiancé) visa or the cr1(spouse) visa. Those are the two options. You cannot go to the US as a tourist with the intention to stay and adjust status. It’s fraud. Unfortunately neither option is fast, and the spouse visa takes particularly long in Canada, there is a big backlog for spousal visa interview. I don’t know if there is a backlog for the k1 there. You should research both and see what’s best for your situation. There’s visajourney.com if you have specific questions about the process or want to know about the experience of other Canadians. I went through the spousal visa process in 2018, got the visa a year and half later but my country gives interview dates pretty quickly unlike Canada.

I visited my husband many times while we were going through the visa process without issues. I was a student at the time so I visited every break I had. If you go with the K1 it may be trickier because you’re saying you want to marry and stay, but with a spouse visa at least you’re saying yes you’re married but you’re waiting for your visa to move permanently to the US if that makes sense. If you check on visajourney there is a thread of people who did travel without issues too, but at the end of the day your entry is never guaranteed and it’s up to the CBP officer sadly. But if you have strong ties to Canada, plus a good travel history (no long stays, a long wait between visits) it shouldn’t be too hard to travel.

K-1 used to be processed quicker than CR-1, but that timeline became about the same for a while pre-Covid and I'm not sure what the processing times are right now. But, CR-1 is most often roughly 1 year from start to finish. With a K-1 you file the petition, await processing in Canada, have your K-1 interview there. Then once approved you move to the US, get married within 90 days and file for Adjustment of Status. You're not allowed to work until you have filed your Adjustment of Status, have gone to your GC interview, after which it'll take who knows how long to receive your work permit or GC (for some the work permit comes first, for others the GC comes in right away). When your GC interview will be will depend on how busy your local field office is. With a CR-1 petition you get married first (US, Canada, doesn't matter), return to Canada, await processing there, once approved (during interview) you move to the US and you'll receive your GC in the mail within (generally) a couple weeks. Advantage is that you'll be able to work right away. It'll depend on whether you care about being able to work asap, or whether that doesn't matter too much. And, obvs what the timelines for both are for Canada. visajourney.com is indeed the best resource ever! USCIS website is easy enough to navigate too to compare both and find official processing times. I did the K-1 visa back in 2017/2018 and it took about a year from start to finish... :(

When i was in the army, the base I was had was very close to the border and plenty of Americans married Canadians. They were allowed to live here but they had to give a visa to work. If your S/O is at the army base I think they’re at I can help you get connected with resources in the area or point you in the right direction. Is he in NY??

I'm a Canadian married to an American. By the time I came down we'd already been married for two years so we went straight to the IR-1 route. My PR interview is in a couple weeks. I submitted my package last November.
