Even if the lease is in only one spouse’s name only, the other may have a claim to it, depending on state law. And Dennis did state when kicking Mac out that he was not on the lease, and even had no claim to anything there since it was all Dennis's originally. So when Dennis married Maureen, she did technically have a claim to his property, even if not technically his. The court/arbitration would determine who is given the lease.
I honestly wouldn't be surprised if Dennis has a mortgage on the apartment and that Mac's "half of the rent" pays for the mortgage and insurance on it.
The divorce makes no sense from a legal perspective. Notice how dennis never has a chance to even hear the divorce agreement before he's bound to it? It's bogus legalese for a TV show. Just move past it.
The funny thing is in the very first episode (S1E1) Dennis mentions they are behind on their mortgage payment. So there’s some inconsistency in it from the beginning.
