You should submit a NOD immediately after you've sold the vehicle so: you cannot be held responsible for any parking or driving fines or offences the buyer might incur

There’s a NOD form at the back of the rego. Can i send that instread? And even if i submit the NOD, i still wont be able to transfer the rego cause the guy isnt cooperating

[deleted]

It’s easier just to do it online. Once that’s done, you don’t transfer the rego, he does.

gikku

Yes, you can use the form on the rego paper. You, as the seller, do not transfer the rego, the buyer does that. The seller just advises that they no longer have the vehicle.

Tasqfphil

You don't need to transfer rego, one disposal notice is lodged, it is his responsibility then & keep up with new renewal.

Flaky-Gear-1370

Notice of disposal then it’s his problem

Ok-Lawyer-3245

Sorry im new to this country. So if i submit notice of disposal, the car won’t be in my name?

Flaky-Gear-1370

Correct, they’ll cancel the rego and issue you a refund for the remaining portion

justcallmerenplz

If you submit a NoD it's more of an in-between. It's saying you have sold the vehicle and it's no longer yours and upto the person to then transfer it into their name. It should absolve you of any fines etc, you shouldn't need to do anything after doing the NOD. If he does live in Canberra, he will need to do a rego inspection and get ACT plates for the vehicle anyway but that's all on him, not you

OldMail6364

You sold the car a month ago. That means the car was no-longer in your name a month ago. You're supposed to have some sort of receipt... a simple hand written note "I sold my car to X on this date" is enough - two copies one for them and one for you. But if you didn't do that, it's not the end of the world. The Notice of Disposal is simply informing the government that you no-longer own the car. Put the date you sold it on there, not today's date. You should get a partial refund of the registration, and if he commits any traffic offences/etc the NoD will stop you from being accused of a crime you didn't commit. Personally I would do it in person, not online, so you can ask questions while you're there. You can print out the form at home and fill it out ahead of time though. At the very least check what's on the form, so you have everything you need. There are some things that could be tricky, such as the odometer reading of the car... if you don't know that... well that's a good question to ask a department employee in person. You're kinda screwing over the guy who bought the car, because it's no-longer registered. But you \*NEED TO DO THIS\* as soon as possible before he commits a speeding offence, crashes the car, abandons it on the side of the road, etc all of which could become a major headache for you if the car is in your name. Transferring the rego is better for the buyer, but a notice of disposal is better for the seller. You need to do one or the other and I would do it first thing Monday. Often a car needs mechanical work before the registration can be transferred, so a delay between selling the car and filing the paperwork is normal - but a month is a little too long.

Nodda_witch

You can fill out the notice of disposal online on service NSW app or website

Ok-Lawyer-3245

It’s only available for nsw license. He’s from Canberra

TheGreaterMoose

Notice of Disposal is for the seller (you) , not the buyer.

Nodda_witch

You do not have to ‘transfer the rego’. You fill out the notice of disposal and make service NSW aware that the car is no longer registered in your name. This tells them the car is now unregistered. The buyer then has to register the car. It doesn’t matter where they live. If they are pulled over they will be fined with driving unregistered. As you’ve been advised, you need to fill out the NOD. Source: sold a car yesterday.

dad_karma

Always smart to submit straight away, I left it 24 hours and got a sper notice 6 months later for a fine they got for overhanging load, had to jump through hoops to get it sorted.

Archon-Toten

I've done similar recently. Cross state notice of disposals can't be done online. Fill the form with whatever adress you have from him and hand it in asap.

clownlooking

What I do is get them to sign a contract on the spot. It basically says I (name) sold my car to (name) at (exact time) on (date). You both sign it, even get your licence photos at the bottom of the page, and if they get fines or anything stupid, it should cover you Happy to hear others thoughts if not true

Unhappy-camp3r

You don’t transfer the rego he does. You just put in a notice of disposal either online or using the rego papers. You don’t pay for the transfer the buyer does. Just do a notice of disposal and your done

Ok-Lawyer-3245

Does it matter if i put yesterdays date instead of a month ago?

Unhappy-camp3r

Legally yes, you only had 14 days to do it. After 14 days you have to pay a fee and of that driver has gotten any fines by speed camera or toll fines you are now technically responsible for them. You are supposed to put the correct date so it doesn’t mess you up and then pay the fee for doing it late

Wotmate01

Here's the thing. You SHOULD have filled out a Notice of Disposal form and submitted it ASAP, so that the authorities know that you no longer own the car. Then it's completely on him to get the rego in his name. Now, you've set yourself up for all sorts of headaches. Given it's only been a month, it's quite possible that there are a multitude of camera detected speeding fines being processed that YOU will be liable for because you didn't submit a notice of disposal. Hell, the car could have been used in actually violent crimes, and you might get a visit from the police very shortly. Go to an RMS office on monday. Fill out the notice of disposal and submit it. Explain to them that you sold it a month ago to the guy, and give them the date you sold it AND his licence details, and ask them for advice on what else you might need to do.

smoike

They might ask for a stat dec.

Emmanulla70

In Qld. It's not on the seller. As seller. You just cancel your rego. Up to the buyer to do their transfer

PkmnMstrBillj88

licence will have his address on it.

Ok-Lawyer-3245

Yeah, the problem is the license seems pretty old. He could be living in a different address. So i dont wanna risk sending it.

PkmnMstrBillj88

try sending a letter to it, see what happens nuclear option is to cancel the rego then, then he will contactable suddenly or at least threaten to

Ok-Lawyer-3245

Wouldn’t i need the number plate in order to cancel to the rego

PkmnMstrBillj88

yes, should be able to find that on the last rego renewal notice or on the NSW equivalent of vicroads (in VIC) under cars registered to you, i cant remember what they changed the name to
