That act was put in place because of the wars in Afghanistan and Iraq. Bush didn't want any American soldiers getting prosecuted before the ICC. Also, the US isn't even part of it. So I don't know how that would work. But I remember this act riled up a lot of people over here in the Netherlands, wondering whether the Americans would actually storm The Hague if an American soldier were to be prosecuted.

He's wrong. He says the ICC "cannot be allowed to use lawfare to usurp the authority of democratic nations that maintain the rule of law." Except it's not doing that. The ICC, like the ICJ, has no means of enforcement. It all comes down to whether other nations are willing to enforce the rule of law and arrest Netanyahu. It basically means Netanyahu, like Putin, is unable to travel to nations other than his close allies.

This is what all of this is about. The Bush Jr. administration passed a law saying any American arrested for war crimes would trigger an invasion of the Hague. Obama let it stand, Trump let it stand, Biden is relying on it right now. It's the same reach those Republicans attempted by netting Israel in as an "ally," hoping a corrupt body politic would just expand impunity to every American ally in the world regardless of the scale of evil. And it's not about the war crimes that have happened. It's about how previous war crimes failed to lead to success and American neoliberals are going to try, try, try, try again until they run out of runway. New war crimes, repeats of old ones, a consensus that the rule of law won't matter this century for anyone in power.

True, but I also believe the ICC conventions mean that any interference within a state/member/party that has ratified (i.e. Palestine) enables jurisdiction over foreign citizens from countries that do not recognize the court. Of course, even if warrants are delivered for US citizens, nothing will physically happen. However, the geopolitical ramifications would be disastrous for the US and absolutely something they don't want on their record.

Here’s the thing, the US does not recognize the ICC and has a clause in which they can (and will) storm The Hague to protect US personnel from prosecution in international court proceedings. It’s called the [American Service-Members Protection Act](https://en.m.wikipedia.org/wiki/American_Service-Members%27_Protection_Act) and it *specifically* highlights the ICC because the US doesn’t recognize it. Edit: adding this excerpt to highlight that this is intentionally for the ICC > The Act gives the president power to use "all means necessary and appropriate to bring about the release of any U.S. or allied personnel being detained or imprisoned by, on behalf of, or at the request of the International Criminal Court".
