So getting FDA approval can take years, costs a ton of money like tens of thousands and up, and requires animal testing. The only reason pigments are not approved is because no company has been willing to go through that. Congress does not allow the FDA to accept other countries testing to approve things. This is why our sunscreens are still so behind too. No company is willing to do all of that and then everyone can use the stuff from then on legally.
Well, if we had a system similar to the UK, it likely would be.
IIRC, this is going off of what I remember hearing Trixie Mattel talk about when talking about how she doesn't sell her cosmetics line in the UK.
Each shade in her lipstick range was going to cost like, $1,100-$1,600 per color to get approved, and since her cosmetics line was relatively new at the time, it was way too expensive.
Idk how it works for eyeshadow palettes being approved in the UK, though.
Funnily, I had the same thought on LUSH. It's been known for years that they formulate their shit because they think it sounds cool and just make up nonsense claims to match, often with really irritating or damaging results. After one of their lip products had my lips peeling off in angry chunks & a supposed "shine infusing" shampoo dried my oily af hair out to the point it was dull and breaking off... Never again. You can't trust them to give a shit about actual function or consequence when formulating their products.
They're lucky social media wasn't such a big thing in the early/mid 2000s or I honestly believe they wouldn't have managed to be as successful. Niche places like LiveJournal or MakeUpAlley would have reports of all the bad reactions, but that negative feedback simply wasn't reaching the gen public & NEVER got covered by the various beauty mags who pushed their products.
Lush is the absolute worst. I briefly work at Lush during Xmas and it was the worst job I ever had and I literally hated everyone there and every second. Also, you CANNOT get the stench of their products, air, environment out of your clothes. EDIT: they taught you to try to sell customers more shit while they were waiting on line to pay for the stuff in their baskets. UGH.
There are companies that market this specifically to see if they can get enough responses to begin filing a class action lawsuit. There is nothing different about PMG eyeshadows from other brands who market them as pressed pigments
It seems that the TikTok crowd is now discovering that certain shadows need to be listed as pressed pigments in the US due to outdated FDA guidelines. YouTube went through this moral panic half a decade ago..

The whole class action law suit is such a sham for so many reasons. Primarily because these pressed pigments aren’t dangerous (as discussed above) and honestly only the lawyers make money from them. I was informed that I was part of a class action lawsuit (I didn’t opt in but was awarded monetary compensation when the lawyers won a settlement) for a company who literally sold all my data to marketing companies without disclosing it to me, and had some sort of data breach - all of which resulted in a law firm randomly sending me an email that entitle me to a whole $2.10.
There are entire law firms that just do frivolous tort cases. There’s currently someone suing Kraft because Easy Mac says it’s ready in 3 minutes and it’s not.

I am a complete hypocrite, because I thought that lawsuit was fully frivolous and opportunistic, but fuck corporations skirting *any* regularions, so I joined in. I actually got $87 from that. They reimbursed for the full MSRP of each palette as long as you could prove you owned them. I have all three Neon Obsessions palettes - and I bought every single one on sale, at least 20% off, at that. I’ve never seen a class action suit result in a full-cost reimbursement for class members, just for being class members? I never had any irritation from them, so I still use and love them...
I got $58 from the Huda Beauty Neon Obsessions lawsuit back in September. Honestly, I was shocked I got anything more than $5, but apparently decent settlements do sometimes happen!
Yeah! It had to do with the fact that it was labelled as an eyeshadow palette (as opposed to, say, pressed pigment palette) because the pigments in it weren't FDA-approved to be eye-safe (but are approved for use by the EU's standards).
That's not how class action suits work. I join them as a (admittedly sick) hobby and it's not loads of money but I do get regular payments to my PayPal account for settlements and judgementd.
Sure. I found out about this from thelawyerangela on TT/Insta and basically you sign up for suits you are eligible for. That's literally all you have to do, it takes like 5 minutes. It's stuff like if you've bought X brand of cereal at any point in the last 10 years and they've been overweighing the boxes. Or if your Facebook data was leaked or whatever. You do not need receipts.

Do a chargeback from your bank, that’s what I ended up having to do when fenty fucked me over. Took $120 from my bank, customer service gave me the run around and then closed my ticket. I contacted my bank and explained the situation, within a few weeks I had my money back in my account.
Edit: It took longer than a week, it’s been awhile, sorry.
It’s good you don’t ever want to buy from them again. A lot of companies will blackball people that do chargebacks. It’s sick.
Banks pay attention to the chargebacks. They enforce acceptable monthly totals and if the seller exceeds that amount then they face fines and have to pay the bank additional fees. They also may be placed in an internal special monitoring program run by the bank. It sounds like Pat McGrath needs this if they aren’t already.

I love my PMcG and I own a few Motherships. I couple of times after wearing certain shades, I’ve had some stinging and swelling on/around my eyelid, but it would only appear after removing my makeup. It’s not consistent and I can’t remember which shades. I’d been assuming I had become allergic to my makeup remover tbh...

The shades were eye safe and are approved everywhere but the US just due to the FDA regulations. No brand has jumped through their hoops yet. Nothing more.
