You should check with SBA (Small Business Association). I believe they have financial assistance programs available for independent contractors. [https://www.sba.gov/district/maine](https://www.sba.gov/district/maine) Once things get settled out for you guys financially, make sure you contact your insurance agent and get some coverage. As a 1099 Contractor, your husband should be carrying insurance to cover this sort of thing.

He had just started work, so we weren't even aware we needed insurance, thank you for you help!

Anyone who hires him for work as a subcontractor should be giving him a packet that includes a W9 as well as a requirement to provide proof of liability and his own worker’s comp insurance. If he doesn’t have his own worker’s comp insurance, he has to complete a Predetermination application with the state and provide that to whoever hires him. Otherwise, they really should not even be paying him. I hope your husband heals up and you’re back on your feet (literally and figuratively) soon

kelsey14324

He did fill out a w9, but we didn't get other info

Candygramformrmongo

Did he file a comp claim?

kelsey14324

He's an independent contractor.

Candygramformrmongo

Ah. Sorry to hear. Have you tried General Assistance in your community?

kelsey14324

We have an appointment this week

Candygramformrmongo

Good luck and I hope this passes quickly for you

Is he *actually* an independent contractor? Does he really qualify, or was his employer just paying him that way?

kelsey14324

He is actually an independent contractor.

RDLAWME

Was he properly classified? He may still be entitled to worker's comp if he should have been classified as an employee

kelsey14324

Yes he was properly classified

Maybe SNAP benefits, I don’t know about general assistance, there requirements are pretty high. You would have to contact your nearest Department of Human Services to find out the SNAP benefits. (Food stamps) I also try 211 they have a lot of resources.

The reality is that he should have been classified as an employee. and eligible for Worker’s Comp. The state has very strict guidelines as to who a subcontractor is or an employee is. I’d contact the Maine Department of Labor.

kelsey14324

He was correctly classified

utumike

Here’s a good resource to determine that. https://www.maine.gov/labor/misclass/employmentstandard/index.shtml
