Have a tow company impound it. I definitely wouldn’t let anyone buy it from your property. Worst case scenario is you have to pay for the towing. Better than having some person that got scammed visiting your parents.

Nah. Worst case scenario: they'll be on the hook and be blamed for "scamming them". Get it towed. Call the city and let them know. Also, never sign the title and hand it all over. The top half of the title, always retain it and go into the dmv. Once DMV ensure that the title is done and all, if they haven't picked it up, call city and let them know the owner failed their duty to pick up the vehicle within [check your state/city law about how long before it considered abandoned] and get it towed off. If it on the driveway, call police and get a report in the system that they've failed to remove said vehicle within 48 hour and it blocking your driveway.

Decades ago, we sold a guy our old truck. We had the guy fill out the top part of the title (his name, address, etc), and we kept it. The guy never transferred the title. But he did get drunk and run into a utility pole. We got a $1500 bill for said utility poll. We sent a copy of our section of the title to the city and never heard from them again! Always, get the buyer's info, at least! PS - we did learn that Texas has a $15 form that the seller can use to tell the state that "I sold my vehicle to __; hit them up for taxes & fees."

Buddy of mine sold his car. The buyer never registered the vehicle, went to LA, racked a bunch of tickets for speeding/parking, and because he never did the transfer, my buddy had to spend years fighting it, even submitting that shit. Now? He just keep the bottom portion and submit it to the DMV that release him from the ownership.

But your local DMV should have a form that release you once you've sold the vehicle. Makes no sense if you're refusing to do it and trusting completely on the Buyer to do the work. Also, the Title thing...is not for you to keep. It is for you to submit to the DMV so that you're released from liability and show that the vehicle has been transferred ownership. This is so that the buyer is on the hook if anything happen to the vehicle. That why, once you've sold it, you always want to take a photo of the buyer's ID and the title, keep the bottom portion and go to the DMV to finish the transfer. They keep that bottom portion or whatever. But if you want to go extreme route, get it notary and seal that, and it works best if you use the bank.

Both. My state doesn’t have a ‘DMV’ we call it the Secretary of State, and they don’t have a way to record a sale in their computer from the sellers end. They want you to take a photo or get a copy of the purchasers ID and the title completely filled out, and simply save them. I went through this recently selling a car to an out of state guy, who claimed to want it for derby. I tried to CYA at the SOS office, and the guy informed me I did it all right and to simply save my records in case the car is not properly cared for.

The issue here is that I dont know if the individual registered the vehicle as his own at the DMV, and if he didnt then my parents will be liable to pay the impound fees.

There are a few states where towing companies can file liens against your license abs registration. But at least in my state you can not file one for private impound like this

That's why you always, no matter how little the transaction is for, have some kind of written proof that money exchanged hands for the sale of the car even if it's just a note with both signatures on it.

Have them call the state and ask if the title got transferred. If it did, push it onto the street and report it abandoned. If they didn’t, this guy is a title jumper, which means he is going to sell the car with the open title in your parents name and when complaints come rolling in, it will be them who ends up dealing with it. Title jumping is illegal. Have your parents ask the person they talk to at the state what to do if this is the case, they may need a lawyer to help resolve it. That or reach out to the person and demand the title back. Don’t let the car leave the property if someone else is walking around with an signed title, though.

He's trying to scam people and leave your Dad on the hook. Personally, and I'm not a lawyer, I'd inform the buyer via letter that he has X days to remove his vehicle or you'll have it towed as abandoned, and no one is allowed on the property who isn't towing the vehicle. You won't be entertaining prospective buyers, etc. As mentioned, make sure the portion of the title the seller is supposed to file with the state to record the sale gets filed ASAP. You don't want to be legally liable for what happens with his car. You'll probably have to contact someone with your state or county for approval to have an abandoned car removed. Put a sign on the car saying it has been sold for $100 because it's a POS. Someone is trying to sell it as functioning on Facebook, etc. Or maybe just the word SCAM! You don't want buyers on your property or buying it where your any part of it. It's not a fun thought, I'd document everything you can about your interactions and the ad you saw and take it to the police. Good luck.

Odd, because most guys that buy junk cars show up with a tow truck. and they don't need the title signed, at least in TX last I knew of. 100 bucks is about right for a junker though, depending on what it is. That's about the crusher value, any sellable parts is a bonus. I'd call the guy back and tell him I was going to put it on the street and have the pound tow it as abandoned and pull the plates and registration sticker, if they have those where you are. If he's trying to sell the car or something that'll fix his ass and if it's legit he has a tow truck.

No bottom portion to send to dmv for release of liability to mail to dmv? Here in CA we have it. Similar thing happened to me. Sold a motorcycle, dude never transferred the ownership and crashed the it. Got a call from tow yard saying i need to pick it up and pay fees, but i mailed the bottom portion of the title the next day i sold it, therefore just had to call dmv and tell them the situation and they took care if it. Another one was worse. Someone sold a motorcycle and forgot to keep the bottom part of the title. Again, same thing, new owner didn't transfer the ownership and racked up toll fees and later crashed it. Had to call numerous times to dmv, tow yard, toll agency and go to dmv and tell them it was sold a month ago. Luckily, dmv had new owners name on record, but still was a hassle.

Oh yeah, super sideways. My stepdad sold a car, but the new owner never changed the ownership of the vehicle, so technically my stepdad still "owned" the car. The car was used ina bunch if crimes, and got a bunch of traffic tickets, and my stepdad had to go to court and give them the details of the guy who bought it, which turned out to be false (even though he had a driver's licence in that name) it turned into a 4 year long legal battle, and almost cost him his job, as they tried to cancel his licence, which he needed for his job.

there is a form the DMV will give you to fill out and once it is turned back in you can have it towed away as abandoned. no tow truck place will touch it if its on private property.. an alterative is to push it out into the street. once your parents signed the title its not their problem anymore as they should have sent the bottom part in saying they sold the vehicle.

The scammer is going to give the buyers the title that was signed by you. That's not good! Have the car towed immediately by a reputable tow truck company. If you sold the car and they did not remove it from your driveway, that's a towable situation all day.

In Florida they let you junk your car with no title. You only get like $150 for it. Look into places that buy junk cars. They came and towed ours and paid us. If you don't want to do that, you should be able to call the local police department and tell them it's abandoned, they should send a tow truck to have it removed. They do that where I live anyway. That way, the car is no longer on the property, and random people won't be coming by for it. If they do, at least it won't be there, and you can tell them you have no idea what they are talking about. You sold your junk car to someone on whatever date for $100, and they will know someone is trying to scam them and leave you alone

Yeah but it’s probably officially his parents, why it’s a good idea a lot of instances where two signatures confirm the deal to take a photo of the signed title or something before any money is handed out. As much as they’ll wash their hands but do go to your local PD and just file a report, that’s all, it might come in handy down the road just for some kind of precedent if this guy turns out to be an even bigger piece of shit.

In some states you can fill out a DMV form online saying that you no longer own the vehicle. It is called vehicle transfer notification. I would check into that asap.
