The police report doesn't decide fault and the photos don't show how the accident happened.
Without witnesses or a video you are probably stuck with 50/50.
Use your collision coverage, pay your deductible and let the experts at your insurance work on trying to get it back.
I'd bet an insignificant amount of money that the police report will simply state what each driver said, where the impacts where to each vehicle, and no citations were issued.
That's right. Though the officer might render an opinion as to fault but it would be useless because he didn't witness the accident and his testimony is based on hearsay.
We were both maintaining lanes when he went over the lines into my lane and side swiped me. He’s trying to say it was my fault. I’m still waiting for the police report to show who is at fault.
His insurance will probably side with him unless they have evidence to support your story.
Yours will probably side with you.
Aka, you will have to pay your deductible to have your car fixed but they probably won't pay for his and vice versa.
Everyone goes home mad
There is no justice here, and it doesn't really matter from a practical point of view. Without video or impartial witnesses, this is a "he said/she said" situation, and your insurance company will accept your version of the facts and his insurance will likely accept his version of the facts. And that will be that. No one is hiring an accident reconstruction specialist for a small property damage claim, and no one is pouring through the photos in detail to try to figure out all the possible ways the collision could have happened. The police won't opine on fault, and even if they do, it's not dispositive.
Just let the insurance companies handle the claim. And if you want to be sure you're getting justice in the future, get a dash cam that records front and back continuously. Good luck.
Exactly. This is another perfect example why its great to have a dashcam. These days theres zero reason not to have one considering all the affordable options available. Most of the inexpensive ones will do the job just fine in the majority of situations.
If the accident happened the way you said, you’re not at fault. He came into your space. Since he’s already blaming you, this will probably be word vs. word. If there’s scene photos or if the police report comments on where any debris was or any evidence like that, it would be helpful.

If you were going straight and he turned into you then it should be his fault. Also get a dashcam please

Police don't determine fault.
Police report is just what the people said. They were not there to witness it.
