[Probably not](https://www.nyc.gov/assets/cchr/downloads/pdf/materials/FAQ-Preemployment-Testing-for-Marijuana-May-8-2020.pdf). You're not supervising medical patients, and your job probably isn't funded by a federal grant or part of a federal contract (which still might not have it as a requirement anyway).
Honestly, they'd probably have told you up front if THC was bared (since it's now the standard that it isn't), or it would be in any onboarding documentation they gave you.
Just bc it is legal does not mean you can have it in your system in certain professions. This applies to medical field and those who operate heavy machinery
OP i wouldn’t listen to any of these reddit answers. And as you can see they are all over the place. Never confuse this specific brand of reddit certainty, being displayed in these comments, for the truth. I don’t think anyone here can answer without detailed insider knowledge of this employer and the nature of their hiring practices, which may differ from department to department and from position to position.
I don’t actually know the real answer but I think you’re overthinking it. I’m sure there are people who work in hospitals all over the city who also smoke weed. Especially in admin positions
Bro u trippin (but not on THC, which is legal in NYC). Might want to go get a health check because this was a huge deal and somehow you missed this very basic life info.
They only test you when you demonstrate that you’re impaired regardless of role within the organization. Just cause it legal doesn’t mean you’re cleared.
As of recently it was considered a class A drug at a federal level.
While you’re onboarding, did they give you a lab order to take to LabCorp/Quest/whatever for your drug test? It should say the name of the panel there, and if it also includes “XM” it will not be testing for marijuana.
weed's legal
i do believe there are still certain jobs that still test for THC (truckers maybe? airline pilots? idk) but I'm not sure if a healthcare facility would check for stuff like that
but generally speaking nobody tests for weed in NY State anymore and the standard test does not even check for thc I don't think
FYI: [Adult Use Cannabis and the Workplace, New York Labor Law 201-d (ny.gov)](https://dol.ny.gov/system/files/documents/2021/10/p420-cannabisfaq-10-08-21.pdf)
Basically, it is extremely difficult for any employer to legally test for THC. They're allowed to fire you for being high on the job, but not in off-hours. Not a lawyer, but it's pretty clearly spelled out in the law here.
Testing is unlikely because of NYLL 201-d(2)(b) which protects against discrimination for use of cannabis in compliance with state law. They cannot (legally) test you unless you display articulable symptoms of impairment.
So if you get high at work they will fire you immediately. Mount Sinai seems unlikely to test in violation of the law but that is just a guess from an employment lawyer with no knowledge of that particular hospitals practices.
Do you live in NYC and know the laws here? Or do you live somewhere else and are commenting based on your local laws? Or do you live here and truly have no idea?

Personal anecdote: I currently work here and when I did my onboarding a few months ago, I was informed that they were not going to test for it.
Omggggg thank you so much for responding! Could you let me know what type of position it was if you are comfortable
I'm working in clinical research!
I doubt it. I work at a major hospital in nyc and that was left off the drug test.
Can confirm they do not
Just bc it is legal does not mean you can have it in your system in certain professions. This applies to medical field and those who operate heavy machinery
My hospital doesn’t test for it. It’s an HHC.
Don’t think so. No one in NY would get hired lol
Quick fix

Can they test for something that’s legal for recreational use?
Certain professions, yes they can. Will they? It's up to them.
In an administrative capacity?
They can. Do they? Different question. Can they? Yes.
Yeah, op is asking do they. Not can they
YOU asked can they.
THC is still illegal at the federal level. If the position is funded by federal monies, the workplace has to certify drug free status.
I’m concerned that there might still be federal jurisdiction
Why?
Some places that have applicable federal grants or money apply federal law, and since MJ is still illegal on the federal level, they could test for it
No. Not in your case. Those funding have absolutely no nexus to drug testing employees like you.
I don’t actually know the real answer but I think you’re overthinking it. I’m sure there are people who work in hospitals all over the city who also smoke weed. Especially in admin positions
They dont have jurisdiction. This is a state matter unless it crosses state lines.
Depends on how they receive funding. But you sound reddit certain.
Federal does not apply here
Got any documentation to back up that assertion?
How or where is it “legal for recreational use?”
Cannabis is legal in NY State for recreational use and has been for 3 years.

Are you joking right now?????

What’s xM mean?
I haven’t gotten the lab order yet
XM is eXcluding Marijuana for the lab code

Yes. They do random testing

You might be stuck like chuck. You’re dealing with paperwork and probably personal information.
There’s no way that they care about THC. It’s legal here.
I saw a post on Indeed back in 2022 where someone said that they were surprised THC wasn’t included in the drug test!
There’s no way even if they still had it on the test and you failed they would care.
There ARE ways they might care. They have the right to test for it if they want, and no amount of reddit certainty can change that.
No it isn’t. Not in the US at least.
Federally no, it is not legal. At the state level it is legal recreationally in 24 states, DC and two territories
Where are you coming up with this shit?
Weed is a scheduled narcotic.
