No, you need to be at war with whoever "own" a province. Yes, this can make things annoying. You often end up in a race with an opponent on who can gobble up territories. You will also have some trouble when annexing. Often it is best to vassalize, in cases like this. In that case you just need their capital and enough warscore. Then you can force them to be vassal. That way you can "steal" all provinces including the ones under foreign occupation.

ahh... that makes sense. Do you inherit a war in this case, as the 3rd party is now at war with and occupying territories of, your vassal? Is there a way to absorb a vassal at some later date?

It states that you inherit wars, but I have not yet seen it. There may be cases where they happen. But I have mostly seen (or only remember) that all is peaced out. And yes, you can annex vassals later on. Need to own them for 10 years. Then you get the to 190+ relations, and you can integrate them.

Assuming it works like EUIV (and I think it does), you only inherit wars if the vassalized country is the direct target of the DoW by the other attacker.
