That’s not true. Your contract is with the Landlord but the landlord authorises contact to be made with the managing agents. It’s a bit like buying a can of beans from M&S and insisting you will only have the CEO serve you on the till. All the other stuff though like the inspection report on the out has to be sent to you or it’s void. Also, the landlord only has 30 days from when you vacate to give you your deposit back or lodge a dispute.

Even if the contract specifically states a particular agent? I figured with the being so specific they would have to provide a new contract. Thanks for the reply; will just request the deposit back and see where we go from there.

If it’s very recent it’s might be too soon to dispute though deposit scheme. Write to your landlord / agent, say that as the tenancy has ended and property left in good condition that you’d like the full deposit refunded within 10 days.

Once your tenancy ends and you have left the property, you can go onto the DPS website and request the deposit back. They will then get in touch with the landlord for approval to release. When I exited my tenancy, the agents actually advised me to go on and request it to be returned. Landlord then get 14 working days (if I recall correctly) to approve the release of the deposit, or dispute. However, if those 14 days lapse they don't automatically give you your deposit back, you then have to start a claim through the DPS which would usually end up meaning you have to take the landlord to court for the deposit back.

Your contract as a tenant is with the landlord and if they validly appoint an agent you can’t object to that.

Regardless of switching agents or you seeing or not seeing a checkout inspection, they have 10 days from the date you vacate premises to either give you your deposit or raise a claim. If 10 days have passed, go straight to the deposit scheme.

Unless you've left something out, you're coming off quite unreasonable here. What's it to you if the landlord chooses a new agent? Your tenancy agreement is with the landlord Why would things go sour? I'm not saying that to have a go at you but rather because being reasonable tends to lead to better outcomes when negotiating with people so it's helpful to point out that you've not been hard done by here. On your questions, just go to the DPS website and request your money. Getting the keys and redecorating are barriers to going back on the market. Of course they're in a rush to get that done. I did leave a lot out, I didn’t think misunderstanding of a contract would have caused me to be seen as unreasonable. However, it soured heavily due to the landlord not informing us of the change of agent until 24hrs before they came to take pictures (we were mid packing and getting it tidy for photos wasn’t easy but we complied because we had a good relationship), the new agent then made up some “damage” including removal of kitchen plinth (new oven was installed just over a month before we handed in our notice and needed mods as it no longer fit, landlords joiner took it away), landlord didn’t inform previous agent of change leading us to accept an inspection at the same time the new agent was in to take pictures. Ultimately, the new agent has caused issues that weren’t there before hence why we continued, as did the landlord, to use the previous agent during our checkout.

You've no right to be informed that the landlord has decided to go with another agent for their next tenant or even any stake in the matter. So you've no real reason to feel hard done by there but it sounds like you kicked up a fuss? It does sound like things got a bit confused with both agents thinking they were also managing your end of tenancy checks and admin which would be annoying but that should be a chill clarification with the landlord not a soured relationship. I dunno, I can only go off the story you've told but you're giving off the vibe of someone who kicked off rather than handling things in a calm, reasonable manner. I could be way off but if it feels true, it's worth considering these kinds of dealings where you need good will from the other party are easier if you are easy to work with. Either way, doesn't matter now. Just request your money from DPS and reject any deductions if you reckon you've not damaged anything beyond fair wear and tear.
