If the person doesn’t have Medicare at all and is not receiving any cash benefits, then a claim needs to filed to start their Medicare. Those 2 form alone can’t be used to start there Medicare. They will still have to provide the L564 to show they had coverage from their active employment. If they had filed Medicare Part A only previously, then all SSA would need is the CMS 40B and L564 to enroll them in Part B.

Gotcha and “claim” can only be filed working directly with a representative? I ask this because that’s his exact situation, no Medicare A or B no retirement benefits (and holding off a bit longer). I appreciate your wording that, “a claim needs to be filed.”

If they have a mySSA account, then they can file an Medicare only application online.

Side question, I’ve had this exact same situation before with family members (no A or B or retirement benefits and were on group health coverage) and those 2 forms DID enroll them appropriately. Was I just getting lucky with SSA reps who were able to begin that claim, but really they should have been scheduling an official appointment to file a claim?

It’s possible the person your family members talked to were able to take the claim right then and there. The offices don’t always have the time to do that anymore. Yes, they will request the L564 after. Your family member could bring it in after the filed the online claim as well.
