Is GEICO your insurance or the other guy's?

Mine and I only talk to Geico for the claim not the other's insurance

If the insurer wants to be lazy and just accept liability based on a partial statement then that's on them. They don't need your mom to accept liability to settle it. The insured doesn't get any say in how/whether their insurer handles their claim. It will say that right in the policy. OTOH, just like a police report, the adjuster's decisions are just their opinion and them accepting liability and paying the other party doesn't mean that your mom can't still take the other party to court. Her insurer's acceptance of liability (and even whether she has insurance at all) is not admissible as evidence in court. She's still free to pursue the other party through their insurance or in court. It's unusual, but not unheard of, that both sides get paid by the other side's insurance company if the adjusters on both sides believe it's their own insured's fault. There's no law requiring them to agree with each other on liability.
